Obama Defends Medical Marijuana, States' Rights

The Obama administration will not seek to prosecute medical marijuana patients or dispensaries as long as they conform with state law. A 3-page memo was sent Monday to federal prosecutors in the 14 states with medical marijuana laws. In addition, the memo was sent to top officials at the FBI and the DEA. The new policy guidelines tell prosecutors it is "not a good use of their time" to arrest those who are in compliance with state medical marijuana laws. While federal prosecutors will still attempt to arrest those in violation of both federal and state law, there are no details on how that goal will be achieved.

The memo stressed to prosecutors discretion when choosing which cases to pursue, saying it is "not a good use" of federal manpower to prosecute those who are in compliance with state law. This is a huge departure from the Bush administration, who insisted on ignoring state laws and continued enforcing federal drug laws. During his campaign, Obama stressed the importance respecting states rights and promised to change policy in situations where state and federal law clash. However shortly after he was elected, the DEA raided four Los Angeles medical dispensaries, creating confusion on where Obama stood on the medical marijuana issue.

While the memo does urge prosecutors to pursue marijuana cases which "involve violence, the illegal use of firearms, selling pot to minors, or money laundering," the focus remains on other crimes, not on the sale of medical marijuana. This is the biggest step in a year of huge steps for medical marijuana activists. While Massachusetts and California are working on bills that would make marijuana completely legal, the next best thing is a medical marijuana blessing from the guy in the head office.

what i dont understand is what makes it illegal to begin with. it comes from the earth. just like hops made for beer. add hops to beer you get fucked up and its sold in stores. add flame to a plant you get fucked up and hungry. i have been smocking happily for years now and not once did i see some one get angry, fight, well they might have gotten alittle upset cuz someone ate their tacos. but my dad was in a car wreck with a 17 year old drunk diver and she is out and about doing what she wants right now. but someone i know got 4 years cuz of pot!

many are hoping and praying for legalization and medical marijuana. the fact is that we need to be on top of this new heath care the governtment is tryin to roll out. if it is in any way controlled or influenced medical marijuana will stop in its tracks the government will control what does on their list of drugs what we can and cant take. we need to keep them out of control and out of the pockets that will be controling the new health care program what ever it turns out to be i see it as a threat to the movment not a friend they could co exist but it will be difficult to weave them together keep fighting the good fight we are making ground

You Know that this is good for all of us for instance im only 25 and i have major spine problems and dont have enough medical to cover surgery it dulls the pain. Plus any person that has something against pot has issues cause there are worse things that are legal that kill and dont help people. That is what the goverment needs to focus on not petty things like pot its a waste of money and manpower not to mention its been around alot longer than goverment has and probably even us.

I am not knocking you in anyway, however I believe that you are incorrect on your experiences with "young" people. I am one of those young people, and I am nothing of the sort, nor are damn near every other young people that I know. To me it sounds like you are stereotyping. I am as involved in activism as most of you "old heads". There is nothing more that I would love to see than legalizing marijuana. My generation has grown up understanding that the government has produced all this propaganda on trying to keep these "drugs" out of our hands. Which has led me to take my part and speak my voice at every venue, festival, and seminar that I can manage to find. Society is changing, and I do not deny that yeah, most young douche bags probably don't care about legalizing, but you gotta realize that there are plenty of if not more old douche bags who have the same theory. Again no disrespect, it's just that I felt I need to speak up for the young generation that gives a fuck.

Don't believe in what? I have read all study on the matter of MMJ to date. I have also provided terminal ill sufferers herb for free for years.

Young people I've encountered could care less about legalization. They just want to get high. They also think it normal to pay through the nose for herb.

I'm not sure what the previous post was about but to each his own. Also smoke dogg addressed something most stoners wont take time to think about and if they do they dont for long.We do share the blame whether it be from the racist or just down right stupid way we react sometimes.It mostly comes from younger and uneducated smokers that are just doing it to piss their parents off.We have to realize that we are going to have to do things, get involved in a respectful and responsible way.Such as supporting other states, write their officials after all the more states there are that approve MMJ the better.We have to prove we can handle something as serious as this is.

If you people really want that then how about you write your congressman...protest so that a law can be made enforcing punishment for these illegal raids. Everything can't be pinned on Obama. This is not just 'a memo'...if places are raided they'll have a little more to fight with as they can site (as it has been all over the news) that if they are legal users and dispensary owners, they cannot be busted without due cause.

Obv. there will be some who will have a hard time fighting against the feds but obama isn't idling about. He's busy and furthermore any thing he puts forth (if it was legalisation itself) must be passed by congress! Congress is the barrier, not obama.

When has anything in this country 'been given' to anyone? Those people in Cali. have the laws they have b/e they protested...they made their voices heard.

