My seventeen-year-old son was leaving a friends house (in NJ). He was driving his sister’s car. Less than one mile from his friend’s house he was pulled over for not having his headlights on. When asked for his license, registration and insurance he told the officer that it was his sister’s car and he'd have to call her to find out where the registration and insurance card were and that his license was in his car.

Of course the officer then asked my son to step out of the car and asked if he had anything on him or in the car that the officer needed to know about. My son’s response was "no sir.” The cop then asked if he could search the vehicle. My son said no because he was in a hurry and needed to be home by 10PM (the stop occurred around 9pm). There were five cops on the scene and they called for a K9 unit from a different township in a neighboring county.

The K9 arrived about an hour and a half after the traffic stop. The dog proceeded to severely scratch all four doors of my daughter’s car and then the car’s interior. The dog detected something in the center console. They found a very small roach inside the compartment and charged my son with driving without headlights, failure to produce documents, and possession of a controlled dangerous substance in a motor vehicle.

After picking up the car at the impound lot (which cost $163) I notice the damage to the car and went right to the police station to see what they were going to do to repair the car. The cop filed a report concerning the damages and said he'd see what he could do.

When I asked the cop why a K9 unit was called to the scene, their response was that the officers on the scene detected the smell of marijuana. I asked why they sought permission to search the car if in fact they had probable cause. The office then became angry with me and asked, "shouldn't you be more concerned that your son is smoking marijuana?" I explained that that conversation will be between me and my son and that my conversation with the police was intended to 1) make sure that my son's civil rights were not violated by being subject to unnecessary detention and an illegal search and 2) to inquire about the damages to my daughter's car.

Needless to say, we have retained an attorney (at a cost of $1500 dollars) and will vehemently fight the charges, however, it is comical to think that five cops and a K9 unit were wasting their time and tax payers’ money to make this giant bust of a seventeen year old for a old roach that he wasn't even aware of in his sister’s car.

Hey EVERYONE! Just busted myself recently and it totally blows! I looked online and found L.E.A.P.(Law Enforcement Against Prohibition). There is a HUGE movement going on to legalize and regulate ALL drugs. They are not condoning drug use. But, they do believe it is your personal right to do drugs if you want. They are also declaring that the "war on drugs" is a huge failure and that it needs to end. They have a petition you can put your name onto that will be sent to President Obama and there is also a pre-drafted letter that you can have emailed to your local state representative. Both are strongly urging for legalization.

This is NO JOKE and is completely on the up and up. Check out their web site and GET INVOLVED!!! You can find all the video proof you need on the web site to prove it is true. Some videos of actual news media and discussions in the senate on a bill to legalize ALL drugs. They are fighting in Congress and the UN and traveling all over the U.S. to help educate people on the failed drug policies. THIS IS GOING TO HAPPEN AND WIIL ALL HAPPEN A LOT FASTER IF EVERYONE GETS INVOLVED. Put your bongs down for one minute and do some networking and tell EVERYONE to voice their opinions.

I urge everyone to go online and look up "Law Enforcement Against Prohibition" and at least check it's validity. I know that after getting busted myself, I was feeling really guilty about the whole ordeal. But after reading through this site for a while I was feeling very disturbed and not because I was wrong but, because WE ALL SHOULD HAVE THE BASIC HUMAN RIGHT TO DECIDE WHAT GOES INTO OUR BODIES!!!

Great news pops...cuz i hate to see a waste of time and money on situations like this...good luck on getting the money back cuz we all know how that goes..all they want is there money and quotas... they should be protecting the city from real crime rather then petty things such as these which i agree can be handled at home...cuz it starts with the parents anyways..

This is an update to letter #117 (cost of a roach $2.25 cost of getting caught with roach $1663 and counting). The evidence collected during the search was ruled inadmissible and the prosecutor was forced to drop the charges. The judge stated that my son son was detained for an unreasonable amount of time without being charged. The prosecutor said that it was only 20 minutes before the K-9 unit arrived when the distance from the one township to the other was more than 30 miles. Now we are in the process of getting the local police department to pay for the damages done to my daughter's car by the K-9. Thank you

