Marijuana and Religion

Is the religious use of marijuana protected by the U.S. Constitution? The Ethiopian Coptic Church believes it is, and this important question is the subject of a lawsuit recently filed in Federal Court by Carl Olsen.
The Supreme Court has previously recognized the legitimate use of other drugs for religious purposes. The use of mescaline in Native American religious rituals is the most notable and well-known example of a religious exemption for otherwise illegal drug use. In 2006 the Supreme Court also recognized a legal justification for the use of the entheogen ayahuasca.
In 1993 the United States Congress passed the Religious Freedom Restoration Act (RFRA), which states that the “Government shall not substantially burden a person's exercise of religion without compelling justification.” In 2000 Congress passed the Religious Land Use and Institutionalized Persons Act (RLUIPA), which established a general rule that “no government shall impose a substantial burden on the religious exercise of a person residing in or confined to an institution.”
According to Olsen these statutory rules have great relevance to the subject of the religious use of marijuana. “Broad construction of the RLUIPA means that any deprivation of liberty by a state law enforcement agency would fit both the meaning of a pre-trial detention and an institution as described in RLUIPA. Congress has applied the RFRA to the states’ drug laws as it originally intended to do in the original language of the RFRA.” In other words, arresting people for the religious use of cannabis is a violation of these laws.
Olsen’s legal argument is much more substantial and complex. One of the complexities of legal cases involving government’s regulation of religion involves the manner in which the courts apply law and prior case precedent to a specific case. In the RFRA the Congress established that in religious freedom cases the government would have to establish a compelling interest to justify any substantial burdens placed on the exercise of religion.
In the ayahuasca case (Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal) the Supreme Court ruled that the government’s interest in uniform application of the CSA did not prevent courts from recognizing the use of the drug for religious purposes and that its status as a controlled substance was not a sufficient reason to prohibit its religious use. In prior cases involving the religious use of marijuana, which preceded the passage of RFRA and RLUIPA, the government has argued that it had an overriding interest in controlling marijuana use and distribution and that marijuana posed a real threat to public health and social welfare.
Olsen wants to revisit these issues in light of these new laws and the 2006 Supreme Court ruling on ayahuasca. Specifically, Olsen argues that applying marijuana prohibition to the religious use of cannabis is a substantial burden on a sincere religious exercise, and that this violates both federal law and protection of freedom of religion guaranteed by the Constitution.
In the past the government has argued prohibition of religious use of controlled substances serves three compelling national interests: preventing harm to users, preventing diversion to secular (non-religious) users, and maintaining compliance with international treaties. Olsen argues, in part, that the government cannot provide evidence that marijuana causes sufficient harm to users or society to justify the substantial burden prohibition places on the religious use of cannabis.

People use marijuana for many different reasons, including social, medical and religious motivations. One of the most important issues Olsen brings before the federal courts is not, as some would argue, that marijuana use should be recognized by the government as a legitimate religious practice. Instead this case involves a more fundamental issue: whether or not people who use marijuana religiously should receive the same legal protections as those who use other drugs as part of sincere, legitimate religious practices.
In 1984 the Iowa Supreme Court recognized that “Olsen is a member and priest of the Ethiopian Zion Coptic Church. Testimony at his trial revealed the bona fide nature of this religious organization and the use of marijuana within it.” The issue in the current litigation is not Olsen’s sincerity but instead the government’s refusal to provide Olsen equal treatment under the laws as they have been applied to the use of mescaline and ayahuasca.
Individuals should be able to decide for themselves whether or not they want to use marijuana. The primary argument for marijuana’s legalization is that the drug is not dangerous enough to justify keeping it illegal. Individuals should not have to justify their use on medical or religious grounds. Adults should be able to justify their use of marijuana on any grounds they see fit. It is an issue of personal liberty. Nonetheless, like prohibition of medical use the prohibition on the religious use of marijuana is a violation of deeply held American values that are protected by both the Constitution and federal law.
Carl Olsen is a true patriot for challenging the federal government regarding the religious use of cannabis, and he deserves gratitude, respect and support from the reform movement for this important lawsuit.

"marriage" REFFERED TO AS THE "STATE SANCTIONED RELATIONSHIP", Sanctions are usually monetary fines, levied against a party to a legal action or his/her attorny, for violating rules", such as "divorce".
So we have a preety wedding at "the church" which is of course seperated from the state. However we sign a legal doctrine with the state under our church. hmmmmm Did we somehow drag the states into our churches? Since we base our mariages on the legal document signed at church instead of focusing on church, more than 50% of marriages fail because the State is involved with our churches. I cannot find in any religion where it says "prenuptial" agreement. So knowing full well that we are going to our church to get married or sign a legal document with the state sooo to have half he/she half half half.
To the state: leave our marijuana alone and our mariages, your laws have corrupted the people of this country.

