Busted Letter #123 – Basement “Hydro Lab”

My wife and I got busted back in October. Someone called the D.H.S. and told them that there was a gash on my son's head and we did not seek medical help, which was not true. A worker and a state trooper came to look at him and saw that he was fine. After that they came up with another complaint about drug use and insisted that they look through our house.

My wife told them that I was at work and asked them to come back when I got home. They told her no. So, they finally conned their way into our home and looked through our house. They didn’t find anything at first. When they got to our bedroom it was locked. I was the only one who could get in the bedroom and the basement, so they made me come home from work to open the doors.

When I opened the bedroom door they found a couple of small buds hanging in my closet. After that they wanted to get in the basement. I asked them if they had a warrant and the trooper said no but that he could hold me until they got one. So rather than them doing that and coming back and ripping our house apart, I opened the door. Big mistake!

When he got downstairs he discovered my "Hydro lab," as he called it. There were 63 plants all together – 45 fresh clones and 18 ripe ones. After he found that, he had me sign a consent form and said he would not take us to jail. So I did. I don't think that it was a good thing to do. I have never been busted before. He held up his end of the deal. We finally got a court date at the end of February. They are getting me for manufacturing, delivery, possession and maintaining a drug house, which is totally bogus. I was not selling it. They found no money at all and no one has come forward and said that they got it from me so I don't know where they get off charging me for selling.

On top of all that they weighed it when it was wet and the roots were still hooked to the grow rocks so it came out to 5.45 kilos. Even worse they charged my wife with possession and maintaining when I took full blame for everything. She even passed the drug test. Do you have any idea what kind of trouble we are looking at? Do you have any advice that you think we should know about? We live in Lexington, Michigan. I am 29 and don’t have the greatest record but no drug charges. I work every day of the week and I have for the last year. My wife is 23 and has no record at all. We have two children.

Any info is better then none.

You and your wife should have (if not already done so) written down everything that happened. Obviously, this is best done as soon as possible.

Decide whether it is better to have a trial by jury or a trial by judge...matters of law are best decided by a judge. At least that is the advice a Public Defender gave me when I was busted for possession of cocaine back in the 80's. And, it sounds like the best way to go for you as it appears that this may also be an illegal search.

I let the judge decide my case and got off as it was an illegal search and seizure. What it comes down to is the judge will either believe you or believe the cops. Be prepared that the cops will commit perjury when they testify in court.

Ok here's the deal this is all hindsight now but, first never believe cops. 2nd the cop would have never waited for u if he didn't need ur consent to search. To get a search warrant u need a judge to sing it he won't sing it unless its concrete evidence remember its the judge sticking his neck out at this point if its not right the city could be sued. If the cops are knocking it means there fishing never answer the door if they come .if they got a warrant there kicking the door in always! There afraid u might have weapons there not gonna give u a chance to get em before I started growing I consulted with a well renound criminal attorney in detroit he set me with guide lines 1 never grow ware u live 2 never sell out of ware u grow 3 never I mean never answer the door wear ur growing. Never leave anything that traces back to ware u live keep ur money in cash they will cease bank accounts they always go after the money also. never have children around what ur doing that's child endangerment dummy always know who ur dealing with do a little home work try to have them be life long friends know ware they live who there kids are ware there family is u need to protect ur best interest all I'm trying to say is be professional also look ur the sentence guide lines in mich for growing. And most important DON'T SING or say ANYTHING! WITHOUT UR ATTORNEY all u will is make his job harder to get u out of trouble

hey i got a question i got drug tested august 6th or 7th and my level was 240 then i got tested on either the 10th or the 11th and my levels went down to 175 then i got tested on aug. 21 and they said my levels went up to 218 but i haven't smoked what could have made my levels go up and could my levels really gone down 65 points in 3 or 4 days could it possibly been i drank more water the second test so my levels looked lower?

I too was screwed when they weighed my "huge" stash when I was busted. The fools cleaned off my rolling tray and weighed roach papers that I had already emptied. Total marijuana I had was about 2.5 grams but after they added in the paper, seeds, and stems it came to about 5 or 6 grams. The actual bud was in one baggie, no cash, no extra baggies, and no proof of sales and the fools still tried to charge me with intent to resale.
By the time court rolled around it was dropped to simple possession and the judge told me I should have told the cops to fuck off,they had no right to be bothering me.

