Busted Letter #121 – Compulsory Cooperation?

I'm just looking for a little advice…for a friend. Anyway, this friend of mine was pulled over one night for improper equipment – a taillight was out. The officer who pulled him over smelled weed and told my friend that he had reasonable cause to search the vehicle because of the smell. He then told my friend that if there was anything he wanted to give him before he conducted his search, it would be much better than if he were to find anything on his own. My friend thought about it and decided that he was in the wrong and it was time to face the music. He handed the officer a burnt down joint and a bag that was a little shy of half an ounce.

The officer took the contraband and proceeded with the search. After his search produced nothing else, he asked my friend to get back into his vehicle. The officer ran my friend’s driver's license and came back and told him that he would be willing to let him go if he told him where the weed came from. My friend didn't give any names, but more or less gave the officer ideas of where it came from. This seemed to suffice and the officer told him to be on his way and to get the taillight fixed.

Now nearly two months later, my friend gets a call from the local police department asking him if he is still willing to work with them on the incident that happened when he was pulled over.

My friend did not get arrested that night; he did not even get a ticket. Does he have any obligation to the local police department? Can my friend still get a possession charge for what happened almost two months ago?

Now im not a lawyer and dont want to seem as such however, I have had several mishaps if u will with the law. Vechicle searches vary by state because when u signed that license u got in ur wallet it says u consent to it and u agree so decipher that. If u say no when they say smell it fine they cant search on smell alone but they can and will bring drug dogs to the vechile the dog hits they search so u decide. As far as does your friend owe the police anything no absolutely not can he get a charge possibly yes however due to everything in this case it wont stick up in court but i would lawyer up asap!

will, please pull your head out of your ass. Saying no to a search is not probable cause AT ALL. The police have asked to search my car many times, and when i say no, although they do get pissed, they realize they are more or less beating a dead horse and drive away. Now of course one could get a crooked cop who violates your civil rights, but in that case charges will probably get dropped anyway. Stop giving people false information, as all it's doing is helping innocent stoners get arrested. JUST SAY NO (to a cop). Oh, and whenever a cop asks you something, give them the best answer you can: "I don't want to talk to you, I want to talk to my lawyer".

Just so you all know. For vehicles cops don't need a search warrant. Simply saying no to a search is probably cause.

jsut dont call them back, duh. they have nothing on you at this point. i would be shocked if they still had the tape from the cruiser, that means no record was made of this. if the cop had made one notation about finding weed on you hed be fired for not arresting you because his superior would be pissed (hed be pissed the cop didnt arrest your freind for the fine money that gets funneled back into the cop departments budget, not because he has anything against weed)

its too late for the cop, dont call him back. block the number, they have nothing on your buddy. if he comes to your house dont even open the door for him, just dont answer and wait for him to leave.

The NORML freedom card is useful for this situation. Your friend needs to take responsibility. Why should someone else get in trouble? Smell can be enough for a warrant for your car. Just keep driving the speed limit until the evidence is gone. You are not committing any crime by driving to a location in which you feel safe. Never cooperate with the cops but there are exceptions to every rule. If you KNOW you are busted is one case. If you treat them like they are stupid, then they will fuck you IF they can. I was caught smoking a blunt in my car. The blunt was still burning. They asked me what I was doing. I told them they knew what I was doing. One cop got a little snippy while the other one commented on the smell of weed. The snippy cop thought I was being smart. I explained it was obvious I was smoking pot and did not think he was stupid. They asked me if I had anything else and I told them I would have to search my hiding spots to make sure. I turned over a once and they lectured me about how stupid I was for being where I was and gave me tips on how not to get caught. They explained that weed was the least of their concerns and to look out for the younger cops because they were not cool. They also explained what they could charge me with and that they could take my car. I was 18 at the time with a 17 year old with me. That meant I could have been busted for contributing to a minor. They asked me were I bought it and I told them from a black guy in a caddy on the bad side of town. When they ran us for warrants, he commented that I wasn't going to give them any information. When everything came back clean, they said to get in my car and leave. I was very stoned because the blunt they caught me with was the 2nd of the night. I thought they might be entrapping me to get a DUI. But I did as he said and left. Not all bad, because I found the blunt that I put out in the ashtray as I left. The cops never went in my car. They stole the once though.

I forgot one critical thing in my post below, COPS ARE PROFESSIONALS!

When they give you the "Give it to me before I find it" line, it's because they have no reason to search you.

You'll note almost every time they don't ASK if they can search, they say they have probable cause, but then all of the sudden we're waiting for the canine unit?

When you hand them a bag of reefer, they now have everything they need.

This concept is called "manipulation".

Wait a minute, police would never manipulate you. What was I thinking?????

It amazes me how people still don't understand the simple concept of keeping their mouth shut.

First off, when a cop asks if they can search your vehicle, remember, there is no law that says you have to open your mouth.

The less you say, the better. Be very selective in the questions you choose to answer.

If you are an idiot, and just can't shut up, dodge the question by changing the subject, or asking a question of your own.

If you don't already know, now would be a good time to find out why you were stopped.

That is the reason you are on the side of the road, and the cop is burning taxpayers gas money.

Once properly informed of the issue, simply figure out how to solve the problem.

Example:

Cop: "I pulled you over because your license plate light doesn't produce 75 lumens."

You: "Oh, I was unaware of that officer, but thank you so much for pointing that out. I will have to get that fixed right away, so I don't waste anymore city resources. Am I being cited for this?"

Now, here's the important thing. YOU HAVE TO ASK "AM I BEING CITED FOR THIS VIOLATION?"

If not waiting on a citation, then you have to ask "AM I BEING PLACED UNDER ARREST?".

