Busted Letter #103 – The Court of Diminishing Rights

One day after work I went home and ten minutes later the Drug Task Force and the DEA knocked down both my doors. They had a no-knock search warrant and when I asked to see it, they refused to show it to me.

They used my light bill and the fact that I had two windows in my basement boarded up (one of the boarded windows had a dryer fan attached to my dryer and the other had a black hose coming out which was hooked up to a sump pump in case water got deep on the basement floor) for probable cause to get the search warrant. They claimed the drugs could be easily destroyed which is why they needed a no-knock warrant.

They found plants growing in my basement.

We had a good case in Federal Court until Supreme Court Justices Roberts and Alito were appointed by Bush. They ruled in the case, Hudson v Michigan, a 5 to 4 decision, that even if your rights were violated in a search the evidence found can still be used against you. The Court said you would have to sue the police if they violated your rights. To think these two justices will be there for another thirty years! What jury is going to award you anything when they see the police in uniform on the stand? Now I'm looking at five years in federal prison.

Well I"m the one the wrote the above busted letter and guess what. Last week the same DEA and Drug Task force raided my house AGAIN and broke my door down and tore my house apart again and I wasn't home. I was on my way home from my mothers and the Sheriff pulled me over and said I need to go home because they had a Search Warrant and they where already there tearing my house apart. They had a drug dog and between 12 to 15 Police and DEA Agents and searched for over 3 hours and DID NOT FIND ANYTHING. I am waiting to get sentence in Federal Court and they are PISS OFF because I am facing 15 to 21 months instead of 10 to 20 years. My Attorney and Myself got the number of plants from over 250 which they said I had down to 63 plants by using a Botany Professor. A plant is NOT a Plant unless it has ROOTS and only 63 had ROOTS.

First off I want to give you a 'sorry' because whoever your lawyer was did a very shitty job. The 'no-knock' policy only comes into effect when it's an EMERGENCY situation; when the warrant that HAS been issued, the suspect posses a threat to the police. At that point in time the police CAN and WILL enter your house without your consent. Other then that for a state that seems to be one of the more liberal ones on our beloved Cannabis Sativa, nonviolent crimes are overflowing the prison-system. All i can say, as an up-and-coming Criminal Justice MJ, is know your rights, and know the loopholes in the system. Don't try to beat it, Learn it.

A friend of mine actually put a large flowering pot in a tree to avoid deer, hunters and sky cops. Did some pretty good camo techniques with it

Growing in places close to the roads can be a huge advantage.
People don't hunt close to the roads,they go deeper in the woods.say like off of a back road. Go about 50 yards in deep and plant.
Even if plant is close to road it is still possiable to conceal it.
It's not being looked for close to the road and once knowed a guy that growed one that could actually be seen from the road,if you knew it was there.

I wouldn't grow in my tomatoes though.That is your's if you are caught.I was a door to door salesman for years and I litteraly walk around neighborhoods and knock doors. alot of time I would get a bite and have a demenstation at the peoples home.I HAVE SEEN REFER GROWING AT MANY PEOPLES HOUSES OUT SIDE IN THEIR OTHER FLOWERS.Now if I can spot it,so can the power man,gas man,cable man.....

I walked out of this one house one time to retrieve someting from the car.On my way back in going up the steps there sat a plant as tall as I was,I pulled it over to smell and yes it was Marijauna.Strange thing is I did not see the first time I walked in.

I have always heard it was how many plants you have...
They count every plant as a pounder,even if it is a seedling.

I have also heard of people putting a couple of cut up diapers or a large sponge at the very bottom of the hole. This is so the plant will have a water source in time of droughts.

The diapers or sponge will be deep enough in the hole that the plant will still have good drainage,but can pull from it's tap root the water from the diaper or sponge in time of drought.

Everybody should grow out side.Not only is it safer,but the yield is so much higher.

One female plant outdoors should yeild no less than 1 pound of seedless weed.

Two plants a year man...

who would risk getting caught with a room full of short plants that don't produce alot of yeild. Not to mention if your caught (it's yours)

If outside the cops would actually have to catch you at the plant to say it was yours.

They can't spot just one big plant.If you grow small fields they may see them from the air. But not if you have just one plant.

Plant one and go 50 to 100 yards away and plant another.

Dig up the earth where you plant and place in 5 gallon bucket to be hauled away(yes you will have to carry the dirt with you.dump dirt a ways from the plant it self.Be sure hole is 16 in wide and 3 ft deep.
2)stuff a 2'x2' piece of plastic down in the hole(this will allow plant to drain properly,but will hold moisture in the soil where tap root can reach.
3)place one shelvel full of rabbit,chicken or horse manure in bottom of hole.
4)fill the hole the rest of the way with a very light weight soil medium(jiffy mix or ready earth are perfect)
5)Place clone of female in hole. (if you don't have acess to a clone you may want to plant 8 to 10 spots like the one mention above with seeds.Using seeds will often result in more than half being male.Be sure to have only one plant in each hole.
6) ENJOY!!!!!