Hopefully everything will be ok, but I don't know much about your state laws. I feel so lucky to live in Canada, and not deal with as harsh as punishment for growing pot. About 10 years ago, when I a teenager and lived at home, our house was 'raided', and my Dad was held over night for production. He had about 100 plants + at least 20 clones, a very nice home s/u. I remember coming home to about 6 OPP police cars in our drive way, plus a trailer. Our house was surrounded by trees, so I snook through our neighbours yards and hid in the back forest. I had to watch them, in line, removed full garbage bags from his s/u, until i couldn't watch anymore, and ran to our neighbours. Anyway, bless Canada: was released without bail, never saw more than one day of jail, and was sentenced to a 1.5 years of probation.

i'm sickened by any fuck who doesn' beleive 5 to 6 lbs can be consumed for personal use in a grow cycle. depending on the cycle it can take up to 4 and ahalf months to harverst and cure your crop,and what kinda fuck doesn't share free pot with his friends and relatives who come by to shoot the shit. Dude you fucked your self by letting the cop search your home without a warrant. That was the first thing you should of asked for when you got home from work. Now as far as your wife going to jail I doubt it. You had the key and there was no way for her to get into the bedroom or basement without you being present, so that suggest's to me that your in "charge" so to speak. You probably fucked yourself real good when you signed the form the trooper gave you to sign. Your very next move would of been to contact a lawyer as soon as them pigs left. Here where i'm from massachusettes that shit would not fly in a court room. The pig coming and conning his way past my wife violating her civil rights to snoop around my house. The judge would throw the case out and embarrass that state trooper. But you are from michigan I think you said and I don't know what your laws are, but you definately need to contact a lawyer dude!!!!

I live in florida and my laws are probably pretty different from yours. My brother knows all about the law because of his past and he says they would drop all charges because you were wrongfully charged and they could only get you on caltifations

I had a simular situation. Less plants though. The fact of the matter is your wife gave let them in. You knowenly gave them promission. I got 18 months probation, and 30 days in jail for having 5 small plants. The cops where in my house for 3 hours before they had a search warrent. I wasent home but my gf let them in. Get a good lawyer! No court appointed shit or they will F*ck you hard, Good Luck. If you have a any illness under that you need to smoke to feel better dont be affraid to tell them you self medicate. I was busted before, and you know what the sad thing is. It only encouraged me to smoke more and become more of a marijuana law reform activist. So my advice is to lay low for a while, do what you do and fuck the police. Can't let the man get you down. Especially because you know your NOT a criminal! The police came to your house on another matter which was the welfare of your son , You should have taken your son outside where the officer would have questioned him on his wellbeing and so on.

They had no right what so ever to enter your property and the threat of getting a warrant thats a joke , a judge would not have issued that.

When you go to court say you were threatened by the police officer to the degree that he said I want to search this house or I will make sure Child protective services get involved and have him taken away & also the fact your son was fine ..

Im thinking your neighbor somehow knew you were growing dope maybe through your children saying something to the other kids ( If your kids know what your doing then you need to make sure they understand that you can get in trouble with police) and would have told the officer this and your sons injury was just an excuse to search your house ...

Id be taking care of your neighbors ......

police use intimidatation all the time to bluff you , when dealing with the police I always treat it like a poker game where theres a big pot to win or lose.... I like to win ..

To all of you people out there who are stuck on the fact that the police weighed out his grow and it came to 4 kilos, and cant believe that it was all for his own personal smoke:

You have to remember that they busted his GROW. they didnt find a 4 kilo bag of chronic, they took his plants. The majority of the weight on them would be stem and leaf - granted, there is plenty of weight supplied by nug, but its mostly foliage that their weighing there, plus like the poster said, there were hydroton growrocks all stuck to the roots on the plants. If you have enough growrocks, that shit can accumulate weight too.

Now, you also have to take into account that in all probablity, this guy is growing perpetually, so he never needs to be out of chronic. Like he said, he had 18 plants maturing, and the rest were in the cloning phase of their lives. Which means that hes probably doing a small SOG or ScrOG grow, in an attempt to get a lb, maybe a little more, out of each harvest. An lb every 2 months is a realistic personal stash guys. Figure if the rest of the plants were in cloning stage, and he was flowering 18 of them, then it would probably be another 8-12 good weeks before he would harvest the rest of those plants. Maybe he smokes heavy, n a 1/2 to a 1/3 lb a month is reasonable for him...

Just know the situation if your gonna comment on it, thats all im saying. I understand that you all wanna tell this dude what he shoulda done, or how fucked he is, but if he has a lawyer explain basically the same thing to the jury as i just did to all of you, then he could convince a jury beyond a reasonable doubt that every single nug being grown in his dro setup was for personal useage. Thats one of the reasons why a Marijuana lawyer, and not some random Civil Servant is the ideal way to go in a situation like this. Because a normal lawyer wouldnt be able to tell you shit like the average yield per grow of a particular strain, or potential yield because of grams produced per watt of electricity he used. Being able to explain shit like that, which even a prosecutor wouldnt be able to do, is what would convince a jury of your side of the story, as opposed to the gov't 's side, which would result in you getting cornholed.

