UPDATED 2009-WHAT ENDED UP HAPPENING:

By the time I finally made it to court I ended up getting probation for 11 months and 29 days. The judge told me I should have never talked to the cops in the first place because they had no right bothering me but at the time i figured since they were armed and all I should cooperate..lol. The judge said he knew I was a good father and that I worked everyday and he knew I would be alright. He was drug testing left and right but when it came to me he asked if I was clean, I said yes and he said Ill take your word for it(no shit!!). My ex-wife and her worthless stepmother were the ones to call in complaints on me, karma got em both in the end though. Even though I wasnt selling or sharing with students I was still in the wrong for even having it in my vehicle at work, so I learned my lesson there. My shit was all over tv and it was a pain in the ass in my small community because they tried to charge me with intent to resale at a school,even showing footage from a previous student bust at the school involving a few ounces, though I only had 2 grams in one baggie on me.By the time I went to court it was dropped to simple possession because they couldnt charge me with intent with what I had,they didnt tell that on tv though. Anyways, its over now and its a lesson learned.

Well,

The laws for Tennessee are: for any possession, it's only a misdemeanor.. that is, if it's your first time offense. So.. since you where in school, the penalty will most likely go up one class (or double). so, you may be charged with a Felony. Thats horrible news, but it's a way better penalty than I would have if that were my in Illinois. Good Luck Bro.

HOW did they know you had it? What were the circumstances of the actual seizure from your person? Did a dog hit on you? Did some cop demand you empty your poskets? We need to know more than this to help you..you ,ay have a reason to get it all thrown out ..give details.

How, exactly, did the authorities discover the 2 grams? State laws against selling in a school or within XX ft.of it are much harsher than possession on school property. Remember, whatever law applies to you applies to the students. Any of them serving hard time.

Oh shit man you better have a really good lawyer or they will crucify your ass.I know a guy here in Alabama who went to work with three lortab 7.5 pain pills in his pocket he had a script for them from his Dr.but they were not in the bottle from the pharmacy,he was pulled over at an intersection next to an elementary school searched and arrested for possesion of a controlled substance within five miles of a school.He used the public defender and the judge would not allow him to show the prescription,the dude got 3 years.GOOD LUCK MAN.

I wish I could offer any advice or information, but all I can offer are condolences. I also live in Tennessee, and a teacher at my old high school was recently busted with a small amount and a gun in his car. I saw no mention of a weapon in you story, but regardless, living as a fellowman under ridiculous Tennessee law, I wish you the best.

sounds like they are trumping up the charges in an attempt to get you to plead guilty to somthing bigger than simple possession when they start offering plea bargins.
they often get away with this when you plead guilty, even when they dont have the necessary/required elements to support the higher charge.
make damn sure that your lawyer-even a public pretender-investigates all necessary elements usually in your states rules of the court book. under the rules of evidence section.
better read it yourself to make sure that they are not fucking you over.
thats right they have specfic rules that they must follow to earn a conviction at trial. if they dont and you discover it it is a reversable error upon appeal.
but make the prosecuter work hard for the conviction, they might not want to work that hard for an adjudication that will only end up in a simple possesion conviction anyway when pushed

I live in Tn and i didn't read about this story at all i'm not sure hoe long ago it was but i'm sure i would of heard about this. but Tn is stricter then most states so i'm sure it's going to be alittle over a year if your not poped for selling at a school.

I don't buy that Ross Davis story. I told you guys that I work for a mental hospital and we have a drug/alcohol rehab program as well. Anyways, sites like this are blocked in a place like that, as a matter of law in some states, or just as principal. No rehab unit would let any patient go onto a site like HT especially if they are there for marijuana use. I mean come on. It's probably just eddie or that other loser trying to get a rise out of us. i feel bad cuz i took a pipe to school also but i didnt get caught,but theres a catch. cuz im smart i dont tell people that i have, but i stashed it good on a table,because i goto a military school which requires we wear r uniforms at all times, me as bending da rules put my jacket on table, as i left to play ball i came back and saw tha crown royal bag i put it in along with my scale lighters,ect just my pipe didnt make it, but i felt bad cuz my gurl gave it me and i still havent told her but neways.....as seeing that my pipe was 4 large pieces and a hundred lil shards i decided to just throw it, instead my my hommie wanted to fix, i said to my self knock ur self out but i doubt he'd get ne results, a couple hours go by and after lunch[finally] the sgt.s decide to let everyone have free time, as i was chilling with my hommie who said he would try to fix my pipa, al of the sudden one of the sargents calld my hommie and they staied talking 4 ahilw, and it was a random search cuz this fool had it buldgeing out of his pocket, trying to see wat they where doing i saw him raise the bag and say"i found a pot pipe" my heart dropped wen i heard him say that.....make a long story short, my homz got probation 4 a year. over a broken pyrex, is that messed up or wat?
thats a true hommie where he didnt even tell them where he got it form, knowing that i had a scale and well.....i could of gotten caught or more seriously in trouble then my friend[military school is considered federal goverment property]

