Schapelle Corby: Judge Refuses to Hear Baggage Claims

Revelations about the involvement of Sydney Airport baggage handlers in drug smuggling will have no bearing on the verdict in Schapelle Corby's case, which is to be delivered a fortnight from today, the chief judge has ruled.

On the last hearing day in the case against the Queensland woman, Judge Linton Sirait rejected attempts by Corby's lawyers for the court to consider as evidence information from Australian police detailing how Qantas baggage handlers had been paid $300,000 to help smuggle cocaine into Sydney.

Erwin Siregar told the court there was "involvement of baggage handlers" in smuggling in Sydney and that "it's not impossible that someone put something in Corby's bag".

Corby has maintained that someone placed a 4.1 kilogram sack of marijuana inside her boogie-board bag sometime after she checked it into Brisbane Airport where she boarded a plane to Denpasar, via Sydney.

Judge Sirait said Corby's lawyers could write to him about the latest disclosures, but it was too late to call witnesses. He gave little hope any such letter would have any influence on the verdict.

"We only examine events that take place within the Denpasar jurisdiction," he said.

The main prosecutor, Ida Bagus Wiswantanu, said after the proceedings the judges could not consider evidence provided "outside the sitting of the court".

In a further rebuff for Corby's lawyers, Judge Sirait rejected their attempt to play a recording of a television interview during which the head of the Bali drug squad, Colonel Bambang Sugiarto, talked about how airport officials had contaminated the marijuana bags, making it impossible to fingerprint them properly.

He allowed the lawyers to write a summary of the interview but said "it's not necessary for us to listen or see the pictures".

Corby's main lawyer, Lily Lubis, said after the hearing she was "disappointed" with the judge's ruling. She had wanted the judges to watch the program which includes footage taken with a hidden camera showing baggage handlers rifling through luggage.

Despite the setbacks, Corby remained calmer than she has been and did not break down as her three lawyers took turns reading their final appeal to the court.

Their major point was that Corby did not own the marijuana. Their evidence for this was provided largely by Corby's travelling companions, Alyth McComb and Katrina Richards and stepbrother James Kisina, who all said her boogie board bag contained only the bodyboard and a pair of flippers when checked in at Brisbane.

Corby's mother, Rosleigh, flew from Queensland for the hearing, determined she would not go home without her daughter. "She's not going to get sentenced . . . if the verdict is on the 26th, then hopefully she will be flying home on the 27th," she said.

Ummm...I know it's all pretty shocking seeing a young 28yr old beauty student getting arrested and sentenced to 20yrs, but does anyone actually bother to stop and think about 3 Australians that have been sentenced to death in Vietnam and Singapore???? and not to mention the 16yr old Australian that has been sentenced to 13yrs jail in Cambodia and an Australian 15yr old boy and 17yr old girl arrested in Hong Kong all of them on exactly the same charge as Schapelle. All of them were found red-handed, but then again so was Schapelle. And there is nothing to prove she didn't do it. I think everyone needs to wake up and and stop acting so immature and realise that there are other Australian citizens out there that need our compassion and support that are being sentenced in other countries with the same laws. Does that mean we are going to boycott them too??? Come on Australia the Corby's are already rich enough from our support, lets think about others for a change.

Unbelieveable verdict! This skinny little brownskinned monkey judges are corrupt to the core. They ignore all evidence presented by the defense, cuz they want the conviction. Bali & Indonesia will pay dearly for this injustice. Can you imagine day after day of being in that shithole prison. I can only hope she wins on appeal. Or a prisoner exchange with Oz. Corby is innocent ? Common ? 4.1 kg and she did not know ? Impossible. If she is innocent then her brother must be the one. No wonder why Corby was so upset to her family when she heard the verdict 20 years. Unexpected !! Her lawyers and family keep on dreaming, FREE ?? Without being able to prove anything is out of question by the law. Anybody caught up in another country will have to follow their law system. If she caught up in Australia she will have to face teh same thing.

Her beauty, and her look gets the sympathy, but law is not about symphaty, law is evidence. If you are at the court during the trial you will know who is lying.

20 years for 4.1 kg is too lenient. If you say that it is too long or inhuman then you must consider how many lives will be destroyed by this 4.1 kg? How can Australian be so sure that she is innocent ? From her look ? What about if Corby is an ugly 48 years old woman, will they say the same?

I was at the court room following the trial and it was a very fair trial. The judges are very considerate and we think that 20 years is too lenient. If Corby was caught in Tangerang it will be for sure DEATH PENALTY.

If Corby is innocent, she should be able to tell the truth. Who owned the bag ? Corby or her brother ? Why did the brother who came together with Corby to Bali did not turn up and supported her ? Was he the one and Corby was trying to cover him up ? Nobody knows.

