Busted Letter #118

No Grow-Op Too Small

My name is Richard Webb. I am 52. I live in southeast Oklahoma. I am disabled with a fatal disease of my circulatory system. My dad died in 2004 of a heart attack which left my mother all alone. She is handicapped and confined to a wheelchair. I moved in to take care of my mother a few months ago. She has many physical ailments and is in constant pain and discomfort. My condition also causes me great pain and discomfort, but I can still get around well enough to do the things that I need to do to take care of her.

I try to give her as much comfort as I can but not much helps. She likes to smoke once in a while, as do I because it helps with depression, insomnia, gives her appetite a boost and makes TV more interesting. I planted a few seeds in a small isolated clearing a few hundred yards from our house. They didn’t do to well. I ended up with four little scraggly plants. They were just starting to mature.

On Sept. 12 I heard this strange noise outside and when I went to investigate, low and behold there was what appeared to be an army attack helicopter hovering over the very spot where those plants were. I couldn’t believe that they actually found my meager little garden, but they had. It wasn’t long before what resembled a platoon of soldiers had invaded our place. They used fear and intimidation to get me to confess. They never advised me of my rights. They searched without a warrant. They confiscated an old shotgun of my dad’s and never told anyone about taking it. I was summarily whisked off to jail in shackles.

My bond was set at $10,000. My old crippled mother got the money together and bailed me out the next day. Thank God for mother. The jail was overcrowded so I was forced to retire to a concrete sitting area for the entire time. When I got home, I looked up the penalties for cultivation in Oklahoma and was stunned to see that I now faced a life sentence. I was given an application to fill out for a court appointed attorney. Since I am on disability from Social Security, I assumed that I would be granted one. I was denied. The reason was that since I had come up with the bond money then I shouldn’t have a problem paying for my own attorney.

I was given until today (Oct. 5th) to appear in court with an attorney or face revocation of my bond and being returned to jail. Our mailbox had been flooded with letters from attorneys wanting to take my case. I guess they had found my name over the Internet somehow and knew I would need one. The only one I could come near affording was $2,500 with $1000 down and the rest in two payments. This will pay for a plea bargain. If I take it to trial it would cost $25,000.

My health is bad. I doubt I can survive prison. When and if I go, my mother will have to be put in a care home. I can’t believe this is happening. They must have some very sophisticated equipment onboard those helicopters to have spotted such a tiny, remote location as I had. Everyone needs to be warned of this. Also, if you know of any attorneys who would be willing to do a little charity work, we could use some help from some kind soul out there who agrees that this law is insane and the people who enforce it are out of control.

Hire the lawyer for 1000. He can't not take your case to trial for nonpayment. You can declare you don't have enough money and the lawyer can ask the court to pay him or have the court appoint one. Your mom bailed you out and if you don't have any assets, it should be easy. Your mom should have nothing to do with the decision if you can pay for a lawyer. Use that debt to your mom as one reason you can't afford a lawyer. My friend did this with his lawyer successfully and the lawyer never asked him for any more money. Once he accepted payment from the court, then the obligation was fulfilled. Fuck the lawyer anyway. These drug laws are designed to keep cops, lawyers, and judges employed and not for public health. Tax drugs, put gangs out of business, and provide free college and health care for our citizens. You can only make positive changes through education and compassion, not oppression and tyranny. Say no to hard drugs. Imagine a world where everyone smoked pot openly.

I'm voting Ron Paul, while I may not agree with him on everything he's the only candidate openly stating his opposition to anti-marijuana legislation.

I advise any other US smokers to do the same, or look into whoever you vote for and find out about their position on drugs laws.

Why are we spending trillions of dollars enforcing laws against people like dying patients trying to soothe the pains of their illnesses. Especially when we have an enormous deficit.

Have a sympathy for this man,I cant stand a few days in jail let alone years or life.I have been arrested on possession charges with intent to distribute.2000.00 lawyer 110.00 possession of drug para.My best friend had a small grow op in his basement,one fight with his old lady and she and her ex boyfriend called him in.1 year in jail,5 years pro,poor bastard lost everything.I have since taken a job that has a random hair test every 60 days so I have cleaned up.It can happen to anyone.You few blowing this guys story off sound like you are 20-25 and havent gotten your feet wet yet.It will happen and when it does remember this guy you were cutting on.

