Marijuana and Religion

Is the religious use of marijuana protected by the U.S. Constitution? The Ethiopian Coptic Church believes it is, and this important question is the subject of a lawsuit recently filed in Federal Court by Carl Olsen.

The Supreme Court has previously recognized the legitimate use of other drugs for religious purposes. The use of mescaline in Native American religious rituals is the most notable and well-known example of a religious exemption for otherwise illegal drug use. In 2006 the Supreme Court also recognized a legal justification for the use of the entheogen ayahuasca.

In 1993 the United States Congress passed the Religious Freedom Restoration Act (RFRA), which states that the “Government shall not substantially burden a person's exercise of religion without compelling justification.” In 2000 Congress passed the Religious Land Use and Institutionalized Persons Act (RLUIPA), which established a general rule that “no government shall impose a substantial burden on the religious exercise of a person residing in or confined to an institution.”

According to Olsen these statutory rules have great relevance to the subject of the religious use of marijuana. “Broad construction of the RLUIPA means that any deprivation of liberty by a state law enforcement agency would fit both the meaning of a pre-trial detention and an institution as described in RLUIPA. Congress has applied the RFRA to the states’ drug laws as it originally intended to do in the original language of the RFRA.” In other words, arresting people for the religious use of cannabis is a violation of these laws.

Olsen’s legal argument is much more substantial and complex. One of the complexities of legal cases involving government’s regulation of religion involves the manner in which the courts apply law and prior case precedent to a specific case. In the RFRA the Congress established that in religious freedom cases the government would have to establish a compelling interest to justify any substantial burdens placed on the exercise of religion.

In the ayahuasca case (Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal) the Supreme Court ruled that the government’s interest in uniform application of the CSA did not prevent courts from recognizing the use of the drug for religious purposes and that its status as a controlled substance was not a sufficient reason to prohibit its religious use. In prior cases involving the religious use of marijuana, which preceded the passage of RFRA and RLUIPA, the government has argued that it had an overriding interest in controlling marijuana use and distribution and that marijuana posed a real threat to public health and social welfare.

Olsen wants to revisit these issues in light of these new laws and the 2006 Supreme Court ruling on ayahuasca. Specifically, Olsen argues that applying marijuana prohibition to the religious use of cannabis is a substantial burden on a sincere religious exercise, and that this violates both federal law and protection of freedom of religion guaranteed by the Constitution.

In the past the government has argued prohibition of religious use of controlled substances serves three compelling national interests: preventing harm to users, preventing diversion to secular (non-religious) users, and maintaining compliance with international treaties. Olsen argues, in part, that the government cannot provide evidence that marijuana causes sufficient harm to users or society to justify the substantial burden prohibition places on the religious use of cannabis.

More information about Olsen’s lawsuit is available in a recent article of his published in the Bulletin of Cannabis Reform and the briefs filed in the case can be read at the website for the Ethiopian Zion Coptic Church.

People use marijuana for many different reasons, including social, medical and religious motivations. One of the most important issues Olsen brings before the federal courts is not, as some would argue, that marijuana use should be recognized by the government as a legitimate religious practice. Instead this case involves a more fundamental issue: whether or not people who use marijuana religiously should receive the same legal protections as those who use other drugs as part of sincere, legitimate religious practices.

In 1984 the Iowa Supreme Court recognized that “Olsen is a member and priest of the Ethiopian Zion Coptic Church. Testimony at his trial revealed the bona fide nature of this religious organization and the use of marijuana within it.” The issue in the current litigation is not Olsen’s sincerity but instead the government’s refusal to provide Olsen equal treatment under the laws as they have been applied to the use of mescaline and ayahuasca.

Individuals should be able to decide for themselves whether or not they want to use marijuana. The primary argument for marijuana’s legalization is that the drug is not dangerous enough to justify keeping it illegal. Individuals should not have to justify their use on medical or religious grounds. Adults should be able to justify their use of marijuana on any grounds they see fit. It is an issue of personal liberty. Nonetheless, like prohibition of medical use the prohibition on the religious use of marijuana is a violation of deeply held American values that are protected by both the Constitution and federal law.