But Corby's trial is open for public and media, then you can not say that it is UNFAIR. If she is innocent then the lawyers have to try to find the evidence to release Corby and not just talking.

Ok, doesn't matter whether she is guilty or innocent, whether she actually did try to smuggle that much, but 20 years in an Indonesian prison?? That's way out of wack. But could she actually be so stupid to try to smuggle that much pot through an international airport???


By the way, they are talking about negotioating a prisoner swap. Does that mean that if it happens, the Australian gov-t might let her go free? Or does she have to serve the full time??

It's obvious that the judges in the Schapelle Corby case are vile and very corrupt. The prison guards there are supplying heroine to the inmates, so why aren't they getting busted? Those judges are a bunch of filthy, dirty little monkeys.And I for one will have nothing to do with Indonesia, or their products.

My friends and I believe, 9 pounds is way alot, too much, of drugs to be in posession of. So we feel she must have known, and she is guilty.
I know I hated the verdict. 20 years sucks. I don't believe I could survive that.

Just curious... who actually knows all the relevant facts to claim she guilty or innocent? I know its impossible for me to know... coz all i hear is media (which is assumed to be factually garbage) and the voices of people claiming her innocent... which is hard to not condemn to be biased on the basis of such media.

The best person of group of persons to do so are the judges of Indonesia (like it or not). Just because they did not come out with the right (when i say right meaning the one you wish for) does NOT signal their incompetence nor their bs juditial system. None can be perfect... you can state your frustration and your disagreements... but once again... that is based on your knowledge (perceived facts) NOT actualy facts!

I think a 20 year sentence for an innocent person is insane and of course unjust, but i have 2 reasons for not feeling frustrated. I cannot say for sure she is innocent... the fact that anyone would place cannibus in her bag (that they'd never see again) is unlikely for any drug smuggling ring. I do think that if she was used as a decoy for other drug smuggling activities... that is unfortunate... esp when it cannot be proven.

I also think this sentence brings out the issue of such drug smuggling rings. The people they harm are not just the drug addicts... its every single person who touches or associates with it... this is the bigger picture. I think it teaches every single person to be more careful of who they come into contact with... esp with the bali 9 incident as well.

Aust. government needs to pay more attention to this case and assist the Corby's with whatever they can do to bring Schapelle back home to Oz. If witnesses are not allowed to testify, two years jail term to the man who masterminded the Bali bombing and twenty years to Schapelle, UNBELIEVABLE!! Clear CORRUPTION, No justice. The indonesian government havnt done enough to find shappelle innocent. she made good points in her trial like if the police had weighed the bag they would have found a difeernce in weight n if they fingerprinted the bag they wouldnt av found hers on it. WHY dint the judge follow this up to try and find her guilty???

Has anyone considered that they should question the baggage handlers, they are the GUILTY ones, in 2004 my friend went on holidays and the baggage handler actually sliced open her locked bag and stole her camera. We know after a major cocaine bust a few weeks ago that on the day schapelle's bag went through sydney airport a baggage handler was paid $300,000 to carry a briefcase out of the airport containing 8 kilos of cocaine.

The thing to understand about Indonesia is, that it is a corrupt society. I wouldn't trust anyone there with an official position -- all they want is money (and power). A case in point: I went to Sumatra in 2000, and on the ferry there met this Indo journalist. A few beers later he invited me to stay at his house in Medan, and promised to smoke a bit of weed together. We didn't get to smoke any weed in the end, but we had just about everything else. The irony is, his brother was a policeman and he was our drug supplier! Every night we would park outside the police station, he would go inside and come back with a stash of Ecstasy and other pills. Then we would go to a nightclub where the brothers would demand a discount on drinks (because they were such important people.) It was fun at the time, but I couldn't trust the pair of them. I know police are usually corrupt, but in Indonesia they take corruption to a new level.

This is what the almighty usa is supposed to use their power to fix, an obvious case of injustice. The state department should tell the austrailian government if they don't do something to free this poor woman that they can take their kiwi, koala, bloomin' onion and all the rest of their crap and stick it where lumens don't shine. This has got to be the single most horrid example of a crime to everyone on this planet. This once happy vibrant young woman is in the worse possible situation anyone culd ever imagine and still the world does nothing. I'm one tough mf'er and I honestly have a hard time not crying everytime I hear Scapelle Corby's name. I feel so damn angry and helpless. Whether it was her weed or not, no country should have the authority to put another human being through such pain and trauma over a plant that has helped millions since it was first used in 6000bc by the Chinese for food, 2727bc for medicine and has never killed anyone and never will. My glorious country has spread it's disease called "the war on drugs" to almost every country on earth and this is a prime example of it's results. I really love my country but it is becoming more imbarrasing to be an american every day.