If the answer to both of those questions is no, you are free to leave. Inform the police officer that you appreciate his/her service to the community, but that you must be on your way since you are not required to waste anymore of your precious time.

A good rule to remember is:

If you answer more than 2 questions, you need to stop talking.

This is another case of bull shit. "smelling" weed is not probable cause to search a viechile. It is important to remember that the ONLY way he has probable cause is if he sees weed or a pipe. Alot of times cops will ask 2 part questions to get you to forfieght your right against unfair searches, its important to be smart if your going to smoke because the cops are assholes they think there all big when they bust us weed smokers

If you get a summons, dont go. Have an attorney call the judge and explain what you just told us. They should drop the charge (Depending on the state) and you should just be able to pay $200 in court fees and it will be esponged from your record.
But I would like to say on the behave of all stoner, your "Friend" is a little bitch for opening his mouth, its not about giving names, its just that you cooperated with the crooked law inforcement, and that makes you a alittle bitch.
Besides, he should have just eatin the Bud, there wasnt that much.

What CAN happen is the police can still issue a warrant for your friends arrest IF he doesnt cooperate. When the officer took the weed he wrote a report obviously that named your friend as the suspect for possession of the weed but indicated that he would help police for not getting arrested. So yes, your friend still can be arrested for the weed the cop took. Generally for a misdameanor amount the police have up to 2 years in which to obtain a warrant, so just becuase the officer let him go then doesnt mean he cant still get in trouble if he doesnt cooperate.

Your friend gave up his rights when he went into public. If he had been legal with his ride, this would not have happened.

I find it humerous, that we always ask for our right to privacy and the right do as we want, but when it comes to anything OUTSIDE of the privacy of the home, we are quick to ignore the rules we must follow.
Any thing in the public is up for the rules of the public...If we truely want our rights AND privacy, we must learn where those end and begin.

We cannot ask for our rights to be upheld, by ignoring someone elses.....

Several years ago, a jilted ex girlfriend called the local drug task force, saying I was dealing out of my apt., which was a total lie. The coppers showed up, my roomie let them in (dumbfuck!). They woke me up, searched the whole place and only came up with a couple of seeds and some stems. They said they wouldn't haul me in then, if I rolled on someone. I told them to go piss up a rope. They gave me their card and left, telling me to contact them if I changed my mind. I threw their card away and never thought any more about it. ^ months later I moved out of state. I went to get my driver's license in the new state and was informed that I had a felony warrant out for me from the state where the coppers raided me. I inquired about the warrant and was told it was for felony posession of cannabis. Felony! stems and seeds! I hired a lawyer from the HT list and was railroaded into a plea deal..... If I had been willing to roll on someone, this would have went away, but since I ain't no snitch, I now have a cannabis conviction on my record, that along with 6 mos. of probation, drug tests and fines. FTP!

depends. any paperwork from the incedent gives the police 7 years to arrest, after that statute of limitations is over. if theres no paperwork id tell my lawyer to let them know they can go fuck themselves. the guy shouldve been a responsible head and taken the charge instead of cooperating further.

a big NO, the police must have all CDS tested to verify its nature, the only way they can confiscate and test a suspected CDS from an individual is by arrest, if there is no arrest report and no lab results for evidence of a CDS in an individuals name there is no case

in some states(like New Jersey) possession of under fifty grams of weed is a disorderly persons offense. They have up to six months to charge you on a complaint summons inleiu of a arrest. Plain view and plain smell go hand in hand, and the fact that it was in a vehicle causes the automobile exception to come into play. The cop probably logged the evidence and wrote a report on the incident. You should ask a lawyer for advice and get a copy of the report.

Like TCB says, the most powerful personal civil right Americans possess is the right to keep silent and thus not to incriminate oneself. This will require the authorities to make their case in court and this is a much more difficult proposition to deal with than the convenience of a confession obtained through intimidation and trickery.

Excellent. You have the correct attitude. I like a lot of the reactions so far, but your's was pretty much right on. I also liked 'are you serious', 'yo', 'John Doe', 'moldy', 'JimCrackKorn', 'Advisor', and the first 2 or 3 sentences from 'blunt doctor'. However, I wouldn't recommend telling a police officer to "go fuck himself". When in doubt, stay silent. This is your 5th amendment right. When a cop asks you a question, don't answer right away, they're just doing their JOB. Scratch your chin and think. When they push you to answer, calmly say "I'm considering the question". If they continue to pressure you, remember these phrases:
"No". Or, "I'm thinking", or "I'd rather talk to my lawyer first". Aside from that, remember, when in doubt, STAY SILENT, SAY NOTHING. Let them take you in (if it even comes to that), then demand a lawyer, either your own or a public defender free of charge. The most important thing is, when in doubt, stay silent. Also, NEVER submit to a search! When they ask why, or "what do you have to hide", your answer should ALWAYS be, "Fourth Amendment." If they ask further questions, say "Fifth Amendment". Then don't say a word until your free lawyer shows up. The greatest "Fuck You" that you can give to a cop is your SILENCE. They hate it because they have no LEGAL defense against it. Their only defense is to break the laws that they are sworn to uphold. Make THEM break those laws before you EVER submit to their searches or their questions, unless they start to beat the shit out of you, then tell them whatever they want or sign whatever they tell you to sign and deal with it in court later. Otherwise, just tell them your name and basic personal information.

Seeing as marijuana is an illegal substance, the cops job is to take it from you and charge you for it. If he didnt write you up the moment he took it from you, and just let you go they have nothing on you. If for some stupid reason they decide to bring it up 2 months later, take it to court and tell the judge they bribed you out of getting busted, and they will drop the charges.
