  • Marijuana Law Reform: Where The Ideas Come From

    The Coalition for Rescheduling Cannabis (CRC) recently filed suit in the US Court of Appeals for the District of Columbia challenging the Drug Enforcement Administration’s (DEA) refusal to reschedule cannabis. The CRC originally filed a petition to have marijuana removed from Schedule I of the Controlled Substances Act (CSA) and regulated like other substances with accepted medical use in the United States in 2002. After several years of review, and the threat of legal action, the DEA formally rejected the petition in 2011.

It’s also the time when public interest groups cast about for end-of-year donations, usually by touting their accomplishments. When it comes to the movement to legalize marijuana it’s all about what great progress has been made and how all the activists, interest groups, and leaders have had a real impact on events.     November 11th is Veterans Day, which makes this a good time to rally support for Veterans for Medical Cannabis Access (VMCA). This organization is committed to protecting the rights of Veteran patients and health care professionals to have safe and legal access to medical cannabis for appropriate therapeutic uses and to further encourage research on the use of cannabis as a treatment alternative.

    At an October 7 press conference federal prosecutors announced an ambitious and far-reaching crackdown on California’s medical marijuana dispensaries.

     

    In a carefully crafted strategy the federal government is not targeting medical marijuana use or the non-profit supply of marijuana to patients. The term goes back to the 1960s, and to many even earlier to the Beat Generation which preceded it.   • Rescheduling Cannabis – The Battle Heats Up

    On July 8th the DEA formally rejected an administrative petition to remove marijuana from Schedule I of the Controlled Substance Act (CSA). I prepared and filed this petition in 2002 with the support of several advocacy groups and patients, collectively known as the Coalition for Rescheduling Cannabis (CRC). The petition’s rejection, though, is not the end but the beginning of the battle over marijuana’s regulatory status in the United States.

     

    The DEA filed a lengthy report in the Federal Register detailing their reasons for retaining marijuana in the most restrictive schedule of the CSA. In short, they claim that marijuana has the highest potential for abuse when compared to other drugs, that it has no accepted medical use in the United States, and that it is unsafe for use under medical supervision.     Marijuana is regulated under federal law by way of the Controlled Substances Act (CSA). This, however, is a complicated proposition. 

     

    First, it may seem odd to many to discover that marijuana is actually regulated under current federal law. 

     

    Second, while these federal regulations are exceedingly strict they have not prevented various states from implementing their own regulations, which are sometimes contradictory.

     

    In more simple terms, the medical use of marijuana is prohibited under federal law but permitted under many state laws. Non-medical use of marijuana is prohibited under federal law but tolerated, by way of mild sanctions and/or sentencing policies, in almost every state.

    A lot of attention these days has been devoted to the medical marijuana issue. The advent of state medical marijuana laws has been one of the most visible signs of America's ongoing rejection of marijuana prohibition. The emergence of a multi-million dollar dispensary industry has also captured the attention of the news media, not to mention tax-hungry state governments.

     

    But the movement to legalize marijuana is based on society's obligation to provide justice to all Americans, and all Americans who use marijuana, not just those who have medical reasons to justify legal access to cannabis.     The next phase of America's long running debate over marijuana's legalization involves rules and regulations. Under what terms and conditions should one be free from the threat of arrest, sanction, and possible imprisonment for growing, selling, and/or using marijuana?

    It’s been a good couple of years for marijuana law reform, particularly with the advances of state-level medical marijuana laws and the emergence of local dispensaries in several states. The attention and public support received by Prop 19 in California has also stimulated national discussion on marijuana legalization, even though the measure was narrowly defeated.     Do you want marijuana legalized? Are you registered to Vote?

     

    Look, this is not complicated. If you want politicians to listen to you, you have to be registered to vote and you have to vote on election day. 

     

    Everybody knows by now that most marijuana users are young adults, and also that most young adults support marijuana's legalization whether they use it or not. The problem, politically, is that young people aren't registered to vote and/or young adults don't vote.

    The Obama Administration is reviewing marijuana’s status under the Controlled Substances Act (CSA) in order to determine if there are grounds for removing cannabis from Schedule I (the list of prohibited drugs).