Sadly, my sister-in-law and her husband recently lost their 2 year old daughter to a house fire. During the investigation of the fire, they found that they had approx. 18 plants growing in the attic. These plants did not have anything to do with the fire (it was acutally a cigarette left outside in an ashtray that ignited their old dry porch). Now, not only have they lost one child, but they are now in the process of loosing their 4 year old son due to the drug charges they face. I'm sick and effin' tired of hearing about all the people going to jail and facing charges for marijuana, especially when it's people like them who work their 9-5 job and are generally normal, good people. What's ironic with the situation is that my sister-in-laws dad spent years in prison for a marijuana bust years ago and while he was in prison serving a sentance for prison, his kids (one of his son' is my kids dad) were sent to live w/ their mom and step-dad and had to face abuse, molestation, and shitty living conditions. Now, after they went through that, it's not surprising that my kids dad grew up an alcholic and is in prison now, And my sister-in-law was doing well for herself, just getting married and buying the house that burnt down. It's so frustrating to me that the government doesn't look at the after effects of punishing people for marijuana. They're just pissed that, like all natural herbs, marijuana cannot be patented. Therefore they cannot have a monopoly and fully benefit from the legalization. So many people SOOOOOO many, feel the same as me. But you'd think living in a "free country" we could get this legalization movement to move on a little quicker. But to me, our "freedom" is more of an illusion. WHAT DOES IT TAKE TO GET HEARD IN THIS DAMN COUNTRY?!?!?

You know I would never want to go to prison for anything.

But,I must say that I know alot of people who have been in prison and there are some rapes and alot of fights.

But it is mostly in the prisons that house the youngest most violent criminals.

Most of the people that go to prison say that it ain't that bad and alot of them have said they even like it in prison.

You also can make some great connections and learn how to be a real criminal.

I live in a small town of 600 and what a surprise it was to see 3 state cops, 2 local cops, and 1 DEA agent pushing their way through my door with warrants in hand acting like the Gestapo. The 1st. warrant said that I had an unusually high spike in electric usage and in the pig's 30 yrs.experience that could only mean 1 thing... grow-op. He got a judge to authorize another warrant to do a flyover in a National Guard chopper using an infra-red gizzmo that detected heat from the roof of my 2 story house.The 12 plants in the basement plus clones in a different closet totaled 142 plants according to their figures. They claim ANYTHING with a rootball or tap root is a plant and it gets counted as if it were mature and would be a viable commodity someday. They didn't arrest me, read charges against me, or Mirandanize me. Just scooped up the stash and cash and said I was looking at a dime minimum Federal. BUT, if I would give him 3 names of bigger fishes well then he could get this taken care of in no time.. minus the $$ of course. I just laughed in his scum sucking face got up and took a double shot of Jack outta the freezer while he watched. He was a joke, but this is what it's come to.Barney Fife making billions off of it's tax paying,freedom fighting citizens.I won't go down without a fight!! Praise the Lord and pass the ammunition.

exactly 1969. I believe a vast majority of grow room busts (at least here in the states) are because of word of mouth. Growing massive amounts of pot just isn't safe in the first place..

I don't really pity drug dealers when they get busted, because prohibition is helping them turn a profit. Do you think drug lords running smuggling ops want drugs, or even just pot, legal? hell no they don't! how are they gonna make a profit if you can walk down to a coffee shop or even your backyard and smoke it yourself?

An easy solution is under federal law...The RFRA to be exact. Temple 420 of Hollywood has a legal program based on federal Supreme Court rulings that have allowed the use of herbal sacraments more powerful than marijuana. I have actively campaigned, and announced the church program, my growroom, and dispensed sacramental herb to a church member in the presence of a Police officer. For the purposes of Religion, Marijuana is not a drug...it's a right.

Bush was quoted as stting in a press conference the other day in Vietnam, " I support the right of all people to practice their religion as they see fit.

Marijuana has been used discretely in many religions, including Christianity. For those interested in Scripture, reference Genesis 1:11, and Revelations 22:2. Our Church believes that this is the tree of life to bring healing to all of God's Nations ( Try and find a Political, Racial, or Religious fight at a Hempfest!)

