Sharing Drugs? You're A Dealer!

Mon, Jul 14, 2008 3:54 pm

Hey, bad news! The Second District court—that's New York, Vermont, and Connecticut—has decided that you might be a drug dealer and you don't even know it. Back in 2003, this guy named Ricky Wallace, who lives with his dad in Rochester, poor schmuck, sold two little bags of coke to a some narc. When they came to raid the house, they found 1.5 grams of it and a good deal of pot (well, $600 worth) and an AK-47. They also found a lot of little ziplock baggies. Mmm, Rochester! His rent was $400 a month, by the way.

Li'l Ricky told the court about his stash: "Most of the time I used it by myself ... but if a lady friend comes by we use it together, you know, have some and relax...." Ah, sure. Coke is so relaxing. But uh oh! Said the court: "This testimony is direct evidence that Wallace engaged in the distribution of cocaine base." Um, if you mean "getting ladies high," then yes!

And, oy, those ziplock bags!

When the Rochester police searched Wallace's bedroom, they found (among other things) 1.5 grams of cocaine base parceled out in more than a dozen small ziplock bags; a dinner plate holding numerous new and unused small ziplock bags; a ziplock bag containing numerous new and unused small ziplock bags bearing green dollar signs; a dresser drawer full of empty and unused glassine ziplock bags; and a semi-automatic assault weapon and ammunition for it. Viewed in the light most favorable to the government, this evidence supports the inference that Wallace had the intent to distribute narcotics.

That's nice that we're viewing things "in the light most favorable to the government" to support an "inference" that someone has "intent" to do something. That'll end well for a lot of us.

I'll 2nd that opinion BBJ. You hit the nail right on the head, by calling out the "My drug is better than your drug" hypocrites.
Just as much a part of the problem as the Anti-drug Crusaders themselves. In my humble opinion.

Stupid Is as Stupid does

The clear point is.."he SOLD drugs to a NARC" that is distribution and the baggies with product inside closed his case. But what is amazing is this clown thinks he is just using with friends and has an AK-47 along with the cocaine in the same room unlocked. He will be looking at an extra 10 yrs.with that fire arm to his conspiracy to distribute.

Doing to much coke and not thinking about who he sells to is his major problem.
He will have loads of time to think about it.

It's obvious the dude was dealing, he had his product in seperate baggies, no one does that. But, as far as coke being a "bad" drug, that's not our place to decide. We all get pretty mad when people talk shit about weed, so let's not drop to that level just because we're talking about coke. As far as the AK-47 goes, this country was founded with the intent to "Keep and bear arms", -arms-. Arms are -not- hunting guns. They are weapons. Now, George Washington grew pot -and- smoked it. If he were alive today he'd not be the least bit paranoid of cops pulling him over. For God's sake, the man would've bit their nose off with his wooden teeth if they tried to hastle him, probably while brandishing an AK-47. So, before you call someone stupid for having illegal guns, consider those before us who fought and died so we could have our guns, only for us to let our own government take them away. So, while some of you think having an AK-47 is stupid, I think it is Patriotic. My thoughts.

is it just me, or is the fact that he sold coke to a narc what makes this guy a "dealer"? baggies, sharing drugs, etc. are just superfluous to this. coke is not dangerous. you see far more dangerous drugs with catchy little names and ads being sold to you on the tv every fucking day by pharmaceutical companies. if coke was so dangerous, theyd be out picking up bodies and throwing em in a dump truck here where i live because there are shit tons of crackheads and cokeheads and it would look like a massacre happened. how many people have died taking pharmaceuticals under medical supervision? people are taking coke without any oversight whatsoever and theyre not dropping dead. cokes so dangerous you shouldnt do it alone? this is dare program bullshit. just like smoking cannabis makes you grow boobs if youre a guy, or rots your brain out. i personally dont care for coke much, but everyone has the right to imbibe their choice of chemical in a truly free society and those of you bashing cokeheads for choosing a different compound than what you prefer are just as wrong as a drunk chiding you for smoking cannabis.

BooBonic

Jul 15 2008, 1:24 am

whats the point of this artical? everyday ppl get busted for drugs, it seem like HT had nothing else to write about that day. besides that, coke is a fun drug, but in moderation, like once or twice a year type of deal. all those baggies, yea, i would say hes a dealer. i mean there is a difference between a 10 sack and a sandwich bag. who cares about the weed, what is he going sell to ppl and what? buy out all the ice cream at a 711? this is where i say hes a dealer; AK-47. ive only met 2 dealers that have equipment like that, and they are basically the middle man. everyone has a weed dealer. and everyone has a dealer. most the time they're strapped w/ a 9 or a glock. not a AK. gewt what im sayin?
ps. Brandon please never post anything ever again unless you learn how to spell. correctly.

