Of course the officer then asked my son to step out of the car and asked if he had anything on him or in the car that the officer needed to know about. My son’s response was "no sir.” The cop then asked if he could search the vehicle. My son said no because he was in a hurry and needed to be home by 10PM (the stop occurred around 9pm). There were five cops on the scene and they called for a K9 unit from a different township in a neighboring county.
The K9 arrived about an hour and a half after the traffic stop. The dog proceeded to severely scratch all four doors of my daughter’s car and then the car’s interior. The dog detected something in the center console. They found a very small roach inside the compartment and charged my son with driving without headlights, failure to produce documents, and possession of a controlled dangerous substance in a motor vehicle.
After picking up the car at the impound lot (which cost $163) I notice the damage to the car and went right to the police station to see what they were going to do to repair the car. The cop filed a report concerning the damages and said he'd see what he could do.
When I asked the cop why a K9 unit was called to the scene, their response was that the officers on the scene detected the smell of marijuana. I asked why they sought permission to search the car if in fact they had probable cause. The office then became angry with me and asked, "shouldn't you be more concerned that your son is smoking marijuana?" I explained that that conversation will be between me and my son and that my conversation with the police was intended to 1) make sure that my son's civil rights were not violated by being subject to unnecessary detention and an illegal search and 2) to inquire about the damages to my daughter's car.
Needless to say, we have retained an attorney (at a cost of $1500 dollars) and will vehemently fight the charges, however, it is comical to think that five cops and a K9 unit were wasting their time and tax payers’ money to make this giant bust of a seventeen year old for a old roach that he wasn't even aware of in his sister’s car.

Some videos of actual news media and discussions in the senate on a bill to legalize ALL drugs. They are fighting in Congress and the UN and traveling all over the U.S. to help educate people on the failed drug policies. I urge everyone to go online and look up "Law Enforcement Against Prohibition" and at least check it's validity. I know that after getting busted myself, I was feeling really guilty about the whole ordeal. But after reading through this site for a while I was feeling very disturbed and not because I was wrong but, because WE ALL SHOULD HAVE THE BASIC HUMAN RIGHT TO DECIDE WHAT GOES INTO OUR BODIES!!!

I also wanna bring to your attention that not all cops are of the hard knock sort. Most are the equivelent of Wienies with hats & badges, but some would rather go after criminals than "smokers" but some "smokers" make it all too easy to be found & some are of the terribly stupid sort & are blatant. Don't be stupid, smoke in/on private property & don't partake while driving. 'Nuff said.

There are plenty of us that would be more than happy for marijuana to be legal. Yeah, the price would go down and that would be a bummer for some dealers, on the other hand a lot of us wouldn't care anyway because we grow our own. Cigarettes are legal and if anything they've only gotten more expensive as time goes on, along with alcohol...which doesn't lose it's value just because it's legal.

Jersey cops are fuckheads. I know this. That doesnt make you any LESS of a dumbass for getting caught with miniscule amounts of pot. I defend no cops, but I unlike the people who ripped a bowl before posting instead of me who will after, understand that they have a job and process to go through. They didnt just pull over some kid, plant drugs on him, and attack him with a dog. It was a stupid 17 year old coming back from a friends house with no lights on and got caught with more than he expected. Act like a moron when getting pulled over and expect them to fuck you over. I live in AZ and our Sheriff is a douche. You DO NOT FUCK AROUND when they pull you over.
The validity of the pot law is battled out in court, not at a traffic stop you stupid fucks(njams13 and whichever dickless moron ????? is). I cant wait to see you try to decriminalize with ideas like you have.

NEWS FLASH: It doesnt matter if they illegalize the color yellow on baseball caps, it still makes it ILLEGAL. Sure it would be stupid and useless, but thats not the point. If a law is broken, then dont be surprised when they arrest you.
On another thought, why couldnt he produce documents? Why were there 5 cops there at a headlight stop? What caused them to call the k-9?
There are questions in that story that are severely unanswered. How shakey was this kid acting? They dont call 5 cops and a k-9 for no reason, no matter how corrupt NJ is.

Virginia Gentleman said it best . The prosecution has the burden of proof .They have to prove to a judge that everything is what they say it is .
The kids story (not plausible once the cop says he smelled it) is not convincing to me , and I don't think the judge will believe it either .
Bottom line , if there was no "roach" the whole incident would have been averted .
Soooooooo , pay attention and DON'T GIVE your ass to the cops !

this story reminds me of when 7 cop cars (no joke, 3 UC SUVs, 2 UC cars, 2 reg cars) pulled us over when they saw us blazing in an unregisterd car with an unlicensed driver. we ate the evidence n didnt end up in ne trouble but did lose the car. u just gotta talk to these pigs the right way

the moral: chances are if he had said 'yes' to the search they 1)would never have found the roach in the first place; or 2)let it go with a citation [or a warning] if they did find it, but b/c he said "no" they got pissed.....
It would have been easier to have said "yes."
If they had found it after his consensual search he could plead it was not his car, ergo not his roach. Now it looks like he knew the roach was there and was trying to prevent the police for searching. (Although the search by the K-9s was still a 'search' after he had said no.
....anyone can be searched b/c once a cop stops YOU the cop can search your person, or the part of your car under your immediate control for a concealed weapon (yes, incl'g the closed center console, but not if it or the glove-compartment is locked) for the purpose of protecting him/herself...this after the cop has stopped YOU! [the cop wouldn't be in danger of a potentially concealed weapon if they hadn't of stopped you in the 1st place, but that is besides the point in the eyes of The Law....
and, son, please dont' give legal advice until you have attended law school at the very least. :o

1) who has the most evidence in their favor ? The cop , claiming he smelled weed then finding the roach , or the kid who has a story that they've heard time and again . (its not mine )
2) the burden of proof IS on the cops but they have that covered .

Still, it's only sealed with scotch tape....I'm sure if he applied for a goverment job later, they would open up the file, regardless of what they might tell you...
My guess is that the cops used their intuition to detain the kid, and then waited for the dog to bark, shit, cough, or wag his tail. They call that "alerting" to the vehicle.
Then they search your vehicle, find the joint, and report to the judge.
It's a win-win for the cops; if they find something, they tell the judge "We thought he had pot in the car, so we called for the dog, he alerted to the vehicle, and we found pot"...then you are screwed.
If they don't find anything, they re-train the dog...they aren't perfect after all...darn false positives...