My own personal advice for the future -- If your going to grow cannabis, youneed to make sure you know the laws, and what might happen to you if you should ever get caught. If you feel that the pros outweigh the cons, then by all means do it. But make DAMN sure that you know what your getting yourself into before you set up that resevoir again. All you have to do to avoid the trouble is to stay within the reasonable parameters of the law man. Theyre showin us a TEENY bit of leway, so try to abide guys. Shits starting to get better, and over the next couple years its gonna improve even more, trust me. So why dont we all try playin by the rules for a little bit. Grow a Qp instead of an Lb. Its the difference between a minor misdemeaner and not going to jail, and a Felony, which could land you in jail for a minimum of 5 years in some cases, which also carries a fuckin hefty ass fine too. Second, stash the shit out of your cash too. Dont use banks, and dont put it ANYWHERE that any other human would look. Thats a whole nother rant though, lol.

I'm much more into the coke scene but I smoked weed once in a while back in da day. Anyway, about 6 years ago I was driving down some tumblefuck road in good ol' Georgia when a state trooper pulled me over for speeding. Guess going over 5mph made me a danger to society. This pig comes up to my window and says, "show me your license, registration and any drugs you have". I said "I never use drugs" LOL. He says I must use drugs cuz I'm "a Yankee speeding thru rural Georgia", and that I must be fucked up in the head from something. He said "either you're retarded or on drugs". I begged him not to bust me, as I had a previous possession conviction two years back for an eight-ball that I got caught with after I got into a bar fight and the cops came in and busted everybody's heads up.

....ok, back to Georgia. I told him I got no drugs on me. All of a sudden he says, "Son, I don't like your tone of voice--that's verbal assault--which is a $100 fine in these parts". I said WTF!!!???? Then he starts yelling, "STOP RESISTING!! STOP RESISTING!!" as he maced me and dragged me out of the car thru the open window like I was living thru an episode of the Dukes of Hazzard. The pig then repeatedly stopped on my spine and nuts until I cried for mercy. Then he says, "I'll show you mercy!!", and slams his flashlight into my mouth. Most of my teeth fell out of my mouth. As I picked up the broken pieces of my teeth out of a pool of my own blood, the pig says, "Wait a minute, I know how u can get out of your $100 fine. I haven't had a toothless blowjob in years". So I sucked him hard until he was as dry as the Sahara desert.

I'm lucky I'm still alive, but I feel like less of a man after having to perform oral sex on a cop.

first off,
always insist on the warrant. he can only hold you for one hour without one in most states, otherwise it is kidnapping.
secondly, never deal with pigs. sounds like you pissed off a cop, or someone that was very familiar with the complaint process.

Get a good lawyer I know someone that got a misdemeanor for 109 plants, obviously got a couple of things taken for him and because of the scumbags irs has fines up the ass but thats it. I am all for making bud legal. Hell Yeah! I have done other drugs in the past and done some fucked up things while up on them. I am a responsible smoker and don't drive while high, or getting high for that matter! Think about how much better it would be if pot was legalized. I would much rather smoke a joint or warm up one of my pipes than head to the bar. I dunno about you guys, but I have never seen a person who was high on bud shoot up a schoolyard full of kids. Seen methheads do it once. Scarey shit. If pot is legalized, it would be cheaper, better, and a safer alternative to pills, crank, coke, alcohol, shrooms, dust, etc. I think it is bullshit that "those that be" are so down on pot smokin. Bust some of the sick fuckers that sell meth and shit like that to lil school kids. I hope to be a voice in power about the legalization of pot someday. rule number one: no warent = police can go fuck themselfs. dont even open the door, talk through the door. DO NOT OPEN THE DOOR! ask if they have a warent, if not thats where the conversation ends. just walk away from the door. they cant do anything without a warent. if they start breaking down the door record it on your cell phone then hide your phone after they break it down so they cant erase it. youll get off every time from the illegal search.

I just got hit mon. at 6:00 pm 15 plants 1 pipe. I opened the door to 10 cops with m16s and a paper in hand I thout was a warrant but was a seized property receipt.(good trick.) I was arrested and read my rights. at the door.then they said a informer terned me in.the informer was the guy who gave me the plants. so he could turn me in to get off on another charge. DON'T TRUST ANYONE!! guess I'm done smoking .

