Busted Letter #115 – Drug Test DUI?

I was busted July 9 in a small town in southern Georgia while in my car with a friend. They ended up finding around 5 grams and a pipe, which is a misdemeanor but then they tried to charge me with a marijuana DUI.

I was busted at 10:30 a.m. on a Monday morning. I had not smoked since a few days before so I was not high whatsoever. I told them right off that they did not have a search warrant and they said they had probable cause because my friend smelled like weed. I had just watched him put on a clean shirt, he hadn't smoked at all that day either.

We were put up against the wall and searched, they found the pot and I was arrested right then and bailed out by my friend at 2:30. Then after I was released they led me and my friend back to the drug squad for some kind of accusation/questioning thing. It was total BS! Can I be charged with a DUI off of a urine test? I thought that weed stayed in your system for a couple of months...

I have court Sept. 5 and am facing misdemeanor marijuana possession and DUI which could suspend my license for six months up to a year. I have never been arrested before, the worst I have ever had is a speeding ticket. I also do not even live where I got arrested. It was my hometown but I was just passing through. I live 2,300 miles away in Missoula, MT. Now what should I do?

I am sending you this email / letter regarding a deeper explanation of the charges I am facing in regards to the Mineral County Justice Court in Montana. I was traveling from Spokane Wa to Illinois to see my parents for the summer, when my front tire had a blow out. Just at that moment a police officer saw what had happened and pulled in behind me. He then proceeded to ask me questions as he spoke to me he started looking into my car and noticed in my over night bag my marijuana prescriptions I had one open bag, he then asked me if he could search my car. I did not have a problems with him searching my car because I knew I was with in the law, being a medical marijuana patient. As he pulled my prescriptions out I did explaining to him that I was a medical marijuana patient and offered him my medical paper work. He did not want to look at it. He proceeded to hand cuff me, had my car towed to impound and it was all down hill from there As I mentioned earlier I could obtain necessary representation from my medical clinic and even a letter of explanation for my debilitating medical conditions from the doctor that signed my medical marijuana prescription. I have a long history of ADHD high levels of Anxiety, Migraine headaches and severe muscle spasms / uncontrollable body movements. These are debilitating conditions that I had to suffer through for 2 days while I was held, without any option for bail with no option for my medical marijuana. When I was arrested my body went into full body tremors (uncontrollable body movements) I once again tried to explained to the officer that I was a medical patient with tremors but it did me no good. I do take Adderall and other prescribed medications from my Psychologist. this medication helps me stay on track as I do a lot of different types of work as a IT Specialist, these medications were offered to me on a nightly basis, but my medical marijuana was not an option. I currently take less than my prescribed amount of adderall and had a two month supply in a one month bottle and this was not brought up as any issue at all. Although my medical card for my marijuana had expired I was still a legitimate medical patient according to my medical paper work. I have obtained my renewal card to current date for my medical marijuana, which has now been renewed due to the conditions listed above. My medication was correctly packaged in medical packets included any (Hashish), which came from my medical clinic as approved. These are THC concentrates(hash) as listed on the label from my medical clinic. (This is where there trying to get me on a felony charge) I have done every thing with in the law to keep my self legal by obtaining all my medication by the legal standers of the law, it's not right that I should be charged with Illegal possession of drugs/ uses of drugs paraphernalia, when I have obtained my medication legally. All my medication was in there original packages with my prescription on them. According to the Montana Marijuana laws I can have 60 grams or under on me at any given time. I was charged with 52 grams. I have to return to Mineral County Montana on July 28th at 10:00 am to go before the judge on one felony charge (hashish) and two misdemeanor charges.

In GA they will take your driver's license and make you go to DUI school and wait six months to get it back even if you were no where near your car. Believe me because it happened to me seven years ago. How fucked up is that?