Oh and if u still out on bail, my lawyer from tulsa got me out of a felony charge and he charged me 2,500 his number is 918 585 3721 also if u can get ur hands on a tulsa phone book there is a NORML lawyer here that will take ur first case for free and he has a seventy-odd percent success rate. Certain helicopters are equipped with a special light now that changes color when it hits a marijuana plant. Dont grow outdoors any more unless u own a large ammount of private property and i would suggest growing in the middle of some tomato plants so that there is less of a chance that the light will reach your plants. Greenhouses are pretty much a wide open target so id stay away from those too. Fuck the police. They need to focus on violent offenders not some dude growin 4 measly plants for his sick mother. I live in oklahoma too and ive been through the court system here i have to say that its bullshit i was never asked to be searched or read my rights. DONT MOVE TO OKLAHOMA IF U SMOKE BUD THE WEED SUCKS AND COPS ARE DICKS HERE.

I know I already posted a comment before but the scope of this one is different. I know how they discovered 4 measly plants in a sea of other green plants. Even though cannabis is one of the most miraculous plants on earth in terms of the diseases it can treat, it's pattern of light absorbtion is the exact opposite of most other plants. It absorbs visible light that most plants absorb, yet it reflects/generates infrared light (thermal). Basically, to a thermal vision camera, cannabis plants will show up like candles in the middle of a cavern.

I hate to say it but this is either BS or this guy got trampled then admitted to it under stress. My roomates angry ex-girlfriend called the cops to come search our place and they found his starter kit with about 20 or so sprouts(1-3inches) in a storage area accessible only from the outside of the house, but I was the only one home at the time. I of course denied any knowledge of said plants and took the fall for the few pipes lying around and the 1/8 on my nightstand as the ex let them in at 9am after my 11pm-7am shift and I awoke to 1 uniformed Officer and 2 plainclothes "detectives" standing over my bed looking around my room. Because the stuff was in a common area of the house and no one admitted to it I got off with 1 yr probation $200 in fines and no community service, and thats with no lawyer. So If this story is true homeboy fucked up by admitting to anything that was not in the house, especially a hundred yards from it. And I live in Georgia were the pot aren't lax

here in northern cali we have commet also known as camp (campain aginst marijuana planting)They do have the coast guard and some military copters helping to,but i havent heard of someone getting raided for a few little plants a few hundred yards from a house. For a good size crop they will land and take it i have lost a medical garden a few years back.They basicly just took my shit and left.I was never taken to court over it or arrested.Havent had any more problems with them since 2003

They used a bulldozer to search my house but only found a crate of c4 explosives . (which I use to fish with ) . I am looking at time in jail and my grandma now limps . Rick, Sorry to hear it, I once had a similar bust back in Alabama August,14-2004 and they spoted that stuff with binoculars from arial and I was a total dummy for leaving it in plain view just like you only not you. Those words from Cypres Hill 3 easily could get forgotten. I did over a 180 days paid 20k in fines and did a couple more years probation.Scientist have known for years that tabacco enhances the memory and has medicinal value. A million traitors helped put me there and could had something to do with that bullshit that happened to you too. Roll with the punches and support your local secret libertarians.

I just checked oscn.net the Oklahoma state court networks site and did a search for Richard Webb with the age description there is no record of any dockets with that name even searched with the age added and removed. Not saying he is full of it just know it must be a fake name.