They only state it as possesion with intent to resale because the cops only want the hightest recognition from the highest charge that they the can bring and prove against an offender. You won't be charged with the intent which greatly reduces your case and you probably won't do any jail time at all. You will do some probation, some drug testing, and drug classes. Your name is what is at stake. It sounds as though you are in a place where every, little thing is made out to be more than what it is. And you work for a school so they are going to make it out to be worse than what it is. All I can say is be smarter next time, but as of now your career and good name may be ruined. Temporarily of course.

Why did they really arrest you? The letter was very bland about that. Did the bag like drop from your pant pocket and they saw it? I would've ran into the bathroom and either flushed it down or swallowed it because those 2 grams are now evidence.

Yes I know what Marc was arrested for! But the thing is Marc is not a U.S. citizen, he is Canadian and Marc broke NO Canadian laws !!! Therefore the DEA had no jurisdiction over Canada. my babies mother been incarcerated otherwise shoudl would of been here today to testify that every wrod i stated while it may be complicated its true in a way you see this woman here today i hardly even know her ok maybe once or twice i might of give her a lift but she never lent me any money your honor every penny that she give me she said was a gift, she said it was a gift , my baby mother been incarcerated.
We had some trouble with a interstate cop who said he saw her driving while obliterated and became so frustrated by the way she wouldnt stop so they called out all the other cops and had a high speed chase and chased my baby through the side of a tree thats when i think they might of planted marijuana in the suitcase the court appointed lawyer told us to cop a plea, so we copped a plea.
I never had much luck with the ladies your honor, i never much luck with anything my baby mother wants to drive a mercedes your honor, my baby mother wants to wear a bunch of diamond rings, she knows damn well i cant afford these things.

ok heres what happened to me i was on tha run for 10 days str8 after escaping from police custody and i was riding in a car with some guys and my ex saw me called tha cops i was in a high speed chase 4 more than an hour until my guy lost control of the car when the cop side swipped us anyways i had 5 outstanding warrents we had about 2 lbs of green in the car and since my dumb ass was on the run i went down for it all i spent 6months in prision and now im on probation well just the other day i went to see my p.o and the cops was there so i ran cuz someone snitched me out cuz i sold a qp to a dumb ass

Now my name doesn't apply to everyone here - after all, I wish nothing but the best to all the friendly, respectful, tolerant and open-minded people who love to rock the ganj as much as I do - but come on, who are you people who come on here and bug out over some internet drama? Here this person, who's obviously in a world of trouble, needs some advice and all you can do is challenge eachother over nothing. This is the reason why marijuana laws remain what they are in North America; because we lack articulate, intelligent, dedicated leaders who can form some semblance of cohesion among the smoking masses. I've chilled with a few of the 'big names' in the weed world, and I've been seriously disappointed most of the time. Marc Emery was cool when he provided a free oz for a room full of people to smoke, but during his lecture he kept forgetting what he was saying. And then this Lawrence Cherniak guy, some of you heads might have heard of him, he's a real nut case man. He came to my university on behalf of the Students Against Poverty group to speak about marijuana reform and used the time to try to sell us his weed merchandise (which was of poor quality, and mad overpriced). I met a few other big names in the cannabis world while I lived in Amsterdam and they were cool (R.I.P. Eagle Bill), but most of the North American 'leaders' I've met have come off as being less than what High Times, Headz and Cannabis Culture make them out to be. Reading It's Me's posts I kind of get the same impression. It's not that your work at Hempfest isn't appreciated, but try to come of as more than an internet drama king. We have to show the world that us Potheads, and I use the term proudly Lashawn, are jusr regular people who happen to smoke a wonderful plant that is wrongly prohibited in Canada and the U.S. To Lashawn and all the other non-smokers on here disrespecting, all I have to say is, "If you don't like my fire, then don't come around."

1st conviction for any misdemenor carries a mandatory minimum fine of $250.

IF they get you with intent to sale you are looking at a felony because it is on schol grounds and to a minor. A mandtory minimum fine of $2,500 will apply.

Facially, you have a good case against the intent charge as long as you have a good lawyer, however, I am not familiar with TN law, some states automatically create a presumption by statute or case law that any possession on school grounds, especially by an adult, is a strong presumption of intent.

However, if you have under 1/2 ounce the law is unclear (at least from NORML) if a felony charge would apply to sale. I am not sure what effect, if any, this has in the school context.

They may also bootstrap a tax stamp charge, which is absolute fucking bullshit in my opinion. It is, more often than not, a felony for tax evasion.