Busted for a pot DUI in 07,thats a severity never busted
for that either though check in some walk in clinics some
charge a fee but; its better than the other fee an get on
that thru your laywer. If you dont smoke but a couple times
in the year,then let your stream go,later!

never been pulled over for bein baked. but about a week ago i had a cop shine his brights in my face and i was all oh shit thats bright. and i was stopped to turn at a stop sign. the cop drove behind me and as soon as i turned the bastard turned around and followed me for about 3 miles getting really close to me then falling way behind then speeding up to me again. he probably thought i was drunk. i think he was the hammered one here.

it was about that time i pulled out my gun and starting firing off rounds.

but it was a pretty scary experience

Hey EVERYONE! Just busted myself recently and it totally blows! I looked online and found L.E.A.P.(Law Enforcement Against Prohibition). There is a HUGE movement going on to legalize and regulate ALL drugs. They are not condoning drug use. But, they do believe it is your personal right to do drugs if you want. They are also declaring that the "war on drugs" is a huge failure and that it needs to end. They have a petition you can put your name onto that will be sent to President Obama and there is also a pre-drafted letter that you can have emailed to your local state representative. Both are strongly urging for legalization.

This is NO JOKE and is completely on the up and up. Check out their web site and GET INVOLVED!!! You can find all the video proof you need on the web site to prove it is true. Some videos of actual news media and discussions in the senate on a bill to legalize ALL drugs. They are fighting in Congress and the UN and traveling all over the U.S. to help educate people on the failed drug policies. THIS IS GOING TO HAPPEN AND WIIL ALL HAPPEN A LOT FASTER IF EVERYONE GETS INVOLVED. Put your bongs down for one minute and do some networking and tell EVERYONE to voice their opinions.

I urge everyone to go online and look up "Law Enforcement Against Prohibition" and at least check it's validity. I know that after getting busted myself, I was feeling really guilty about the whole ordeal. But after reading through this site for a while I was feeling very disturbed and not because I was wrong but, because WE ALL SHOULD HAVE THE BASIC HUMAN RIGHT TO DECIDE WHAT GOES INTO OUR BODIES!!!

Well I live in GA and moved here 6 years ago from Va.Beach. One night I was so lost.....had things still in the back of my car, did not have the time to take them all out. I had not had anything to eat all day. I was trying to find a place open it was late so I got lost and was slowing down to see where I was....I got pulled over by a police man, OH forgot this part this man said he could help me move this large oak dress into my place and he had a couple of very thin guys helping him. I ask do you think they can lift that dresser it is very heavy. He said yes no problem. Well I was moving into a 3 story apartment so they were going up I was down at the bottom talking to the man and they droped the heavy dresser on me. So I put ice on it and went on with the move....As I was saying I went to get something to eat and the GA policeman pulled me over and because I could not stand on the leg that the dresser fell on he said I fell the test. He took me to the police station and tried to get me to blow into this thing and it was not work. So he can't banging it and making me blow several times. I had to stay in jail with my leg so black and blue from the dress falling on me and had no food....he told me shut up and go to sleep. Well I could not get out because Monday was a holiday and I could not get in touch with anyone. So I was in jail from late Friday Night untl Monday afternoon. I hired lawyer people said was the best in Atlanta. Paid alot of money but it is still on my record but not as DUI but as reckless driving. So I thought that was over...NO I go to church on a Sunday and stoped at a gas station 3 years later from the last jail time was not in my car was in the store came out with a Dr. Pepper opened my car and got in the car a police came over and showed me his badge and put me down on the ground and said I was under arrest. I keep asking him for what? He said DUI.....I was not under and thing but a Dr. Pepper so this this I said just take me to the hospital and give me a blood test. I knew I was not under anything. Well the test came back nothing in my system. The case did not even go to court. But these things are still on my background check.. I was laid off not due to these things but I have been trying to bet a job and I was told by this person the reason I did not get the job was because of the DUI's I do not even have a DUI and they are on my record. I have tried to contact the lawyer several times to find out why they are and how do I get them off. Does anyone know the GA law that can help me get these things off my record that are not even suppose to be on the record? I am suppose to go to another interview on Tuesday and she just emailed me today and ask me to bring a background check. So I know with these things on there again I will not be able to get this job. This just does not seem right. I am not being able to get a job over something I did not do. Any advise?