Carl Olsen is a true patriot for challenging the federal government regarding the religious use of cannabis, and he deserves gratitude, respect and support from the reform movement for this important lawsuit.

Amen. We are not fools here, and I'm not talking about the Federal Government. Marijuana has given me a perspective on things that no other prescription drug could ever do. Maybee because its natural or that it was intended by God for us to use. I truely have learned that any time I use it, its like a sort of meditation for me which in turn, calms me down, gives me a perspective on things, and a sense of myself. A religious practice in a sence. So the legalization of this herb for religious practices should not only be allowed, but it should be condoned. I really wonder how could a whole governmental anti-marijuana campaign could ever result from a 100% natural and harmless herb in the first place? We all agree on the same issue here and the majority of the people I hang with also agree. So let's do what we can and be pro-active about it and use our freedom of speach to be heard. Let's just hope that one day it will finally be leagalized and in the mean time...Keep it on the down low.

Ya I know all about your Religous censorship books you read. Religous censorship is the means by which any material objectionable to a certain faith is removed. This often involves a dominant religion forcing limitations on less dominant ones. Alternatively, one religion may shun the works of another when they believe the contest is not appropriate for their faith.

Hi again!! The original meaning of suppossed seperation of church and state was because of the catholic church which ruled the known world until 1798 and had a tendency to force people through the governments to bow down to the evil catholic church!! It had and has nothing to do with keeping religion out of government which is legal if the government person wishes to put their religious belief into practice in their role of government, however there is a U. S. Supreme Court decision that says that the government person can not use their religion to force their religious belief on other citizens while acting in a governmental capacity..,, This current twisting of the original meaning of church and state seperation is the work of evil people who want to remove religion from the nation to support their evil agenda which includes bowing down to the med folks who want pot illegal because it is a natural cure all that can not be prescribed or controlled by the med folks without government help, and that suppossed seperation of church and state that is currently being claimed has only been around for less than 30 years!! State vs. CHURCH

The STATE AND THE CHURCH have been seperated for years. The state has nothing to do with the church. Seperation of church and state is a political and legal doctrine which states that government and religious institutions are to be kept separate and independant of one another. The term most often refers to the combination of two principles: secularity of government and freedom of religious exercise.

"marriage" REFFERED TO AS THE "STATE SANCTIONED RELATIONSHIP", Sanctions are usually monetary fines, levied against a party to a legal action or his/her attorny, for violating rules", such as "divorce".

So we have a preety wedding at "the church" which is of course seperated from the state. However we sign a legal doctrine with the state under our church. hmmmmm Did we somehow drag the states into our churches? Since we base our mariages on the legal document signed at church instead of focusing on church, more than 50% of marriages fail because the State is involved with our churches. I cannot find in any religion where it says "prenuptial" agreement. So knowing full well that we are going to our church to get married or sign a legal document with the state sooo to have half he/she half half half.
To the state: leave our marijuana alone and our mariages, your laws have corrupted the people of this country.

Hi again Brother Carl!! While in a sense the pen is mighter than the sword I for one would like to have both when someone is breaking into my home.. As far as turning swords into plowshares that will only happen worldwide when JESUS returns as it say's in the Old Testament that wars are determined until the end so only those living in la la land who do not know better because they do not watch the news and do not realize that there is still a threat would turn their swords into plowshares before the second advent of JESUS, as JESUS said we are supposed to defend ourselves in the verse quote (not perfect quote) "before I told you to turn the other cheek but now I tell you that if you do not have a sword, sell your cloak and buy one" I also look forward to the day when swords will be turned into plowshares worldwide, however at the same time I realize that we must have arms to defend our nation from the muslims etc who want to turn the world into a slave to their evil idea of how things should be.. Marilyn Mansons real name isnt even Marilyn Manson. He's a skinny long haired public high school kid from florida and not some monster from out of this world who like a lot of other skinny long haired public high school kids he was sick of getting beaten up by the pulling gaurd all week only to go out on the weekend and watch the football players get all the girls so he formed a band and now he gets all the girls. They might be strange chicks, but they;re chicks.
A few weeks later a couple of latch-key kids went tragically mad and started killing their fellow students and everybody was standing around the tv store at the mall trying to figure out what went wrong. This one guy said " how do you think a couple of high school kids fron america could of went so wrong?"
This other guy said " shit, its probably just the words to one of them god damn Marilyn Manson songs"