I feel ya pain bro. I am also handicapped and in very much pain b/c of SMA a form of Musuclar Dystrophy. My door was kicked in on OCT 12, 07. Come to find out my fink had a warrent signed on OCT 5. The warrent still seems a little fishy. Considering the NarCs forgot some equipment yet they took a few goodies for themselves. (Rosenthal Tips for the master himself) Anyway, brah good luck. I am still a young man 28 yet I know I have less time then most. So keep the faith and I pray that someone comes helps us in our dying need. PS yeah im in trouble too :(

I think you did the right thing running to Mexico. Why stay to bend over for the goverment to give it to you raw. Most of why they want you in jail is for more money, it cant be for justice! I'm wandering if his disabled mother (who occassionally smokes), maybe slipped up and told one of her croneys. SOMEBODY HAD TO KNOW, either that or the feds were just doing "fly bys" and checking out the land (which they do regularly in Cali). There is actually a group or whatever here called CAMP and there only job is to fly and hike around looking for pot gardens and bust people.

The whole attorney thing with getting stuff in the mail is not to unrealistic either. When my brother was busted on non-marijuana related charges, attorneys/lawyers/whatever started sending advertisements for thier services. I think they get something from the jail with all the lists of people who were arrested the previous day or week. It's all public info., you can go to the county jail web site and see who's been arressted, it's really not that hard.

I really believe someone must have seen you watering or taking care of your ladies. One thing to keep in mind is that most neighbors are nosey!Even in the country1i live in the country and I use to smoke pot and grew some out west. Most of the time when a grow op is less than 10-15 plants in one area, there ususally is evidence that you are growing...ie: a worn path to the area, pot out in the open, or just the classic "look" of a pot plant. Many times the popo and prosecutors and your own attorney will point out the MAXIMUM as the penalty you are facing. The law in OK says this:
Possession of any amount of marijuana is punishable by up to one year in jail for the first offense and 2 - 10 years in prison for subsequent offenses. Conditional discharge is available to first time offenders.

Cultivation of 1,000 plants or less is punishable by 2 years - life in prison and a fine up to $20,000. Cultivation of greater than 1,000 plants is punishable by 20 years - life in prison and a fine up to $50,000.

Sale or delivery of less than 25 pounds is punishable by 2 years - life in prison and a fine of $20,000. For sale or delivery of 25 pounds or more the penalties increase to 4 years - life in prison and a fine of $25,000 - $100,000. Sale or delivery of 1,000 pounds or more is also punishable by 4 years - life in prison, but the fine increases to $100,000 - $500,000. Any sale to a minor doubles the penalties. Sale within 2,000 feet of schools, public parks or public housing doubles the available penalties and carries a mandatory minimum sentence of 50% of the imposed sentence.

What a nightmare! I am a Canadian so this story just seems rediculous really. Four plants or Forty, life sentences are supposed to be for criminals not GARDENERS. You guys have to start calling Senators and voting to get these type of situations to NOT HAPPEN. I hope things work out for you Richard, I really do. What a real crime it would be if you had to do another day in jail let alone Prison. Heh if things do work out for you in court and you stay free a free Gardener......come to Canada and have a smoke. I also was sent tons letters from the snake lawyers when i was released from jail their is no privacy laws that protect you from them knowing you went to jail it is public record and if you pay attention if the news can say was arrested then what stops a lawyer from knowing. I live in Oklahoma, His story is very real sounding for here I was arrested kept in jail 45 days then sentenced to 18 months probation, 6 months inpatient treatment, 300 hours community service, and forced to pay $946.74 in court cost and fines all for less than a half a joint Oklahoma is notorious for making an example out of pot smokers.

Personally, I hope that some attorney has taken up this case by now. Naysayers in the forum below: stop. Maybe you all should go hit the craigslist forum. You will fit in perfectly there, where no one ever accomplishes anything. Bickering back and forth about whether or not the story is a fake.... blah blah blah.

Just take a willing sense of belief perspective about it. Assume that it is true, because some sick guy in Oklahoma stands to lose everything, and have his mother sent to a home. I will also assume that High Times has some sort of safety net lawyers or something to sick on these cases as they arise. After all, they've published the letter. If they didn't offer some sort of assistance, it would basically just be exploitation of another political prisoner of the war on some drugs.

