Reality Check – The Long Road to Legalization

 

Reform advocates are excited about the progress of medical marijuana – and there’s good reason for this enthusiasm. The Obama Administration has adopted a hands-off policy regarding state level reforms. Colorado has joined California in allowing over-the-counter access to medical marijuana in storefront dispensaries. Congress appears ready to finally allow a decade old medical marijuana initiative passed by the voters of the District of Columbia to take effect as a matter of home rule for the capital city’s residents. Along with the passage of a medical marijuana initiative in Michigan and of decriminalization of possession of an ounce of marijuana in Massachusetts in the last election, these developments are the source of great optimism in the reform movement.

 

While these accomplishments are good news, especially for patients that benefit from medical marijuana, efforts to legalize marijuana still face numerous and difficult challenges, especially if recent events contribute to over-confidence on the part of activists and supporters. This is the time to work hard, not to celebrate. These events represent opportunities, not guarantees of victory. Reform may have inertia, but momentum alone will not bring about lasting change across the country.

 

First of all, medical marijuana will not necessarily bring about legalization of marijuana for everyone who wishes to use it. As medical marijuana gains in popularity, state lawmakers are likely to enact strict restrictions on access and availability. The burning question is whether marijuana will be medicine like aspirin, medicine like tranquilizers, or medicine like Oxycontin. It could end up with few controls, some controls, or very strict controls with extremely limited access. Indeed the more medical marijuana is made available to individuals without what are viewed by the public as severe medical conditions the more likely access will be restricted,

 

Nor will the acceptance of medical marijuana in some states lead to availability in all states. It’s progress for residents of some states to have access to medical marijuana, but it’s justice for residents of all states to have such access. We need nationwide reform, and this includes nationwide access to medical marijuana. This requires increased political activity in every state, and it will eventually require political action at the federal level.

 

When the euphoria of recent developments clears, the situation for many marijuana users throughout the country remains bleak.

 

Many states retain severe penalties for marijuana possession, especially for amounts over one ounce. A recent report in the Bulletin of Cannabis Reform includes a review of marijuana laws throughout the United States. Possession of two ounces of marijuana is punishable by a sentence of a year or more in 36 states. Possession of four ounces is punishable by a sentence of a year or more in 39 states. In 19 states the maximum sentence for possession of one ounce of marijuana is one year. In Florida possession of two ounces of marijuana can result in a sentence of five years, in Arkansas it can result in a sentence of 10 years. Even in Oregon, with medical marijuana laws and decriminalization of small amounts of marijuana, possession of two to four ounces can result in a sentence of 10 years.

 

According to the latest surveys there are 1.4 million annual marijuana users in Florida. There are 234,000 annual marijuana users in Arkansas. They can’t all move to California or Colorado. In Missouri, where possession of two ounces of marijuana could result in a sentence of seven years, there are 481,000 annual users. They can’t all move west either.

 

In practice, while such severe penalties are possible, most states treat marijuana possession cases leniently. Marijuana possession often results in a fine, probation, and/or a short jail term. Often people arrested for marijuana possession are referred to drug treatment programs as an alternative to serving jail sentences. In Florida, for example, 64% of the marijuana related admissions to drug treatment programs were referred by the criminal justice system. In Arkansas, 74% of marijuana related admissions to drug treatment programs are similarly referred. 

 

The reality of marijuana laws in the United States remains a bleak situation. In most states marijuana users face harsh laws with little hope of reform. In most states people arrested for marijuana possession are at the mercy of the criminal justice system. They face the possibility of lengthy jail sentences, expensive legal bills, and unnecessary and potentially costly drug treatment services. Decriminalization of possession of small amounts of marijuana, lenient sentencing policies, medical marijuana protections, and even media discussion of marijuana’s legalization obscure this unpleasant, uncomfortable, and unacceptable reality.

 

Nonetheless, there has been progress. It’s a result of citizen involvement. It’s a result of increased activism on the part of organizations and individuals. And, coincidently, these advances are also a result of novel and innovative efforts over the last few years such as The 420 Campaign. Recent developments do provide signs of hope that greater reforms are possible, and that legalization, despite the challenges, can occur. Participate in The 420 Campaign, support reform organizations, and get involved in the legalization movement. Progress provides opportunities. Take advantage of them and help provide justice for marijuana users in all parts of the United States.

Funny how people have only come to realize this now.

There are already so many activists doing their part, but for the most part itīs an uncoordinated effort.

This is the time to get organized and coordinate, not just at a national level but rather at a global level.

As much as I would LOVE the legalization of weed, recently when it was on the ballad in California to legalize it, it was mentioned legalizing it would require it being government run. Almost like a liquor store. There would be certain hours and days it'd be open, and an eighth would be $70. I don't want to pay that kind of money for an eighth when I'm smoking over a quarter ounce a day! and aside from that, growing outside of what government permits would be a sentence of 5 years in jail. (And I can't entirely remember, but I think it said somewhere that any growing would be considered outside of government permit.) If it's already a slap on the wrist over there, and under an ounce is only a $100 trafficing ticket- if your caught -then why bother trading the current restrictions for other restrictions that may leave things worse off than they already are? And they almost passed that, too.