Good luck to you as you pursue your case in TenNAZI. See if there are any NORML approved lawyers licensed to practice law there and if you can retain them, also try contacting local interest groups to see if they can refer you to one. Some bar associations may have referral services that can refer you to criminial defense attorneys who work specifically with these type of cases.

Also, there is a chance your case could be pled down to a lesser included in a plea bargain. Carefully choose if you want to plead the case out, in some jurisdictions a jury trial may be in your best interest because they can nullify the charge (that is, if you are guilty, they can find you innocent for ANY reason and the judge can't do a damn thing about it).

in my area you drive through at least one road block a week and to me thats alot since i live in the middle of nowhere!!!!!!! while mowing my lawn i heard a loud train like noise i looked up and to my surprise was a state police chopper a.k.a. pork chopper....this would be of not much concern if it was only about 50 feet off the ground and circling my property and adjoining fields for about 2 hours.... i have no fear because im not dumb enough to "garden" any where near my home for that very reason. but to me dont they have anything fucking better to do then look for some measley greens what the fuck go circle some child molestors houses you fucks.....to further piss them off i got my binoculars and watched them as they watched me.....like joe pesci in casino said so elequantly "peekaboo you fucks you!" hahahahaha

Well TN is a tough state I don't really know what the laws are for pot. But at least you didn't have a weapon on you that's some serious federal shit on school grounds. But for 2 grams that shouldn't be but a misdemeanor even being on school property. The Prosecuters,media, and rest are probably playing the scare card right? Saying but he was around children he was corupting children. I'm no lawyer so my only advice would be to point out clean record(if you've got one), also any community activity's. Admit your wrongdoing to the judge appologize (even if it's bullshit) but sound sincere. You may lose your job but shouldn't face jail time. By the way what was your job? Were you a teacher, custodian or other? Did the school resource officer come and place you ander arrest or did they catch you smoking/rolling a joint? I would have run to the bathroom and flushed it. I got caught 2 times. Once my first time at 15 years old (School). And second at 18 years old at my apartment. I was gone visiting family on christmas holidays for 2 weeks and my drug addict friend called the cops on my 2 plants that he probably smoked off of. A 4 year friend who's also going to get into trouble because he was living in my apartment for 2 monthes with my plants. Big story. He's running from me and cops :)

The only punishments I go was I was sent to my room.
And at 18 years old. I dunno yet. I'm 22 and they haven't called me in for court :).

I live in Canada so they'll go really easy on me but for US... Zero tolerance on drugs! Your a teacher so you got money. I'm sure no prison for you. Just one fat ridiculas fine!

Dude, I hope willy nelson jr didn't apply to be a teacher, however, had he done so, I can see why he wasn't accepted! Anger management brother... anger management!
Busted in school, You need to do the following:
1-Get rid of any evidence from home and get clean ASAP.
2-Look up NORML and the legal advice on this site (good stuff!) and SEE A LAWYER!!
3-Attend Narcotic Anonymous (NA) meetings and get a letter signed from an official there saying you attended before going to court, to show good faith.
4-See a psychiatrist and try to get him/her to attest to state of mind prior to the act (ie stress levels etc).
5-Seek councelling and volunteer for workshops (it shows rehabilitation).
6-Stay out of any further trouble.
Your saving grace might be a clean record but School grounds are THE WORST place for any drug use; due to the strict laws (quite rightly as kids don't need more reasons to start this stuff too early in life)! I'm thinking Felony with a fine or mandatory prison for 1-5 years. Try and appear genuine in front of the cops and judge as they don't like us smokers telling them what's right and wrong!

I live in California. About 8 months ago i was caught smoking on school grounds w/ 3.5gr of bud and a pipe. The officer tried to say that I was selling bud on campus to other students.....I might have been haha. besides the point.
I didn't recieve any jail time, but they did issue me a citation $150 and im not allowed to step foot on campus, or i can be arrested for "truancy".
I went through that bullshit. Fuck.... The school system is tough and they will prolly want to make an example of you...

In my state many cities have marijuana possession as a misdemeanor and also as a last priority for cops to arrest/fine for. If the cops REALLY have nothing else to do and they happen to catch a stoner smoking, its a fine and confiscating the weed. But that's only IF they (the cops) decide it's worth their time, most of which don't. I've also smoked on school grounds 5-6 times and never got caught even though there are cameras. I played it smart and never had to confront the cops about this. I hear intent to sale is 6 months in prison here in California; I don't know how much it is in Tennessee.

I don't know what the minimum sentence is but, in most states, carrying on school grounds ups a misdemeanor to a felony. Lesson learned, I guess. I would ask your lawyer what he thinks they may offer you and if he thinks you can have it reduced to a misdemeanor.
