Higher Penalties for Growing Pot Imminent

TALLAHASSEE – Increasing the penalty for marijuana grow house operators appears imminent in one branch of the Legislature as a new law generated little debate today before it was moved forward to a final vote.

The bill, HB 173, would bring first-degree felony charges against operators of grow houses with 25 or more plants and where children or infants are present. And the bill would charge operators with at least a second-degree felony for having 25 plants and a third-degree felony for owning a house with the intent to grow marijuana.

The law now requires 300 or more plants for those penalties.

“But can you explain how knowledge is proved and how that person should have known this was taking place?” said Rep. Audrey Gibson, DJacksonville.

She was referring to a potential situation in which a homeowner renting his house might not realize his tenants were growing marijuana.

“It could be (proven) through testimony from witnesses,” said Nick Thompson, RFort Myers, who sponsored the bill. “If the person operating the grow house is not the owner, and giving money to the people operating it, you could prove it through bank accounts, through money laundering.”

Walking up to the house makes marijuana cultivation evident too, Thompson said.

“You can smell it, the odor (from outside the house). And it's really strong when you get inside.”

Thompson, a Fort Myers prosecutor, held two large pictures on poster boards. In the first, he showed how normal a house can look from the outside, a typical suburban home in sprawling Lee County. In the second, he showed how nefarious the activity can be on the inside as the image depicted rows of marijuana plants.

This has become a problem in Lee County, where sheriff's deputies raided 70 grow houses last year, mostly in Lehigh Acres. In one incident, a home invasion in Lehigh deputies later responded to, bullet holes in the wall were just inches above a baby's crib.

A final vote on the House bill remains. A Senate companion bill on Tuesday unanimously passed the chamber's Criminal Justice Committee. If the bills are passed in both chambers and the governor approves them, they will become law on July 1.

First for the record, YES I am an actually Reverend. Second, what I am going to say might sound as a shock but in all honesty I feel that what I am about to say is TRUTH.
I do no feel that organized religion as we know it represents truth. I am of the belief that to try and define the undefinable in regards to God, Gods, or a higher power is blasphemy in itself.
Likewise this whole discussion about "heaven on earth" is futile. Personally I do not beleive in an angry God who joyfully punishes the "wicked" in a mythical place called Hell. The fact is, Hell does not exist.
In saying that, the opposite must also be true, there is no mythical land of perfect bliss called Heaven.
It is my belief that this planet Earth and this human existence IS heaven. Heaven in the sense that this is the best time and the best place in all of known history and time to exist. Life is perfect and life is Love.
But like all things it take hard work and dedication to flower to its full potential. So spread Love and in turn you will spreading Life thereby expanding upon the ideal that Earth and all its creatures are all here for one thing and one thing only, to take of each other and share Love

Just for the record: I was NOT the guy accusing High Times magazine of lying and being involved with police busts. I was answering and challenging the post before mine (Protest the police state--2nd post on April 2 at 13:41). HE made the accusation. I was simply asking for clarification, because I thought it was pure bullshit, and HT is my favorite magazine of all time. They are the ones who turned me into an activist in 1991 with their Earth Day issue (This Plant Can Save The World [something like that], by Jack Herer). So, when somebody starts making wildly paranoid claims against HT without giving ANY supporting facts, I get a little defensive...but I think I did a pretty good job of turning his statement into mincemeat.
As far as my comments being way out in the left field bleachers, it's because I hit that one way over the left field fence, in my own humble opinion. Another home run for our side.
By the way, no offense to The wizzinator was intended here. I just couldn't tell from your post if you thought that I was the one accusing HT of lying, etc., and I don't want people thinking that I'm some paranoid dipshit who makes such insane, seemingly groundless claims. If anyone has doubts, re-read my post on April 2 at 14:51 (the post in question here).

Why wait for the puppets at HT or NORML and the host of others who fight more for our money than our cause? Remember last years TV show, Jericho, which was canceled? The fans got it renewed by bombarding those who canceled it with peanuts, after the last line of the last show. What if we mailed millions of bags of peanuts to the white house? Lets freak out some politicians! It’s peaceful, it’s legal and there is not a damn thing they can do about it or, once started, stop, without ending prohibition first! Isn’t it time we did something besides acquiesces to their rules and play the voting game sham?

The rules:

1) Make the 'return' address the same as the 'send to' address. This forces them to deliver because they can't return the package to it's origin. If the white house refuses to accept the peanuts, the post office must contend with it. Which means the white house has to deal with it anyway.

2) Make the package half a pound, no more than one pound. We want lots of packages, not one big one!

3) Write in big letters 'END MJ PROHIBITION!' on the package.

4) Use ONLY the US postal service. Bringing the postal system to a grinding halt will help make the point! No point punishing UPS and the like.

5) Spread this around! Get everyone involved!

6) Ignore any protests of how terrorists can make use of it. Politicians have been ignoring us without concern for our safety. If they force us to live in fear, them let them join us at the table and share in the meal they prepared!

