Smaller Than Expected Prison Sentences for Montana Dispensary Owners

One slightly encouraging sign has emerged from the rubble of the medical marijuana debacle in Montana. Following the March 2011 federal raids of Montana dispensaries, the U.S. indicted over 60 individuals, with each facing a maximum sentence of 40 years and a minimum of five. However, the actual prison sentences of those taking plea deals have been relatively light, with everyone receiving between six and 18 months.

DEA Investigates Pro-Medical Pot State Rep

An ominous story out of Montana surfaced earlier this week when it was reported that thrice-elected state House Representative Diane Sands (D-Missoula) was the subject of Drug Enforcement Administration questioning of a potential witness in a federal investigation of legal medicinal cannabis dispensaries. Specifically, DEA agents from the Billings, Montana office asked the possible witness if Sands was part of a broader conspiracy engaging in medical marijuana sales.

Montana Medical Marijuana Setback

A federal judge dismissed a lawsuit on January 20 that had been filed by 14 individuals and businesses that provided medical marijuana and were raided by DEA agents in Montana during 2011. The ruling confirms that Montana’s medical marijuana law, passed in 2004, does not protect medi-pot providers from federal prosecution.

U.S District Judge Donald Molloy cited a 2005 U.S. Supreme Court decision, which stated that the U.S. Constitution’s supremacy clause applies in medical …More

Study: Auto Fatalities Decrease in Medical Marijuana States

Amidst all the recent doom and gloom in the medical marijuana scene, an encouraging new study indicates there is a marked decrease in auto fatalities in states that have legalized medi-pot. Though the research has yet to be peer reviewed, it has been posted on the website of the German Institute for the Study of Labor after being released jointly by University of Colorado Denver professor Daniel Rees and Montana State University professor D. Mark Anderson.

Montana Medical Marijuana Activists Fight Back

Faced with the loss of all medical marijuana dispensaries statewide, activists in Montana are in the process of collecting signatures aimed at nullifying the restrictions of a new law set to go into effect on July 1. SB 423, a bill passed by the Montana Legislature, will severely restrict the state's thriving medi-pot industry, shutting down nearly 5,000 medicinal cannabis dispensaries and providers.

Under the new law, medical marijuana patients can only grow their own cannabis or …More

Montana to Shut Down Medical Marijuana Dispensaries

The ongoing struggle to maintain medical marijuana rights in Montana received a major setback on Friday when Governor Brian Schweitzer announced he would permit Senate Bill (SB) 423 to become law without his signature. SB 423 will severely restrict the state's thriving medical marijuana industry, shutting down nearly 5,000 medicinal cannabis dispensaries and providers, putting thousands of people out of work in an already economically depressed state.

Making A Mess in Montana

Montana legalized medicinal cannabis in 2004 when a healthy 62 percent of voters passed the Montana Medical Marijuana Act. But during the neo-con Bush years, less than 7,000 patients registered to use medicinal cannabis. All that changed in October 2009 when the (in)famous “Ogden Memo” was issued by US Deputy Attorney General David Ogden, which stated patients and caregivers/dispensaries abiding by state law wouldn’t be federal targets. Montana pot patients quickly …More

Medical Marijuana Dispensaries Raided in Montana, Los Angeles

The Ides of March was indeed portentous for medical marijuana in Montana as on Tuesday, March 15 the federal government executed 26 search warrants at various medical marijuana dispensaries and grow sites (encompassing seven businesses), along with four civil seizure warrants (in which the Feds confiscated some four million dollars from banks in three Montana cities). The raids were conducted as part of an 18-month investigation that targeted both legal dispensaries and cultivating …More