Sounds like a sound strategy to effect the total eradication of drug use in this country. I mean, all we need is 7 cops, 5 cars, with 1 K-9 unit for every roach-toting teenager in America. Just like the rest of ya's, I have an opinion & here it is: if you don't want to be arrested, don't break laws! Both me & my other half used to bone up HARD! We then bought a house. We saw good people have bad things happen to them for smokin/growing pot & made a decision to stop until it was no longer a felony, especially one which can take yer house, yer wife, yer kids & yer dog too! I just wanna point out to all of you "it doesn't cause health problems/kill people" fact staters: smoking pot, or tabacco can help form blood clots, which can kill you, which is a nicer way of being because it can also cause strokes which can leave you about as useful as a cucumber that craps a lot. Don't believe me? Ask a doctor, a hemotologist knows lots about blood, & can give you insight to this. I did my thesis on the wonders of marijuana & was all sorts of uppity about it being harmless & then learned through personal experience, as well as finding out others that have "sticky blood" that partook of "sticky bud" developed clots. So just keep that in mind & if you come from a line of "strokers" pop a St. Joseph's aspirin along with puffing the nugs. NJ is not a "pot friendly" state, but there are plenty others that are worse off, so educate yerselves & either lay off the puffin' or start stuffing boxes with your goods to make for a move to a friendlier, kinder state.
I also wanna bring to your attention that not all cops are of the hard knock sort. Most are the equivelent of Wienies with hats & badges, but some would rather go after criminals than "smokers" but some "smokers" make it all too easy to be found & some are of the terribly stupid sort & are blatant. Don't be stupid, smoke in/on private property & don't partake while driving. 'Nuff said.

The police can not search a vehicle unless they have the consent of the REGISTERED OWNER OF THE VEHICLE; persons in possession of the car can not give admissable consent because they have no discretion over the possession charge. This is Canadian law, so NJ may be different. consider civil action if your son is found not guilty. If the pigs kept your son waiting for an hour and a half, it is all over. The cops CANNOT legally detain you tyo wait for a dog any longer than it would take to write a normal ticket!!Your son should have been asking every 5 minutes: " Am I free to leave ?"..and iof he was told NO then he was being detained against his will. There is NO WAY that the cops can justify keeping a motorist under detention for an hour and a half just to wait for a dog; that equals false arrest even before the dog arrived. When you feel that you are not free to leave voluntarily, you are under arrest. An attorney should be able to get this dropped fast.

They are losers; glorified Mall cops with nothing better to do. 99% of their time and cases involve issuing speeding tickets to people going 5 miles over the speed limit to make money for their town's treasury. All they basically are is IRS treasury agents with guns who do some light, occasional police work. Small town cops are the worst. Nothing to do, and they are very conservative and rascist to begin with.

For what reason? The cops wanted to show off their authority and declared probable cause and claimed they smelled marijuana. In an old roach. In the console of the car, under things. The balance for money comes when industrial hemp is used for all it can be(to list all of it right now I dont hvae the patience) and the people who want to grow and smoke it can, or if they want to, buy it from a store. The medicinal properties also weaken the idea of a social breakdown. It just doesnt make sense.

If you are able to grow it in your front yard, then you would not be compelled to pay high prices at a store. People wouldnt make any more mnoney than they already are, and it wouldnt be a fuckin global conspiracy like it is now.

To assume every human in the country will be baked all day just because it is legal is ridiculous. Not everyone is drunk all day. You are assuming there is a bigger slippery slope than there is.

Cannabis is a beautiful plant with many uses - There will always be a market in some way or another,I say legalize we will all be better off.It's just a matter of when at this point,12 states tell me so,we just need the federal government to do the right thing and step a side.I brew my own beer,I have plenty of friends that say cool I'm going do that but never do,just like with the herb, some people lack the talent at growing simple house plants or do not have time/space,or the energy,just like we can all be growing our own vegetables in the summer,but still not every one does - buying local grown foods and goods is the single most Important thing allot of communities could be doing,but yet most the vegetables and food in your local grocery store comes from other regions,the Cannabis niche will need to be filled when it becomes fully legal, a lot of people are going to come out of the closet and feel safe & free to partake.I believe legalizing cannabis will open up a whole new vibe that will be kick ass.Just think being able to go downtown and smoke or vape freely passing the herb around during socializing with friends and not have to worry about being fined or arrested - That would kick ass.I spent 1 year in Amsterdam and surrounding areas back between 91-92,and yup it was kick ass..Anyways thats my 2Cents - back to the vape.Peace to all fighting the good fight - and my hat goes off to all the medical growers and medical club owners out west, you all are on the fore front and fighting very bravely - Peace~Mon......