Your biggest mistake was talking to the police. What you say will be misquoted and used against you. If they could have gotten a warrant, they would have had one. Next time, just shut up and make them do their job. I was arrested with 290 plants and charged with manufacturing and possession. 2 rooms were a week away from harvest. They weighed the dirt as well, almost reaching 25 pounds and a mandatory 3 year sentence. I hired an exDA and went through a PTI program. Eventually the charges were dropped. In my case, someone with military boots broke into the house through a window and placed a light on the ground. No warrant is needed in the case of a fire. Dried weed in the closet was not stolen. The cops came to my living house 2 weeks later, questioned me, and arrested me. They lied about what I said, my family said, and what my neighbors said to make the arrest. I only knew about what was going on but they made it seem like I ran the biggest operation. The biggest threat to the grower is not honest cops. As for the erroneous charges of selling, remember they can charge you with anything. They have to prove it in a court of law. It is a negotiating tactic. The tenant's deal was 3 years in jail because of previous charges. He waited until trial and accepted 1 year probation for possession.

to the anonymous dude who posted the website saying pot is legal in canada, try doing some reading up for yourself. Pot is NOT legal in canada. When the Liberal government was in power (years and years ago it seems), there was a bill put forth regarding the DECRIMINILIZATION of pot in canada, stating that you would be subject to only a fine for possession of 14 grams or less. However, when the conservatives under Steven Harper were voted in, that bill got shuffled to a back burner, and as of yet has not even seen the house of commons. Hence what should be everyone's REAL number one rule, DON'T BELIEVE EVERYTHIGN YOU HEAR. Do some research for yourself. You can find the entire criminal code for your municipality, state/province, and country online. DO IT. Don't just take some skeevy stoner's word for it!

As for your plight, buddy, i feel for you. Paying "street price" for weed, for some, is not a viable option. I personally use pot for chronic pain due to a motorcycle accident i had a few years back, and can't afford 200 bucks an ounce. I can only imagine what some of you must feel paying 3, 4, 500 bucks an ounce in some states :S While you were tricked by the cops, you DID agree to the search.....this has been said before. The only thing you can do now is wait, hope, and pray that your lawyer can help you swing a deal. Good luck, man...give those kids a big hug :)

I went threw some shit to where you get scared and think "omg its the cops i must obey the law" but that search warrent thing sucks its legal thats why cops are so dirty and people are really getting ruined from it just to smoke some buds...

my advice that i took and helped me out is if you arent satisified with your lawyer try to find an ex DA they usually can cut amazing deals because they sometimes have worked wit the dirty cops who busted you. So work on that and good luck and keep growing for yourself fuck the police.

To all of you people who think this is a lie go to the Times Herald.com It is a Port Huron news paper it was a cover story with a photo I beleve that the date of the paper was Oct.30 or around there 2'nd of all most of the weight they got out of my home was leaf and stem that I could not get rid of yet the reason I was growing so much was so I could grow enough for a good amount of time so I could stop until I started to run low witch would be at least a year or more becayse my wife did not like me growing all the time. 3'rd for you stupid fucks who cant seem to read the kid's had no way of getting to my set up the door's were locked plus my kids are 4 & 1 I'm pritty sure they were not showing it off to their friends. I live in Southeast Missouri and if i were caught with almost 70 plants i would do prison time with no doubt abot it. But i agree with Adrain Medina Dont take the first deal they offer u. I would keep putting if off. In Missouri the more u continue ur courtdate the better off u will be in the end of all of it. Ull more than likely be hit with the manufacturing and distribution cause 10lbs. is alot to have for just smokin on. Fight ur ass of in court and ull might get off easier than u think. Unfortunately you gave consent to the search, so everything found, can and will, be used against you. Do not believe what these people are telling you regarding this being an illegal search. It was a typical cop tactic to intimidate you because you were unfamiliar with the "babysitting law" which states the police cannot "babysit" you while they attempt to secure a warrant. Your best bet now is to contact a good lawyer who has hands on experience with Marijana Law. Michigan has no mandatory minimum jail sentance for cultivation. The maximum fine is $2000. (for any number of plants) and the max. jail sentance is 4 years. If your Lawyer can prove you are a contributing member of society w/ no prior cultivation convictions, you will most likely have to pay a fine w/ a max 30day jail sentence. When this is all over with, I suggest you buy and Read Ed Rosenthal's book DON'T GET BUSTED, and if you wish to continue growing in Michigan you should look into moving to the city of Ann Arbor MI which has decriminilized marijuana laws to the point of a petty civil violation with fine of $50. Hope this helped. BTW. Your wife will be fine, the police report will show that she had no access to the basement so your lawyer will be able to prove she had no idea about what was going on down there. She cannot be charged if you accept the responsibility and your lawyer has half a brain.