We need to protest in washington. this whole gathering around a local courthouse is just a waste of effort. we need to take it to the big dogs in DC if we are to accomplish anything. and more importantly we all need to group together in massive amounts. every person counts. my wife has cancer we had some weed in our house and somebody i thought was my friend was trying to break my furinture. so i told him to stop when i turned around he hit me and started to kick me in the head. on his way out he started hiting everybody elses houses and then the cops came. searched the house on a domestic vilionce case. found part of the weed. then they took me and my roomate (which it happened to be his brother)to jail. then they came back at 1:30 in the morning banging on the door then they told my wife they had a search warrent and told her to sign this she couldnt see it without her glasses and they wouldnt let her get them when she signed which i know is stupied but she has never been in trouble for anything ever then they found 6oz. slaped her whith a feloney they had know reason to come back and they also didnt read her rights they were just thrilled that they got that bust thats we got kicked out of our house to thats why im devoting my life to changing the system because it is a hyprocisy. who are they to be so cruel espeaily to someone who has cancer they wouldnt want that to be their wife. anyways if anybody likes my stories and or ideas e mail me at crayzjay44@yahoo.com

make a donation what they can do is invest the money for 6 months then give the money back to the donor. use the profit for lawers and media to hammer the politicians. because we all know that petitions and calling the reps. dont work they just ignore us. they only do something when the public cry is so loud mixed in with bad economics. then they do something about it. make it so the people can see it on tv maybe get some interviews on the reps. take polls on it and ask them on tv or radioe. why dont they just let us vote on it if it is so contraversail. it is time to do something different cause what we are doing now just isnt working.

we need to put more pressure on the goverment. i was wachting something on u tube obama took a online poll of the top 10 questions. weed was no.1. he just shurgged it off saying that he wouldnt inforce it if it wasnt going to inforce it if it was for medical use. then he cracked a joke and all of his piad suporters laughed. he didnt even answer the question. the question was if he was going to leaglize it. all politicians do that. i have a group on commonsenseparty@yahoo.com that is contributed to putting preasure on the goverment check it out.

I wish they would get off there high horse and leaglize it. But the gov. uses it to much as a tool to keep the people they deem undesirable down. I know doctors, lawyers , business owners very rich people that smoke at home and you would never know. My boss hates that i smoke but im so good at my job he doesnt give me shit about it. i went to a long time friend of his that is a lawyer. i was bidding on some work when i noticed about 5 new starter plants . I said nothing . But he knew i knew. Come on are we really so high and mighty as country that we can even judge for ourselves that weed doesnt hurt anyone but the ignorant.

Why do they still have the war on drugs?It is a total waste of money! Marijuana is a commodity like any other commodity, as long there is a market(demand)their will be sellers and lets face it the demand is not going anywhere's.
We all have one life to live and i'm going to live before I die.
Marijuana is safer than tobacco,alchol and abortion.
So why is it a crime to enjoy your time off doing something that hurts no one?
Last weekend at a local night club,Two men got into a fight one stabed the other killing him and he got out two days later on a fifty thousand dollar bond.
Why don't the police go after real crime? It should be illegal for employers to piss test.

We should have life without all this descrimantion we truely are the victoms having to go through all kinds of BS. When others get away with Murder!!!!!!!!!!!!!!!!!!!!!!!!

Seriously, the odds of us getting weed legalized in one day are small. We need a sit in type of thing, and get the entire nation looking at us to how how cruel the government really is and how peaceful pot is. and unfortunately 420 is on a tuesday, and many smokers with jobs cant go or take off. and us smokers in school can't come either. we need a big rally on a weekend chillax and blaze up in dc

If you look at over the counter drugs tylonol advil robatussin etc... with taking to much i can or will DIE. i still to this day have NEVER heard read seen a news commentary on anyone overdosing on marijuana. We need to all spread the word and get it legalized for all to enjoy. Native Americans were smoking it before we even knew anything about anything. LEGALIZE IT

The best way for us to spread the word is to spread the weed. On 4/20/10 join me in Project Overgrow and get out and plant 5 seeds outside-in a park, the side of a field, by a body of water, on a farm, by a police station(watch out for the cameras). Anyway are you getting the message? The more weed there is growing the more people will be inclined to use it. The government has created a bad climate with their lies. Its up to us to forge ahead and promote free growth-lets go!

they way the world looks a weed now is pointless it has been scientificly proven that weed is less likly to cause any kind of medical issues also weed has been proven to be far less addictive them ciggarettes. alcohol on the other hand has caused more deaths then most other leagal substances i mean come on why would they leagalize it for medical use also why would god have created it thall shall not detroy the human temple (your body) man made beer god made bud whats worse eventhough weed has been decriminalized in most states why not just get it over with leagalize weed for christs sake switzerland leaglized herion use in a program form but WTF the USA cant legalize weed how much can weed really hurt us or the economy really i think weed would be a extreme boost for the economy if controlled with taxes and permits to sell as long as the goverment has a semi strict controll on it everything should be fine

It seems like marijuana organizations could become more organized. Norml, Hightimes, Skunk, and all the other pro affiliates who can reach out, could come together to organize more events, protests, and smoke outs. I'm not a subscriber to High Times, but check the site and mags frequently, and cannot recall in organized protests High Times has organized. Some organized state capitol smoke outs on 4/20/10 would be a start. I would be down if it came to organized masses.

Then lets start this April 20th, 2010. Smoke outs just like in Denver in every state, if there is that many in each state at least 10,000 can gather in the capitals and do this in the peaceful, carefree way it should be!