I would go to court and pay the fine but in the process do some mary j research you know find out what you need to know but like they say every law is different but it is a FACT that mary j lives in your fat cells and the fatter you are the longer it will stay clinging to your meat so lose some weight to dispose of it quicker or stay sober for a while..but normally 30 days and it's gone. just to let you know you have thc levels when you get a drug test and when your monitored on using it if your levels get higher then your still smoking if they start to subside then they know you have stopped.

yea man i sort of had the same thing happen with me...i had smoked a 2 gram nug blunt to the face bro..i was fuckin retarted as u can get.anyways i got done smoking the blunt and went to taco bell..so im driving home and about an hour and a half passed after smoking when a state trooper came out from a hotel out of nowhere and pulled me over (said my tint was suspicious?)..as soon as the cop came to the window he seen my eyes were bright red, so right off the bat he asked if i was smoking, so i said yea man im a reg. smoker.well then the guy gets me out of the car and starts trying to say i was drinking.and im like no dude i just get high.after arguing with the cop and then doing the field sobriety tests high as a kite..he asks to search the car.i didnt have any weed left in my truck, so i agreed.only to soon remember i had my old scale and bagies in this bag that i was giving to my boy.obv the cop found it as well as 3 seeds on the floor and locked me up.At the station he tried demanding i take the blood test for drugs after i blew a 0.0 on the breath alyzer.luckily the man who does the tests at the state trooper barricks wasnt in town..so i was released and charged with possesion of marijuana, paraphanalia, and dui...but after paying for a good lawyer..my shit was thrown out..plus the fuckin cop didnt show up..holla.

This is a question for those of you who live in georgia is there a law that states that if it is suspected that you are under the influence of pot that you have to give a DNA sample AS WELL as a drug test? Some one told me that they are trying to get him to give a DNA as well as drug test only because he was pulled over and a pipe was discovered in his possession..Some thing does not ring true about this...IMHO I think there is more to his story then he is telling..

ok, this is fucked up!! I was babysitting for a friend, and his kids went to their mother's house. They btold her that I was not only pregnant, but that I smoked weed, did coke, and pills. The truth is.... I haven't touched coke in 13 years, and besides that I'm totally against chemicals.I confess, I do smoke weed. My doctor knows, but is ok with it.
Anyway I got a visit from C.P.S. (child protective services) They say I have to go take a drug test, the last time they tested me, it came back clean. Does anyone know if I have to take this test? I don't want them to take my new baby, because of some little asshole kids making shit up, or because I smoked weed. Please help!

Shit the cops here take your bud and say move out for small amounts hell i had one take an oz off me he smelled that shit said im gonna do you a favor and destoy this while he put it in a fanny pack. I was like peace bro and rolled out. its a common occurence here in WA. Lots of my friends have been pulled for speeding he smells it and takes it and lets you go. He even took my piece the nite he got me. Shortly there after is when i went ant took advantage of the legal lisc here in the state now i tell em to fuck off basically but in tone only so as not to get beat down.

Don't ever let the cops use the "I smell burnt marijuana, and that gives me probable cause" line.

You can not hold up a smell in court, and point to it as probable cause to search.

Now, if a canine unit "hits" on your car, the officer can point at the dog in court as a reason to search.

Know your rights bro. There are a lot of links on this site that will help you in this, but don't stop here.

American cops are some of the biggest criminals in the world. Most don't understand the people of this country are supposed to have the rights, not the government.

Next time they give you that "I smell weed" line, say this verbatim:

"I retain my fourth amendment rights under the constitution of the United States of America, and DO NOT consent to a search of my person, vehicle, or belongings, and I have been advised by legal counsel not to answer any questions without my attorney present. So, now I must ask you officer, am I being cited, placed under arrest, or being detained so you can obtain a search warrant?"

If you are not being arrested, or cited, you are typically free to go. There are laws preventing the police from detaining you unreasonably, so as to secure a search warrant.

Check you local laws, and have them handy for reference.

Oh, and when a cop gives you a breathalyzer, and throws the little plastic thing on the ground, inform him that is littering, cite the statute, and ask him to pick it up.

I did, and it was funny.