There are plenty of us that would be more than happy for marijuana to be legal. Yeah, the price would go down and that would be a bummer for some dealers, on the other hand a lot of us wouldn't care anyway because we grow our own. Cigarettes are legal and if anything they've only gotten more expensive as time goes on, along with alcohol...which doesn't lose it's value just because it's legal.

Jersey cops are fuckheads. I know this. That doesnt make you any LESS of a dumbass for getting caught with miniscule amounts of pot. I defend no cops, but I unlike the people who ripped a bowl before posting instead of me who will after, understand that they have a job and process to go through. They didnt just pull over some kid, plant drugs on him, and attack him with a dog. It was a stupid 17 year old coming back from a friends house with no lights on and got caught with more than he expected. Act like a moron when getting pulled over and expect them to fuck you over. I live in AZ and our Sheriff is a douche. You DO NOT FUCK AROUND when they pull you over.

The validity of the pot law is battled out in court, not at a traffic stop you stupid fucks(njams13 and whichever dickless moron ????? is). I cant wait to see you try to decriminalize with ideas like you have.

For those of you like MASSHAZE,why dont you put a badge on your chest! your distgusting to type in defense of the cops. regardless of whether he should've had on his lights(in all actuallity it probably wasnt fully dark but sunset)or if he should've have known of the roach,it's the duty of mine to prove and make aware to those of you missing it that the punishment for the roach is heavier then driving with no lights,even though driving with no lights is considerably more dangerous.Also not to forget about the expense the police depertment which is supposed to protect caused for the family alone just buy scratching the car. Jersey is the worst police state I have ever lived in. That's one reason I moved. This is a really common story actually. Jersey cops are ready to break out K-9's at the drop of a hat.It's fun for them. High and tight moustache lifers,Pigs. As for the scratching at the doors the cop was probably triggering the dog to go off so he could get probable cause. It's not hard to trigger a false positive on a dog. I've had it done tons with nothing in the car. They do it all the time. Everyday. People on the West Coast can't fathom the hassles Marijuana causes on the East Coast. It sucks here.

Thats bullshit.Im constantly harassed by the po po,they can do what they want,they have a badge,and to the guy that said "there was 5 cops called for a reason," as if the kid was throwing a temper tantrum...he must live in the suburbs,round here 3 to 4 UNITS are on the spot immediately for nothing, a tail light out/,seat belt ticket etc,
Police have to much pull and rights over "reg." people.

I find it hilarious that people say "its not their fault cause the law is stupid and should be changed and smoking isnt even bad".

NEWS FLASH: It doesnt matter if they illegalize the color yellow on baseball caps, it still makes it ILLEGAL. Sure it would be stupid and useless, but thats not the point. If a law is broken, then dont be surprised when they arrest you.

On another thought, why couldnt he produce documents? Why were there 5 cops there at a headlight stop? What caused them to call the k-9?

There are questions in that story that are severely unanswered. How shakey was this kid acting? They dont call 5 cops and a k-9 for no reason, no matter how corrupt NJ is.

Police in NJ are very corrupt. This same thing happened to me, I was arrested for 0.1 grams of marijiana in a local central jersey township. 0.1 is a fucking joke. They will do anything to bust you.

And there you were,waiting, to get busted, why not have fun with them? Yeah I live in North Central Jersey, too. The other day I drove down a dead-end road that I pass on my way to work all the time. There was a cop sitting at the end of it and when I went around the col-de-sac he pulled me over and wouldn't accept the reason that I gave him for being there (just wanted to see what was back there, no joke.) He made me get out and looked into my car with his flashlight from the outside. I kept Stephen Marley going the whole time from the speakers while I waited... guy was such a douche about it.

The cops in NJ SUCK especially in Northern Central NJ. They are corrupt and will do anuything that it takes to get a bust. so are the local papers and court systems around here they dont serve to protect anyone, simply to fine people. I have seen the same thing time and time again up to 6 cops called out for a simple marijuana bust, and all the local districts preety much will call the K-9's at any chance they get. I know someone who was charged with dui recently, even thow they passed a blood test, and a breathaliser, because at the officers discretion they were under the influence. and this is a 40 year old man, being charged. If you plan to smoke in NJ remember... THIS IS A WAR you have to go into fucking hiding just to smoke a joint, the rural towns here have as many cops patrolling as if it were a suburb of NYC. There all overfunded and corrupt so watch your back, and make sure your son avoids getting busted again, because the courts will royaly fuck him over and take his liscence away etc etc etc, if he is busted again while on probation.