I run a email thats devoted to answering growing questions. So realy, im not concerned.
Obama is a good candidate.
He may not legalize, but I think he will make life easier for black people. And im sick of Black people being mistreated in court.
Ron Paul want to bring ALL of our troops home, that includes all those troops in countries youve never heard of, and I dont agree with that. So yeah, He would legalize, but theres alot of shit that I think he would fuck up. Not to mention im sick and tired of Rich Old White guys running our government.

Notice how when we had a candidate that was willing to legalize drugs, Hightimes came out with only 2 articles on him. Please don't brag about growing weed on the internet. IP addresses are saved everywhere your internet stream passes. It can be logged, printed and investigated. I would suggest that anyone who grows, either write to HT and use a fake return address or write to HT when you're on vacation far from where you live. Again if you want this plant to be legal you have to be smart about this. Screaming and yelling and name-calling each person who doesn't agree won't get you very far. I know people in congress. It's amazing how many levels of people are actually in charge of the decisions. You think it's the guy in the tie on capitol hill. Not a fucking chance. It's most likely a man in his jeans picking up fruit for his family either in Jersey, Delaware, New York or Texas. So I'm giving you good sound advice here. The folks in charge don't like the fact that 1. Everyone knows "smoking" anything is bad for you no matter how you slice it. 2. When you hear that we aren't sure about the medical facts most supporters of the marijuana movement react very rudely, erratically and tend to be more interested in insulting anyone who doesn't agree with weed legalization. So if your boss says to you "I'm not sure about this idea." Do you scream at your boss and call him names, tell him he's full of shit? No. You talk to him and ask him what he thinks is wrong. How can I make it better? What proof do I need? Now a lot of you don't feel you need to answer to authority. This is a very good trait to have. It's good to question authority and not give in to everything that you're told. However weed is illegal. So stoners are in no position to act like they're the ones in charge, which is exactly what happens. You attack the government as if weed was legal yesterday and they all-of-the-sudden made it illegal. Don't attack people, work with them. And if you do it could happen.

Which is a bunch of small clones producing small amounts. So I need ALOT of clones to get what I would off one plant. But according to the Government, a clone is considered a plant. So even though im producing the same amount of bud as people who have 20plants, I need WAY more clones. So its not far to have to this new law.
I only sell to people who are 45 and older, other then sister, and I make very little profit, if any at all, but now I have to either shut my operation down, or risk spending the rest of my life in prison for helping old people. Now how the fuck does that seem right?

If you have ever bought pot from someone you should rethink what you are saying.

In order for someone to have an ounce of pot, someone down the line needs to have a pound of pot. For someone to have a pound of pot, someone down the line needs a bail of pot - and so on down the line.

Either it's all ok or it's not ok at all - it is the same harmless plant if you have one plant in a pot as if you had 30,000 plants in a field.

While you seem a bit conflicted about weed (I can't tell if you're for it or against it) you have a point. Drug dealers tend to be more violent than weed growing hippie types. But where do you draw the line? What if one of your "hippie type" people was busted with more than 6-8 plants and they tortured them as you suggest? I think the law should be the law and it would be difficult, if not impossible, to judge a case based on whether or not the grower had dogs and guns or they were dressed in tie-dye. I think your argument has too many holes and variables to be taken seriously. You can't judge a book by it's cover...and if that WAS the law then all the "bad guys" would simply get hippie clothes.

I agree with tougher penalties for growers who seek to make money off Cannabis. If you want to grow weed for yourself then that is one thing. 6-8 plants. If you do it right that's enough for 3 or more months of personal use weed. Then, if you keep the cycle going you could have enough for yourself indefinitely. It's those who grow that have no interest in weed itself, only the financial aspect that should be locked up. Most of these people, and I've met quite a few, are shady at best. A lot of them have big guns and big dogs...clothes in a bag in case they need to escape in a hurry and their friends...usually shadier. And there are those who grow for themselves...and I've met quite a few of those too. They tend to be vegetarian gardeners that are well read and highly spiritual. They enjoy life and are usually very sweet and accessible. So yes, large pot factories aimed at financial gain should be burned to the ground...their owners and operators should be beaten very badly and thrown in isolation for at least 5 years with no outside contact and just enough food and water not to actually die. They should suffer long for their greed and should be let out with nothing more than their clothing. Then and only then will one learn that fueling addiction for one's monetary gain is a disservice to humanity. I've seen too many lives ruined by the harmless "planet saving" plant to believe in this medical and spiritual bullshit you attach to this horrible drug.

What have they lied about, and how are they helping the police? You can't just make a statement like that without even a single fact to back it up. Perhaps you are a narc, or work for a competing magazine. I will not consider your statement any further until you give me some verifiable facts. Otherwise, I will simply consider you a crank, trying to stir up trouble or paranoia because you have nothing better to do, or maybe it's part of your job in some way, or good for your business, whatever that is. Why don't you tell us a little about yourself and your personal motivations?Are you really protesting the police state? For all I know, you could be a MEMBER of the police state. On the other hand, you could be 7 years old. At least you didn't have any spelling errors, although 'Times' s/b capitalized, and 'Busts' should not.
If you really believed what you are suggesting, you would have put at least a LITTLE effort into it, rather than just one sentence. If you actually HAD any facts to back up your claim, surely you would have spewed them all out in your post with the righteous fervor of a true believer. But all we get is one vague sentence.
