BUCKLE UP OR GET BUSTED
Cops use seat-belt laws to prey on drivers.
Thu, Aug 16, 2007 2:26 pm
With a recent Supreme Court case being decided in their favor, law-enforcement agencies throughout the US have found a new way to bust cannabis consumers: seat-belt-law violations. With every state except New Hampshire requiring the occupants of a motor vehicle to wear seat belts, law enforcement has a new arrow in its quiver—in addition to the existing DUI, illegal-drug, auto-registration and insurance-compliance checkpoints. It’s just one more weapon at the cops’ disposal permitting them to “interface” with otherwise freewheeling motorists engaged in the commerce and enjoyment of America’s No. 1 domestic cash crop.
In many states, the driver of a car can be arrested on the spot for failing to wear a seat belt, which automatically leads to a “custodial search” of the driver and vehicle. It’s exactly what happened this past June to a local pizza deliveryman in Charleston, WV, who got stopped at a seat-belt-check roadblock with cannabis in his car, leading to his arrest.
Also, be on the lookout for much more than just seat-belt checkpoints. Our fickle friend technology is constantly introducing new bits of electronic wizardry for the cops to use in snagging drivers and passengers who haven’t buckled up. A few weeks ago, I took a weekend bike ride in central Pennsylvania. Around nightfall, I found myself on an unfamiliar country road. Eventually, I came to an intersection where a local cop was parked. I rode over to inquire: “Where the hell am I?”
As I approached, he removed a pair of funny-looking glasses and gave me some unfriendly but helpful law-enforcement guidance: “Go back the way you came.”
A tad miffed, I asked him what were the glasses for—in-car porn viewing? He indicated they were new night-vision goggles. As cars stopped at the intersection, he was using them to observe whether each vehicle’s passengers were complying with the seat-belts laws. The officer mentioned that he had “arrested a couple of seatbelt-less kids the other night at the intersection for dope” after observing them through the night-vision goggles.
“Dope?” I asked.
“Marijuana.”
“Oh, marijuana,” I replied. “No kidding! Marijuana. Imagine that.”
Everybody got it? Obviously, buckle up to prevent injuries. But be doubly sure to buckle up in order to avoid an equally painful marijuana mishap.

NO ARREST CAN BE MADE!
Sep 24 2007, 7:02 pm
FIRST OF ALL, THEIR IS NO STATE LAW IN THE U.S. THAT SAYS THE DRIVER OF A CAR CAN BE ARRESTED ON THE SPOT FOR FAILING TO WEAR A SEAT BELT. ONLY A FINE CAN BE ISSUED.
WHO WROTE THIS ARTICLE?
BALANCING OF FOURTH AMENDMENT INTEREST THROUGH "PROBABLE CAUSE" AND "EXTRAORDINARY" CIRCUMSTANCES HAS BEEN DELINEATED IN TERRY V. OHIO, 392 U.S. 1 (1968). GIVEN THE CHOICE TO ABANDON OR ABRIDGE THE REQUIREMENT OF PROBABLE CAUSE FOR ARREST IN THE CASE OF FINE-ONLY MISDEMEANORS, THE COURT RULED THAT THE FOURTH AMENDMENT IMPOSED THE SAME STANDARD FOR ALL CRIMES: PROBABLE CAUSE. IF YOU ARE ARRESTED FOR NOT WEARING A SEAT BELT, FILE SUIT UNDER 42 U.S.C. 1983, ALLEGING THAT THE CITY VIOLATED YOUR FOURTH AMENDMENT RIGHT TO BE FREE FROM UNREASONABLE SEIZURES BY ARRESTING HER FOR A CRIME WHOSE ONLY PUNISHMENT WAS A FINE. THIS ARGUMENT REQUIRES YOU TO CONCEDE THAT THE POLICE HAD PROBABLE CAUSE TO ARREST YOU FOR VIOLATING THE SEAT BELT LAW, AND THUS THE UNITED STATES DISTRICT COURT FINDS SUMMARY JUDGMENT FOR THE CITY. A PANEL OF THE FIFTH CIRCUIT REVERSED, HOLDING THAT ARRESTING A PERSON FOR A FINE-ONLY MISDEMEANOR WAS PER SE UNREASONABLE. THE FIFTH CIRCUIT SITTING EN BANC REVERSED THE PANEL, AGREEING WITH THE DISTRICT COURT'S REASONING. THREE JUDGES DISSENTED FROM THE EN BANC PANEL'S RULING, ARGUING THAT THE POLICE HAVE TO HAVE A SPECIFIC REASON FOR ARRESTING YOU FOR ONLY VIOLATING THE SEAT BELT LAW.

Seat Belt Legislation
Sep 12 2007, 10:46 pm
All smoker's move to New Hampshire, the only state in the country that has NO SEAT BELT LAWS ENACTED. WRONG! On the flip side New Hampshire has HARSH marijuana laws. New Hampshire says who gives a fuck if your buckled up in your car moving at 55 MPH, but boy, don't let us catch you with less than 1 OZ. of marijuana, will give you a felony and 3 years incarceration with a fine of $25,000. We don't care if you fly through your fucking front winshield on impact, but we do care if you have any bud at all?
Seat Belt Legislation is a law or laws put in place to enforce or require, the fitting of seat belts to motor vehicles, or the wearing of seat belts by motor vehicle occupants. Most western countries have some seat belt legislation.
Just drove down to Wal*Mart with my special safet harness "Seat-Belt". Bought a pack of White Widow, SURGEON GENERAL'S WARNING say's, Marijuana smoke contains THC which does not cause Cancer. It also say's underage sale prohibited.

Not like I'm gonna be driving a hundred fucking miles an hour while I'm baked man, shit, give me a break.
Seat belts cause Chest injuries, may cause cardiac arrest, lung bruises are amongst the most common causes of death by SEAT_BELTS especially for people of weak heart such as the elderly who can also suffer a heart attack and not be able to free from the seatbelt in order to hide their stash man.
Fuck, the next thing you know they will have us wearing fucking helmets while driving our cars. How fun will that be, looking over at the cool chick with her fancy bigbuggy fucking helmet on man. Or wear a seat belt while riding my Harley.
I mean come on. Did the baby boomers let all these stupid laws and "SEAT-BELT LEGISLATION" just slide on through. We should be worried.

If you had anything to lose you might get a little smarter about your weed and not bring it in the car. Get high at home and then leave..what a concept..Oh yeah, reach out to your conservative stoners..We love good weed, but don't believe in socialism or that the U.S. is a evil empire.
They just need to take smoke off the Schedule 1..

Bottom line, cops do not, in fact ( as opposed to law ), need to have probable cause other than a desire to stop you and poke their nose up your ass.