Virginia Gentleman said it best . The prosecution has the burden of proof .They have to prove to a judge that everything is what they say it is .
The kids story (not plausible once the cop says he smelled it) is not convincing to me , and I don't think the judge will believe it either .
Bottom line , if there was no "roach" the whole incident would have been averted .
Soooooooo , pay attention and DON'T GIVE your ass to the cops !

Unfortunately...this does not appear to be an illegal search. The fact that the dog "alerted" to the vehicle gives the cops probable cause to search the vehicle. However..I am perplexed as to why they even did request a K-9 untit when the officer stated he smelled marijuana intially? That was the probable cause they needed right there. They did not even need a K-9 unit. 1 more thing in closing.... COPS LIE! THEY LIE EVERYDAY! THEY COMMIT PERJURY AND LIE UNDER OATH! THEY LIE AT TRAFFIC STOPS AND SAY THEY SMELLED MARIJUANA EVEN WHEN THEY DID NOT, JUST SO THEY CAN GET INTO THE INTERIOR OF YOUR CAR. BEWARE! NEVER CONSENT TO A SEARCH! this story reminds me of when 7 cop cars (no joke, 3 UC SUVs, 2 UC cars, 2 reg cars) pulled us over when they saw us blazing in an unregisterd car with an unlicensed driver. we ate the evidence n didnt end up in ne trouble but did lose the car. u just gotta talk to these pigs the right way

Correct. Usually if a officer does that when the subject does not give consent to the officer. They have a way around it such as- bringing a k-9 to the scene, and then will walk the dog around the car and if the dog gives any signs of detection than that is probable cause to search the car.Arent we all happy that this is where our tax dollars are going.

the moral: chances are if he had said 'yes' to the search they 1)would never have found the roach in the first place; or 2)let it go with a citation [or a warning] if they did find it, but b/c he said "no" they got pissed.....
It would have been easier to have said "yes."
If they had found it after his consensual search he could plead it was not his car, ergo not his roach. Now it looks like he knew the roach was there and was trying to prevent the police for searching. (Although the search by the K-9s was still a 'search' after he had said no.
....anyone can be searched b/c once a cop stops YOU the cop can search your person, or the part of your car under your immediate control for a concealed weapon (yes, incl'g the closed center console, but not if it or the glove-compartment is locked) for the purpose of protecting him/herself...this after the cop has stopped YOU! [the cop wouldn't be in danger of a potentially concealed weapon if they hadn't of stopped you in the 1st place, but that is besides the point in the eyes of The Law....
and, son, please dont' give legal advice until you have attended law school at the very least. :o

The letter clearly states that the son wasn't smoking in the car....The roach was a product of his sister smoking in the car at another time. So, why is everybody calling him stupid? He was a victim but, not of the system....He was a victim of his sister's stupidity!

And regardless of how we feel the system should be, the reality is that the system is the way it is and if you don't want to be busted you must abide by the laws until we can change them otherwise, we just live up to the lousy expectations of law enforcement.

The thing to realize here is this"
1) who has the most evidence in their favor ? The cop , claiming he smelled weed then finding the roach , or the kid who has a story that they've heard time and again . (its not mine )
2) the burden of proof IS on the cops but they have that covered .

You'll find this will be difficult to beat . People should always insure the car STAYS clean . Had the cop said he smelled pot and found NOTHING you would be in a better position . (I realize a roach is next to nothing but the Judge won't see it that way .) I would go for damages to the vehicle for sure .

Minors have their records sealed when they turn 18.

Still, it's only sealed with scotch tape....I'm sure if he applied for a goverment job later, they would open up the file, regardless of what they might tell you...

My guess is that the cops used their intuition to detain the kid, and then waited for the dog to bark, shit, cough, or wag his tail. They call that "alerting" to the vehicle.

Then they search your vehicle, find the joint, and report to the judge.

It's a win-win for the cops; if they find something, they tell the judge "We thought he had pot in the car, so we called for the dog, he alerted to the vehicle, and we found pot"...then you are screwed.

If they don't find anything, they re-train the dog...they aren't perfect after all...darn false positives...