I'm defending what I believe in. The Constitution gives me the right to believe in any religion I choose, as long as I'm not hurting anyone. Courts are not allowed to decide whether religious beliefs are valid, only whether they are sincerely held. You are way off track here. Yesterday I was watching a show on TV about the oil and gas drilling in the west and was totally appauled at the destrution that is happening to the landscape for the purpose of energy when there is Tesla's free electricity design that I have described on MSNBC.com at the place thereof that I previously said how to find herein this discusion, and I am of the 100% opinion that if we want to claim religious use of herb then we also would care about the enviroment as GOD said quote "I will destroy those that destroy the earth" So I think that we should go to the website mentioned on that TV show ie www.alandoutoftime.com and help in the fight to save the enviroment or are some of us all gas and no substance? Hi again!!!.,, I left a message on brother Carl's answering machine today saying that he most likely will not win his sincerety test before the federal Court because if he were sincere he would be smoking instead of having a THC deprivation fast for 17 years to file his lawsuit..,,, That is something anyone else who is thinking of filing a law suit against the Fed should consider, further added if pot is not harmful as we claim then why is brother Carl not smoking? I mean if it is not harmful then he should be able to function normally and file his law suit under the influence with the important exception being that herb does cause a small amount of lazyness which could cause one to not work as seriously on their law suit as otherwise.,, that being said I find that when I am high I do a better job of and write more of fax's as I am more inspired when I am high, further added it seems extremely much that when I am high I write more intelligently but sometimes more goofily of which the person's I send fax's to do not seem to mind.,, However I realize that everyone is different!!! Hi again!!! I talked again with brother Carl and although he has a valid point of wanting to stick to his original premiss that pot is a sacrement and that it is the blood of Christ of which it is admirable to want to stick to your guns so to speak, he does not seem to realize that my assertion of Isaiah ch 42 verses 1 - 3 and Matthew ch 12 verse 20 being added to his arguement is like haveing 2 poles to fish with instead of one as you are more likely to catch a fish with more poles.,, Carl obviously is intelligent and knows what he is doing, however I think this is a case of Einstein not being able to balance his check book.,, So lets all pray that if brother Carl is in the position that he can offer more evidence that he chooses to fish with at least 2 poles!!! In order for the laws of a nation to be valid, they must at the very least harmonize with, and not contradict, the law of God. We know the law of God by looking to its expressions. If the laws of nation conflict with one of the expressions of the law of God, then something is amiss. Or, perhaps we do not unerstand one of the other clearly.
THe optimum situation would be where the laws of a nation are consistent with each of the expressions of the law of God. But, perhaps the bes that can be generally hoped for is that civil laws be found to not contradict the most universal expression of the law of God in creation- THE LAW OF NATURE. The heavens and the earth declare that law. Thus we may deduce a rule to guide us: only when civil law does not contradict this fundamental and universal expression of the law of God can it be recognized as prima facia valid. That is to say, civil laws, so far as can be judged from first appearances, are valid if they do not violate God's law as reflected in the law of nature. And we can know if our interpretation of the law of nature is correct if it comports with the Bible.
Consistency with creation, therefore, is the minimum test to validate the laws of nations. Historicallly, this was recognized in the legal maxim, lex spectat nature ordinem, the law regards the order of nature. A law which fails this initial test is of no binding legal effect because it remains unsupported. Every civil law requires the supporting testimony of the law of God in at least one of its expressions in order to be of binding effect. Indeed, no nation should be bound to a malum in se rule or law simply because it is written in a statute book.