I understand the concern, high power is no reason. I run my laundry and microwave all day along with my computer and draw an easy 1000watt most of the day. If you grow, the problem you have is who you know. Period!
Rewired homes to bypass the meter is a sure bust too. Outdoor crops are a bust! Anyone who comes to your home is a bust! Selling and profit off it is a bust! Medical use for seriously ill people is legal in some places and encourage you to move to a cannabis friendly zone. If you are a marijuana user and have no medical illness and feel you might get away with growing a few plants to save some cash. The law will target you; same as if you obtained illegal pills and where using them without a reason. The law is colour blind when it comes to the substance you use. The point of the laws are to prevent abuse , ill profits, endangering children, and the possiable destruction of others, so we as humans must be aware of why. If you use Marijuana to escape reality you may want to work more on personal development. If you need it because you feel ill without it, please go to a doctor and explain your symptoms, you may have a real mental of physical problem. Adding jail time to a possiable medical condition is unwise and you will not get the medical treatment you need in jail and with no history will have a hard time convincing anyone to understand your position. Hope this has helped tto bridge the gap between law enforcement and the peoples view on compassion for the sick.

The only reason this sucks is because the criminal's (and yes, this guy is a criminal) constituetional rights were violated. This guy got busted not only with plants, but with firearms and cocaine as well. It sucks his civil rights were violated, but maby he should have been doing something with his life other then ruining others (the coke, not the bud).

Does anyone know what the average home uses per day in kilo-watt hours?
I have been reading around and have found ranges from 750 to 1000 per month on average. This is for a well insulated energy efficent home.

These people that got busted probably had like 1500 to 2000 per month useage.

But even this alone should not have been enough for a search warrant.

Cause the power companies tell you on thier sites that people can have high useage for many reasons.Including a not properly serviced ac,drafts and poor insulation and the list goes on.

I'LL bet these people either told someone or sold and got RATTED.Something alerted the police and it had to be pretty sure thing for the judge to issue a warrent.

Its me....When you are caught growing POT,over 100 plants, every plant counts as a KILO (2.2 pounds). I had 708 Plants. 240 were about 2 inches high, Dried about an ounce. 240 were about 8 inches high, dried about 2 pounds. The rest were about 18 inches high, about 8 pounds dried. O yes and about 5 mother plants, dried about a half pound. Total about 10 pounds. However 708 plants equals over 1,500 pounds at sentencing. Now that is a 5 year minimum mandatory. 100 plants is a 5 year mandatory, and you get a ten year mandatory for 1,000 plants. Anywhere in between then you go to the sentencing guidlines for the sentence which will fall between the 5 and 10 year sentence. I had a prior conviction from about 13 years earlier which doubled the sentence to 10 years. 4 years into my sentence at Marianna medium security federal prison I got the 5 years off the sentence because the prior sentence was a misdemenor not a felony. A prior felony being the only way to double the sentence. A DRUG felony. 10 pounds, 5 years. simple. Another guy had been growing seedlings for the continuous harvest method and they caught him with 1600 plants about 6 inches tall. Dried out to about 2 pounds. He did 10 years and was sentence for over 3,000 pounds. But you know all of this. Why all the hate?

Seems like someone has missinturpreted a comment I made. I was being sarcastic. I have put a pocket in underwear for Stashers. It is true that 99% of Federal Cases are Plead out, mine included. But don't tell me about snitches. In that 5 years I met a thousand drug incarcerated snitches. GOD gave me a way out, they would say. Snitch,Snitch, Snitch. If you have never been in federal prison then don't try to tell other people nothing about it. Your talk is cheap. Let a judge give you 20 or 30 years in prison and see how big your balls are. Just about every single druggie I met was a snitch. Some of them were not snitches when they got there, but after about 3 or 4 years they turned. No don't Snitch. Of course you don't snitch. But the person who goes to federal prison a snitch will be in good company, that was my point. Now if you snitch on someone about drugs or alcohol while in prison you could get killed. Tha't a fact. If you have not been there don't preach. My proudest possesion is a letter from my lawyer which states. "You chose not to cooperate with law enforcement even though I tried to get you to on many occasions, so don't try to say I was ineffective counsel. You had your chance to get time off of your sentence and you refused."

I can see you don't know much about the Law either. In the Hudson case the Probable Cause hearing or the Affidavit never metion that Mr Hudson had guns or was dangerous. In fact they (Police) didn't know what they would find. There was NO reason to Not Knock. This case where reheared, because Justice Alito was appointed. This case WAS argued in front of the Supreme Court. The newest Bush appointees DID play a role in the decision (in fact, Alito cast the deciding vote in a 5-4 decision).

Finally, while the case didn't directly deal with growing pot it did in fact play an important role in diminishing our rights as it allows for evidence found by police who violate the CONSTITUTIONAL knock and announce requirement to be used against you in court.

Translation: ILLEGALLY OBTAINED EVIDENCE CAN BE USED AGAINST YOU IN A COURT OF LAW

Hudson vs Michigan is a real federal case, but is not anything like what is described in this post.

Google is your friend people. Stay off the vape for a few minutes and find the keyboard.