Yeah i just got the samething happened to me in north GA, drving down the road i saw what i thought was wreck so i turned around in a drive way, turns out it was a roadblock, so the assholes chased after me and pulled me over even tho i had not broken any traffic laws, i had nothing on me but they said i smelled like i had just smoked (which i did 30mins b4) i passed all field dui test but they arrested me and either i had to take a bloodtest or loose my lisence for a year automaticaly, thats some bullshit

WTF; i hope you did not go in for qstioning, and did not submit to a urine test until a lawyer was present. the search will be considered legal cause they will lie, and be trusted by the judge. it has to be conclusively proven that you were under the influence at the time of operation of the vehicle. this can not be done with a urine test: no specific breakdown on the metabolization time for weed in the blood stream, nor your particular tolerance level of the drug can be determined. are thewre any statutes stating that .00125 weed content in the blood is illegal? if no ABSOLUTE limit is given you are acquitted. fight all charges FIGHT EVRYTHING AND SUBMIT TO NOTHING

First off while everyone on here has there own opinion and seems to be at least a lil knowledgable, you need to realize that every state has different laws and unless its a supreme court ruling its the jugde that recognizes the precident on the case. In my state you can be arrested for dui even if your drunk and riding a horse i know so here goes my thoughts while every state has different laws the officer has the right at the time of the stop to search the vehicle if you refuse the search your license can be taken immediately so the best idea is honestly to leave it at home if you dont want to do that only carry what your gonna smoke or can eat in case of an emergency roll joints or blunts never carry your hardware and make sure there rolled before you go your lucky your not in my state in wv if your pulled over and charged with a dui even if the court drops the charges the dmv can take your license so your tried twice so everyone get pulled over in the big wv

If they have "proof" u were caught smokin while u were behind the wheel of a moving vechile,and if no video,they should atleast have it on the police notes they took the day of the arrest.So since that dosnt exist,that charge can be beat with or without a lawyer,i would think .... This happened to my friend a couple months back. The drug test may be a good thing for you because if you were high at the time of your arrest the levels in your system will meet or exceed what the police consider under the influence. BUT, if you were not high, the levels will be far below what they consider under the influence and any good lawyer will be able to have it thrown out. Now the bad side is the possession charge, but with the DUI gone suck it up. Hope this helps.

Hello C.R., long time no see. Glad that you are still around. No, there was no dirt to be had, so I'm in the clear. I live smart. No trouble for me. It wasn't really a bad break other than she is mad that I didn't "give florida a chance". I went down for a few days, but if I moved down there and didn't like it I'd be out of an unbelievable job up here. Anyways it was the smartest decision I've made in a long time so I feel great about it. I guess I should read this article and comment instead of talking about me! late

I hope you were smart enough to refuse to take the urine test. If you take the test and fail by testing positive in any amount for weed or any other illegal drug, or even prescription painkillers, etc. You have just sealed a conviction of dui on your record. In most cases its almost always better to refuse the test for dui and dont say shit.

Thanks O.G.Now I can start to google to find out where to buy from. I seen this show on PBS ( Public Broadcast System ) that had some hemp like flour on there and says it was far healthier for us than white flour and corn mill.

I do know that ALL DISEASE are made made and created mostly by the food we consume.

If no one has notice lately it seems our food system has been under attack.

First it was the peanut butter,then greenbeans, catfish,the canned chilies.

We should all it as close to NATURAL as we can.

I know the HEMP does not contain pesticides or growth hormones and is far the pureist.

Repressive laws concering MJ evolve so fast, I may be out-of-date on this, but it's my understanding that you cannot be extradited to another state to face misdemeanor charges. If not, don't sweat it, but if I were you, I wouldn't set foot in Georgia again

the way i get all the resin off my bowls/bongs/ect is i take a plastic baggy make sure its at least double bagged incase it leakes then add salt directly to the resin then pour rubbing alcohol or any alcohol for that matter and shake make sure you wash it out with water after words

if you veg a plant long enough,it will tell you what sex it is,you want a pure strain from your seed pack,as mentioned before they are like a litter of cats,you must weed out the hermy,scrawney,the inferior!a couple of those female seeds in a pack of 10 shoud be 60% female,out of those a couple will be what the seed co. intended.

Dickhead has rightfully pointed out one factor that I neglected to mention and he is right. Bringing the clones (hopefully female) to full maturity will display their "true" genetics and his method will give you a better idea of the potential results you will be dealing with. With that being said, I still atnd by my method of inducing flowering and then switching back to veg lighting. But as I previously said..I have successfully utilized both methods. Sticky..try them both and see what you think. Dickhead..thanks for pointing ou that your final observation, you are absolutley correct.