You should stand up for what you believe in. Trying to tell other people what they should believe in is a waste of time. If what you believe is true, everyone will see it when you make it happen. I'm defending what I believe in. The Constitution gives me the right to believe in any religion I choose, as long as I'm not hurting anyone. Courts are not allowed to decide whether religious beliefs are valid, only whether they are sincerely held. You are way off track here. If you get stuck into thinking that the validity of your religious beliefs matters, you will miss the boat (Noah's Ark, my friend). This is about freedom and liberty. Other than that, keep up the good work my brother!

I was republican Newt Ginrich, Rick Sweeney, Mark Souder, and Co. who wanted the death penalty for those bringing cannabis into America (ginrich was a pot smoker) Marijuana Death Penalty Act of 1988.
Republicans from Oklahoma and Nebraska wanted to force people caught with cannabis to have a limb surgically amputated (removed).
It is friends of the Bush family who operate drug testing facitilites, demanding our pee.

THe optimum situation would be where the laws of a nation are consistent with each of the expressions of the law of God. But, perhaps the bes that can be generally hoped for is that civil laws be found to not contradict the most universal expression of the law of God in creation- THE LAW OF NATURE. The heavens and the earth declare that law. Thus we may deduce a rule to guide us: only when civil law does not contradict this fundamental and universal expression of the law of God can it be recognized as prima facia valid. That is to say, civil laws, so far as can be judged from first appearances, are valid if they do not violate God's law as reflected in the law of nature. And we can know if our interpretation of the law of nature is correct if it comports with the Bible.
Consistency with creation, therefore, is the minimum test to validate the laws of nations. Historicallly, this was recognized in the legal maxim, lex spectat nature ordinem, the law regards the order of nature. A law which fails this initial test is of no binding legal effect because it remains unsupported. Every civil law requires the supporting testimony of the law of God in at least one of its expressions in order to be of binding effect. Indeed, no nation should be bound to a malum in se rule or law simply because it is written in a statute book.

Anyone can write to the individual justices of the U.S. Supreme Court at any time, although there's no guarantee they will read it.
Under the U.S. Supreme Court's ruling in Gonzales v. O Centro Espirita Beneficente Unaio do Vegetal, 546 U.S. 418 (2006), and claim under the Religious Freedom Restoration Act must be decided on a case-by-case analysis.
That means that if I lose my appeals, it would not prevent someone else from making a similar argument since every individual would have a different set of facts.
This is one of the most interesting cases that has come along in a long time. It puts major crack into the drug laws.
When you combine that with three U.S. Supreme Court justices comparing the drug war to National Prohibition (alcohol prohibition in the 1920s and 1930s), in the Bong Hits for Jesus cases (Frederick v. Morse), along with 12 states allowing cultivation of marijuana for medical use, you see a major fault line beginning to develop.

O Centro Espirita Beneficente Unaio do Vegetal, 546 U.S. 418 (2006).
The burden of proof for "religious exercise" is extremely low, Cutter v. Wilkinson, 544 U.S. 709 (2005), at page 725, citing United States v. Seeger, 380 U.S. 163 (1965) (belief in something equivalent to a higher power).
Cutter v. Wilkinson cites United States v. Seeger for the interpretation of 42 U.S.C. 2000cc-5(7)(A): "The term 'religious exercise' includes any exercise of religion, whether or not compelled by, or central to, a system of religious belief."

I comletely and totally agree that Cannabis used for both medical reasons AND for religious purposes IS portected by the United States Constitution. That being said, there are unelected Federal agencies that (unlawfully) prohibit the use of cannabis for any and all reasons. Such as Cannabis being classified as "have no medical use" when medical professionals and users know the complete opposite. It is truly a complete travesty that this unlawful abuse of power by an unelected appointed federal government agency has such broad sweeping power in this (supposed) free and Democratic Republic. It is is very important and essental that we all spread the real TRUTH about cannabis to anyone and everyone who will listen.
I send blessings to all those to spread the good word about cannabis to all and also to those spread Love, Understanding, and Kindness to All.

Considering all the uses for the marijuana plant, and the fact that in all of nature, the marijuana plant is the only one that produces a chemical which matches the human produced endocannibanoids, one might come to the conclusion that the marijuana plant was "made to order". Is this proof of intelligent design? Is there any other plant that could fit the bill of "The Tree of Life"?
(I would like to see a prehistoric Dinomarijuanasuar, 250 feet tall, with buds that weigh in at 100 lbs, each. But there is no proof that marijuana was here before man. At least, not to my limited knowledge.)
I think it's safe to say that the marijuana plant was created for mankind, by a compassionate Creater, to help mankind grow and develop into the wonderous creatures we are today....