I'm giving HT the benefit of the doubt. This is the kind of thing that should be put on TV, PBS or The History Channel. I'd like to see testimonials from these people, anonymous face-blurred out people, and inmates, as well as a film refutation of how that History Channel show portrayed the 1960s in Haight Ashbury and elsewhere so negatively, with all that creative editing! At that time there was also a thriving cannabis culture everywhere in the country judging by the number of Spencer Gifts and (other) shops selling pot paraphernalia. Paraphernalia is/was easy to make for do-it-yourselfers, and the Prohibitionists' limiting by zoning laws and licensing the number of head shops today does not make the issue go away. Out of sight, out of mind; not that many head shops, then not that many people using pot? That can't reflect reality when the number of people incarcerated keeps going up.

The government should stop any action against these people, and make things good again. They are essentially already sentenced to remaining in the house, essentially a house arrest. The greedy bastards are just going for a land grab, then going to cash in on its sale. It's a pathetic way of earning money, and unreliable because if it's successful the well dries up. Oklahoma would be better advised to secure a steady income for its infrastructure via some sort of legalisation.

I guess the Feds still have enough NG & Army Reserve troops and state & local troopers so totally not in the Middle East that they can still wage an immoral crusade against their own citizens!

The lawyers that sent Advertisement/letters got his name from the daily police blotter just like a reporter reporting on a news story would do.I personally do not think this story is made up. He sure did write a dramatic sad - sad story, hope everything is O.K. with him and his mother. Sounds like he maybe lives on the property where he had the plants planted, Oklahoma is a flat area he could have seen something going on in the distance military helicopters are not exactly quite machines .It all sounds possible (I can still remember the night I came home to my property and seen them raiding my house 17 years ago - THEY WERE freaken RUTHLESS ASSHOLES) .I wonder what other charges he received or if he had a prior criminal record, are they going after his home & property? were the plants on his property?.It does say 2 years too Life in Oklahoma & plus 20,000 dollar fine - with no prior I bet (wild guess) he serves under 2 years and serves the rest on probation and pays one Big hefty fine $$$$$, it's all about the money. Be happy Richard you were not granted a court appointed attorney - a court appointed attorney will not work for you as hard as a hired attorney - you should go to NORML's web site to find a lawyer, they have a state by state listing I looked under Oklahoma and there seem to be few in that state that would be best to help you out in this matter.But at this point you should have all ready retained a lawyer for this matter - Well it is October 10th his court date was (Oct 5th) Richard Webb you out there safe and free ? give us an update.

I have had many friends get arrested and I have never seen or heard about any lawyer advertisements that they just send out to people.

It must be a local thing, because I have never at any point in time for any reason heard about it happening here in AZ. You would think getting a mail list of people who got arrested would be an invasion of privacy or something...

On another subject, anyone ever notice that the "Busted Letters" are always a huge punishment for a miniscule crime? Say for instance the last one was about the kid who got caught with a pin-head sized roach in a car that wasnt his for not producing documents for the car, which sounds pretty BS as well. Heres the formula:

1: Regular everyday person, aka teenager, elderly, businessman
2: very small amount of grass on premises with little to no evidence supporting that it is the writers stash
3: massive cop overreaction in the manner of attack helicopters, attack dogs, SWAT, etc...
4: Strange lawyer scenario.

They are sounding to be a bit fabricated now...

The cops simply don't give a fuck what your rights are the just want another arrest on their stats the the taxpayers must pay for. Also, MassHaze if you have been arrested in the past, you would know that attorneys get a weekly list of arrested persons and then mail them advertsments, trust me i've been arrested twice.

If this is true, and by god Richard Webb, 52, of South Oklahoma, I am sorry if it is. Without evidence to support that the plants were his(like photographs of him tending the garden), the fact that it was hundreds of yards from his house would make his search null. They had no probable cause unless he went out to the garden to check it and then "intimidated" him into saying "yeah these are my plants what do you want Im on disability."

This story is either fake or WAY exaggerated in the wrong direction, and just because its exaggerated doesnt mean shit aint still fake in it.

Attorneys cant just "find" arrests over the internet. It doesnt work that way. The junk mail you get in your email box that says "GOT CAUGHT?!!! WE'LL HELP!!!!!" does not count as Attorneys contacting you over a specific case.