Correct!..or you can do it the way Dickhead outlined..both methods have worked for me. Your motherplant will last indefnitely as long as you keep in under veg photoperiod and do not run out of head room. How many cutings you can take at one time depends on the size of the mother plant. Small mother plants = 2 or 3 clones at one time. Large motherplants = 3-5 cuttings/clones at one time. Then you can go back 10-14 days later to take some more cuttings. if you take to many cuttings at once..you will shock the plant.

I have gone from a flowering photoperiod back to a veg photoperiod as I previously discussed to "sex" plants with no negative ramifications, However..Dickhead is right in his hypothesis regarding taking cuttings, inducing "sex" on the clones by using a flowering photoperiod, then keeping the "mother" of the female clone as your source of female clones. This method works as well and I have utilized it. Sticky..Its always best to use a mother plant for your clones. If you clone from a clone...you will begin to see genetic "drift" over time which will gradually affect the quality of your clones/plants.

from my experience you want to take clones from veging plants,they wont go back into veg,they will stay like they are;try numbering plants,clone one from every plant,then flower clones to find which is a desirable mother plant that can be maintianed idefinatly under a 150 metal halide,as long as you dont cut to many clones,it will live,......

You can induce flowering by switching to a 12/12 photoperiod. That will show you your females and males. Pull the males, switch back to vegatative lighting 18/6 and your female plant(s) will revert to the vegatative stage with no negative ramifications. THEN...you can take your cuttings for clones!

There are tests that can tell if you consumed alcohol in the week or weeks before, those do not prove you are under the influence when the test was taken. Those are not the same kind of tests used to check if you are actually drunk when the test is taken. There does not exist a test to do similar things for cannabis.
However I imagine you need an expensive lawyer to explain that.

dude, i got a pot DUI when i wasnt high at all. if there is any trace of a drug in your system you are officially under the influence. i hired a great lawyer and he couldnt do shit. how do you prove you werent high? you cant! these people dont know what theyre talking about unless youve gone through it. i didnt think that it would ever happen to me but it did. i lost my license for 6 mo and it cost over $3000 THEY DIDNT EVEN FIND POT IN MY CAR JUST A PIPE!!!

I am from Georgia and have had a DUI on alcohol related offense.( No drugs were found or tested for)

Unless the cops are pissed at you about something,in most cases a first offense can be pleaded down to reckless driving or at least that happens with most of the DUI's in Georgia.

Being as though yours was POT I do not know what will come of this.

I do know a guy who just got busted for the same thing in Georgia on the 4th of July weekend.
He had a wreck and the state patrols come to the scene,he was NOT drinking,so they ask him to take a drug test,because of his slurring words and not being able to walk a streight line.( he was on some PAIN KILLERS not WEED)
He refused the test and was charged with DUI for unknown drugs,but no drugs were found.
His lawyer told him he should have taken the test,because he is under 21 years of age and said the judge was going to be harder on him for not takeing the test.

I have been told by lawyers the exsact opposite,but I am over 21 and mine was alcohol related.

Good luck!
One lawyer even told me I could be a NO SHOW in court and move to another state and that they WOULD NOT come after me,but that I would never be able to return to Georgia.

BUT if you are living in MONTANA????

Your letter is a little vague on some points . What was the reason for pulling you over ? The judge will ask why you had weed/bowl in your possession if you weren't smoking it .

Bottom line , the SMELL is probable cause in MOST states. The only thing missing in this letter is WHY were you pulled over ? The absence of this detail tends to make one think there is a reason for its exclusion .

your first fight is illegal search under the premise that smell does not constitute probable cause, if smell is all they had then they would still need to get a warrant (there is legal precedent for this)

second, you should not be able to be charged with a DUI over a drug test UNLESS THE DRUG TEST WAS ADMINISTERED AT THE EXACT TIME OF THE TRAFFIC STOP, you could have been clean that day and smoked afterwards. a drug test days after the fact gives them nothing.

third, if you can't get the search declared illegal, you screwed on the 5gs and pipe.

MOST IMPORTANTLY, GET A GOOD LAWYER, PREFERABLY ONE THAT IS RECOMMENDED BY NORML.

Traces of Marijuans in your urine is not an indication of recent usage nor an intoxication meter . Better get a lawyer anyway . The cops will say :
1) they smelled it.
2) you had it, with bowl
3) piss says you smoked it.
I'm assuming they pulled you over for something ?
So , put yourself in the judges shoes ...would you let someone go under these circumstances ?