The dude was tried for having weapons and crack (guns and drugs are almost always a federal case from the get go) and convicted. The terms of the no-knock warrant were violated, however the Michigan Supreme Court had previously ruled in People v. Stevens that just because a search was unconstitutional does not mean that the court MUST suppress the evidence found.

The case was never presented in front of the Supreme Court. Neither Bush-appointed justices had anything to do with the case. He wasn't busted for growing, or even for weed.

Get your facts straight before you start getting your panties in a twist.

Whether or not our consititutional rights are being abrogated every day by LEO is a non-issue, it's happening. Hopefully everyone voted so that we can help stop and reverse this trend as responsible adult smoker/growers.

I can see you don't know much about the Law. The United States Supreme Court ruled in Wilson -v- Arkansas and Richard -v- Wisconsin. In these case the Supreme Court ruled a No Knock Search Warrant is justified if they thought evidence was going to be destroyed, but in my case there said I had a grow room. Have you ever tried to flush plants down a toilet? The Supreme Court also said that just because it's a felony drug case does not give them a blanket to get a No Knock Search Warrant. Now June 2006 the NEW Supreme Court rule in Hudson -v- Michigan that even if the Police violated you rights they did not have to suppress the evidence. So no matter what happen in the two prior rulings this new ruling overrides them. Now do you understand jmd. Our rights are gone.

Dont feel to bad. I proved to the court that the police lied over 20 times in the affidavit for a search warrant. This was the clincher. One cop wrote," A confidential informer who was in a place unknown to him was talking to someone only known to him as Phil, Phil admitted that he had a grow opration, that he had a crop every 90 days that he purchased all of his grow equipment through mail order and that Phil even showed him a Bud. This CI has provided information to this affient on many occasions all of which turned out to be true." No date was given when it was supposed to have happened. No description of Phil was given. The CI never showed them where he had been because remember he was in a place unknown to Him. (complete fabrication). The head of the DEA even admitted to me that the warrant was'nt worth The paper it was written on. The judge told my lawyer (their lawyer) that we could question the affient but that we could not claim he lied. The 11th circuit refused to hear my appeal because the district court, which had just denied me, refused to grant me a certificate of appealability. Yes its true. The judge who shoots you down must grant you permission to appeal or the appeals court won't let you appeal. 10 year minimum mandatory. The lesson: There are one of two things that you will receive from a Fderal judge in Federal court. A nice piece of Juicy Fruit gum, or a Hard dick shoved right up your ass. And guess what? A friend harvested this year and only wanted to keep the buds for smoke. He was going to throw away the leaves and I winded up with them.
A 5 quart container packed full of fan leaves.
You can smoke the leaves and get a small buzz if you don't have anything else to smoke.
I was wandering if making hash would be better than smoking just the leaves.

No, I have not had the feds fuck my life up. But even if he had hundreds of plants, that would not be enough without being a major dealer to have the feds use that much man power. It would be a local police bust. The feds wouldn't get there headlines they like kilos of drugs seized, guns, cash. Plus say that part is true the Supreme Court doesn't here that many cases and they pick there case carefully. You have to go thru years of court hearings and appeals thru cirtuit courts before they will even consider your case. Did you read the case you are refering to? He is moving to supress the evidence because he says it was a "no knock" warrant. He says the cops didn't announce themselves but then it says below in the document that the cops announced and waited 3-4 seconds. That sounds like they announced themselves thats whay the judges ruled the way they did. He's just pissed that he didn't have enough time to hide the cocaine and guns from the cops. Shouldn't have had his stuff on the table if he'd kept it in the bathroom he would have had plenty of time to flush. Best bet is a plea bargin or try to get the evidence supressed with a technicality. Cops are always messing up the paper work. Check out the warrant and the judge who signed it.

I Love Amsterdam all of Netherlands to be exact beautifull place....I have many memorys when I think of that place,I have not been there in over 9 years I lived there for a 1 Year period and went back once for a vacation.not going to cup though -no passport no more- I do not care to fly anymore....owell,I will be playing with some more of my own Treats all over again rite about that time.this winter is shapeing up to be a Good one.Ahhhhhh allso I cant help but think something else led the authorities to check electric bill other than boarded up windows ? must have been a huge amount of electric being used.people have hobbys of all sorts these days useing up electric.

This story sounds so made up. You must have one huge basement. There is no way that the cops would get a "no knock" warrant on you and give you a federal case for a basement operation. You were probably dealing something else. And if you had such a great lawyer he would be able to get the case thrown out. Also you have the right to appeal. Your case would have taken YEARS to get heard in the supreme court. Just because Bush appointed 2 judges doesnt affect your case at the other federal courts. Because all Bush's other nominees were blocked by the Democrats. You did your research but this story is crap and nothing but a made up story to bash President Bush.