My advised to you is if they offer you a deal dont take the first or second deal go to trial and fight it. I got out of a similar charge,only diffrence was i got carying a weapons charge, and i was looking at 2-5 years in prison. So i worried my head of the next 11 months, it was one of the worst times i had in my life, after pre-trial conference's and depositions, i walked clean with a lesser charge, to criminal misofte, and got a huge fine dought of 980.00 My point is, when they offer you a deal it normaly means they have broken a law somehow and until you show that evidence in court. One week before our trial date my lawyer advised me that i would probly get found guilty in court, I said, no im going to trial! two days later he called me saying the charges were dismissed. Now, if I would taken the deal of only 1 year in prison, i wouldnt be here stoned out of my ass giving you advised, i've been charged through my life with 7 felony's and only been found quilty of one of then, and that was back in 2001, since then ive' got 6 felonys droped due to lack of evidence!! Follow your instinct and pray, praying is the only way to find comfort , take it from this person who is thankfull for what the outcome has been. Thanx to praying

I am not sure about the laws in Mich.,here in Ca. I have seen plenty of people take a deferred judgement plea for these types of cases. If the police had no probable cause to search your home and you were not on any type of parole or searchable probation your case could be dismissed. On the otherhand if you signed a consent to let then in you home, all the evidence could be used against you. Only if the consent form was signed by you prior to the search. I work at public service law firm and I see this everyday, I think that you need a good attorney that knows how to work the DA and they will probably cut you a good deal, if you have no priors. Your wifes case will probably be dismissed if you take a plea.

the search was legal. they said they could detain you while they waited for a warrant but that isnt true... they fooled you. Thats called unlawful imprisonment, they need to wait outside while waiting for a warrant. but since u didnt know your rights they got you fair and square if they are assholes about it youll go to jail and risk losing your kids. vote for barak obama and maybe this wont happen to others like yourself.

my suggestion is that you hire a good lawyer. My brother got caught and got 5 years first offence off of like 120lbs. But he wasnt the type to deal wih a D.a. Regardless you will do at least some jail, and in you state if your lucky maybe probation. GL.

If I were you, I would contact the National Organization for the Reformation of Marijunana Laws and seek legal advice through their approved attorney list. I'm not sure if attorneys where you live would be qualified to help you with this case.

Ok, I just said a prayer for you and your family. If anything this will be a costly bump (jail time, attorney fees, etc.) in your life's journey. Hopefully you have close relatives that can look after your kids.

Attention to everyone else. Were you scared when you read this guy's entry? The fact is that marijuana is still illegal in this country and the courts definately prosecute grow operations. Given that, it makes more sense to buy and let someone else take the risk of growing. If you can't afford your current habit, either cut down your smoking or get off your ass and make more money. Oftentimes, people grow pot out of curiosity and the thought that they'll cultivate several ounces for personal use. Most of the time people get away with it, but the consequences are big and affect not only you but your family members. Don't be selfish!

Since your bust yielded over 4 kilos, this case will most likely be pulled into federal court. As you probably know, the feds have mandatory minimum sentences. It will probably takes several years and thousands of dollars in attorney fees moving through the court system but the reality is that both you and your wife are probably looking at a 20 year prison term, with no opportunity for good behavior credits.

Also, the courts will be evaluating whether any relatives are "fit" to take care of your children. In alot of cases, the courts do not find relatives "fit" and place the children in foster care. The good thing is that they normally do not separate the children, unless a family only wants to take care of one of the kids.

Dude, you did EVERYTHING wrong. I agree with the guy below me, dont answer the door in the first place, by law you dont have to answer the door. You consented to the search, you busted yourself. You should have had them hold you until they aquired a search warrant, they couldnt hold you and your wife, so she could have ditched the stuff while you waited in jail. Then no charges would have been filed and youd still be growing with no worries.
As for how much time your doing... I bet youll do a good 10 years.
Ive been raided by the Green Team in Tampa Florida TWICE for distribution and manufacturing, but I always had a back out plan, so every time ive been raided they couldnt charge me with anything cuz I played my cards kewl. But hey, good luck. And remember, just because this is your first offence, doesnt mean they wont be hard on you. We live in AMERICA, where we have more people in prison then all other Communist countries. They dont give a shit if your a good person, or if its your first time. You were breaking the law, you will get a mandatory 10years, youll serve 8, and have 2-5 years probabtion.
My advice to you is, leave the country, skip the trial, Canada will santion all non-violent offenders.

Ok , first off , they will always charge you with the maximum knowing that at best they might be able to convict on a minimum . Get yourself a lawyer as you certainly sound like you need one .