Hi again!!!.,,, Rev Carl, I realize that the Supreme Court might not read my paper because it is their clerks who decide what the Court see's.,,, that being said I should at least try..., and hopefully my governmental standing will sway the clerks.,, I think a plauseable action for folks to take is to join NORML in large nimbers so as to at least give the appearance that it is an overwhelming number of folks that want pot legalized and not just a few million as the Fed gov statistics claim of which the last number I heard of those statistics is that only less than 6 million folks smoke pot when I sykicly count over 80 million so obviouly the gov is lieing to make it look like there is not much like for pot which futher warrants their crack down on pot smokers...,,, and I saw a documentary on the electronic voteing machines that it is extremely easy to cause them to give false numbers which is why when over half of the folks in my state smoke pot that the recent vote to legalize it in this state failed overwhelmingly, futher added the said voting machine doc had a source code writer testify and he said that the codes were being intentionally written to give a favorable outcome to the highest bidder in this case the med proffession which wants pot illegal because it is a natural cureall.,,, so another thing that should be done is nationwide folks make petitions to bring back paper ballets and every voting district nationwide have the same type of ballet!!!.,,, So again I say GOD Bless and the Peace of JESUS to those that want it!!! Appeals are always based on the record at the time a final ruling was made. New evidence is not allowed unless the appeal court sends it back to the trial court. If the appeal court wants more evidence, it will remand the case back to the trial court to hold hearings.

Anyone can write to the individual justices of the U.S. Supreme Court at any time, although there's no guarantee they will read it.

Under the U.S. Supreme Court's ruling in Gonzales v. O Centro Espirita Beneficente Unaio do Vegetal, 546 U.S. 418 (2006), and claim under the Religious Freedom Restoration Act must be decided on a case-by-case analysis.

That means that if I lose my appeals, it would not prevent someone else from making a similar argument since every individual would have a different set of facts.

This is one of the most interesting cases that has come along in a long time. It puts major crack into the drug laws.

When you combine that with three U.S. Supreme Court justices comparing the drug war to National Prohibition (alcohol prohibition in the 1920s and 1930s), in the Bong Hits for Jesus cases (Frederick v. Morse), along with 12 states allowing cultivation of marijuana for medical use, you see a major fault line beginning to develop.

Hi again and much kind Blessings to you!!!.,,, I am currently working on a paper to send to the Supreme Court that although it is still in my head at this time because I like to make sure that everything fits on the page before I reduce it to writing.,,, I talked with brother Carl Olsen and he said we can not present new evidence to the appeals court which is a shame because I beleive that a sacrament does not have the same standard as a regular use criteria because a sacrament is an occasional use thing whereas JESUS used pot on a regular basis in Matthew chapter 12 verse 20.,,, however that being said I hope the U.S. Supreme Court allows new evidence if the appeal that brother Carl is currently going through fails, and if the S. Court does not allow new evidence then hopefully my paper that I am working on will have sufficient influence on the court to cause a favorable decision!!! I find it very disturbing that SOME people on this forum are claiming that Democrats are "evil one" and pathlogical liars. Quite frankly, I simply do not understand your rational. A "republican" governamnet simply states that the United states of America is not a true democracy as it is a in fact, a republic. To start claiming that certain sects of people are "evil" is very dangerous. In fact, Who are you to deem what is evil and what is not. Also, as a point of fact, I am a reverend and know through study and experiencing the human condition that religion in itself as we know it today in its organized form is fatally flawed. For any human to claim to "know" the word of a "god" or claims to know what "God" wants or feels is itself , complete blasphamy. I know enough to know that there is a "god" or "gods" (please note that monotheism is a relatively new concept in human existence) and or a holy or divine "spirit" that guides us and is a part of all things. I also know enough NOT to make outrageous claims on the part of "God". Very simply, to try and define the undefinable as it relates to a "god" is blastphamy. To claim that you know god because you read a book or went to class is outragous. God is here, is with us, and amung us at all times. All I DO know is that God wants us to help each other and look after each other. For all we truly have in this world is each other. Cannabis was made by God for you and me and all people of the world for a great many things.