I feel your passion John, but there's a big difference between the street cops busting pot heads and the dept. that handles anti-terrorism. We still have a long way to go, but we have to have pro-pot people more on the ball. I was watching the special Pot City, USA last night, and it kind of disgusts me. They made pot legal for medicinal purposes and people are going ape shit to go all around the laws for legal cannabis just so they can sell to get major profit. yeah I used to applaud those assholes also, but the fact is, they are proving the point that potheads can't follow the laws and procedure, and that's hurting our cause more than helping. We can blame govt. and big corps. all we want, but we have to put some of the blame in our little circle as well.

i agree with everything john trustworth said. i smoke weed for medical purposes but im in florida, mostly anxiety and stomach problems, and i've tested it when i dont smoke in the morning an hour after i wake up my stomach hurts bad, and whenever i have anxiety if i smoke it helps me. LEGALIZE IT!

The only people who don't want marijuana to go legal are cops, and people in the drug industry. Cops don't want it legal cause it would mean they wouldn't be able to get their kids, cousins, nephews, good paying jobs in law enforcement. When it became legal in Amsterdam the crime rate went down by 2/3%, which means they stopped hiring new people. And the people in the drug industry don't want it legal cause then the public wouldn't be buying their drugs, which most of the time have as many as 5 or 6 harmful side effects, which means it cuts into their profit margin. These people are not concerned about helping the public they are mostly concerned about their own personnel gain. Marijuana needs to be legalized so we can focus our attention on the terrorist problem. You wonder why 9-ll happened, it happened because law enforcement was to busy chasing pot-heads, (which is as easy as catching fish in a pond). And the other people who don't won't it legalized either don't have a really bad medical problem or don't know enough about what they are talking about to even express a comment. So most of these people who don't want it legal are self-centered,
self-serving, inconsiderate of sick human beings. And on top of that we have yet to give legalization a chance to work. BASICALLY BECAUSE OF FEAR. The bible says god gave us seed bearing items for the good of ALL MAN KIND.
The only problem is MAN KIND turned around and use it for his own means, to get elected, to persecute others, and to use it as a means of ethic cleansing. If only they would give it a chance to work will we ever find out if legalization will work on not. And if it's so dangerous, then how can it be medically beneficial. It's because of self-centered punk-asses like cops, and the drug industry are don't want NO competition, they want to corner the market so they can create a monopoly and maintain that monopoly too. THEY ARE WHAT WE CALL, in WV, self-centered bastards. We'll find jobs for all you people if you would just give MARIJUANA a chance.

Just a few days short of 8 months,for the lawyers at the Justice Dept to write a three page memo,and finally putting it on paper. That is what money from the lobbies buy,,,delays.
Now the clock is ticking on how long it takes congress to remove marijuana from schedule 1 or explain how we have a medical marijuana policy for a drug with no medical applications.
Not down playing the importance of this hardcopy on a policy,it will help states that have been waiting for it to start their medical marijuana bills or move those pending closer too reality.

It is because of High Times that there is so much hate and ignorance in these comments and throughout this site!
High Times was a great magazine. It has steadily dumbed down and down and when the failed experiment of High Times as a Marijuana Free magazine did what it was destined to do, the powers that be finally gave up.
The magazine sucks and attracts the stupidest people. Homophobic, racist, misogynistic young males who couldn't grow a weed if they tried! There is no chance of open and honest dialog with a high times reader.
Then because there are not enough "stoner stoopid" young males around they exploit the sad and lonely pathetic souls who make up the make believe community of Face Book and MySpace. Ply them with lies about the worlds best pot (The ganja in amsterdam is a step below SoCal and three full steps behind NoNorCal.) and then disillusion them with the reality of a commercial venture that treats the judges like swine and allow people to vote whether or not they have judged even 1 single strain!
High Times attracts the type of people they do because of the magazine they are. Living off a reputation that was dubious in the 80s, exploiting the Forcade Trust and crawling into bed with Norml, even though for those of us who study history, know that egotist Stroup had a hand in the derailing of Marijuana decriminalization movement. (Dr. Peter Bourne - do your homework!) Norml really does mean the National Organization for the Referral of Marijuana Lawyers!
So don't waste your time. High Times is 30 years past its prime, and a decade or 2 past its relevance. High Times as a magazine without pot showed us that! And going from Ask Ed and Kyle Kushman and Jorge to Nico and CnP wizard Danko shows that anyone who will accept a substandard wage is qualified enough for High Times. I mean, Bobby Black was bad enough, but a magazine full of Bobby equivalent talent is criminal!
So, yes, Hatred and Ignorance and full out stupidity disguised as mediocre is all one can expect out of a poseur magazine like High Times because of the old expression in the computer world!