The Boss

Jul 15 2008, 12:54 am

I agree with the guy that said the coke was for personal use. I personally used to sell cocaine and 1.5g is not the amount that a dealer would have. Also i used to use coke and it wouldn't be abnormal for me to do atleast 1.5 g a day.

Yeah, while all drugs being legalized would drop street value of all drugs .... thats not the point of this article. There's nothing in this article that supports the title of the article.

Now if they were smoking pot and the guy shared it, and somehow cops saw this and charged the guy with distribution.... then maybe I can agree. But when its something like coke, having THAT much of it, the ziplock bags, his son selling it to a narc (which gives cops probable cause for a warrant) and well.... boom. The guy got caught with it all in his home. Even if it was his kid's, its HIS home so he still gets in trouble. The AK-47 was just the icing on the cake.

Selling coke? An assault rifle?! What does the title have to do with this article? Drug laws are abhorrent but this article does NOT give a good example to support that idea.

So what if the guy was a dealer. The US government has brainwashed the public into thinking that ANY drug use is their business, which it's not. And the reason dealers have guns, is because they have to defend themselves against a multi-billion dollar evil, crooked, government machine that makes drugs valuable enough to arm themselves for. Get the government out of the picture, the products value drops to nill, and cuts criminals out of the picture, like the DEA, and other criminals that produce drugs. LEGALIZE ALL DRUGS,

You guys do know that, having two bags of the same narcotic in your posesion is intent to sell right? and this poor guy had his coke in those little tiny zip lock baggies that coke dealers love. he shoulda told his dealer to put it in a cheap little light weight sandwich bag and ghetto tie the thing, no more intent to sell just posesion, so hers a tip keep all your drugs in one bag for each people.

Jul 14 2008, 4:51 pm

well first off its not realy dealing if no money is exchanged and the fact that he had some bags in his house isnt realy evedence of dealing becuse bags are a common house hold object i have probbibly 5 boxes of them in my house but hes a moron for keeping a bunch of little bags in one big one but still no drug dealer now it would have been another story if he had a bag filled with a cupple smaller lets say gram bags of coke or weed then it would be reasonalbe suspishon of dealing and who ever said that he shouldnt have told them about smoking weed and coke ur the retard it he could have gotten away with saying no about the coke becuse it only stays in ur system for like a day but if he had said no to the weed then they would have tested him and he would have been screwed im not even gunna comment on how dumb having the ak47 was but still and idk who dos alone all the time especaly with coke becuse cocain can be extreamly dangerous and it is safer to have someone there incase u od but weed everyone smokes with other people i know that i do its a chain u buy weed and call up a friend and smoke him or her up and then later when they have some theyll usualy call u unless there already with some one els but over all thats how it gose they have no proof he is a dealer he probbibly is but we all are some times cuse anyone who dose any kind of drug has soled drugs be for or gotten connections to a dealer for some one but i dont care what any one says sharing drugs and haveing wat like 3 oz of weed in ur possesion means nothing exept he dose drugs

anonymous

Jul 14 2008, 4:14 pm

skyhawk what if i had a detailed plan about assassinating the president? but i never got around to doing it becuz i got captured... intent is just the same as the deed... now the problem is, how can we tell their intent?

Reed...

Jul 14 2008, 4:11 pm

well if u think about it more than once in a logical manner it would seem that he was a drug dealer... let me start off by saying that cocaine is a terrible drug becuz it hurts far more than it helps, and the fact that its very dangerous... anyway, he had a shit-ton of lil baggies... now either he's a coke-head with ocd or he was gettin his product ready to ship out... based on this evidence alone the case is inconclusive but the report further reveals this dum mother fucker to be keeping an illegal automatic weapon in his house... furthermore, said retard had a a decent amount of marijuana... now, if u know anything about drugs its that there are good drugs and bad drugs... cocaine is BAD... weed good... but the problem is that he confesses to doing coke and cocaine is very addictive... and the hi u get from cocaine is nothing compared to marijuana so he wouldnt be keepin that weed for himself me thinks... now keeping all of these facts in mind, i present them to our retarded justice system... where we judge based on easily manipulated evidence and we are supposed to trust everyone to tell the truth... granted, we put the bad people in jail at the expense of another good man... except the one featured in the article is probably bad... hell, u know wat im gettin at...

Skyhawk546

Jul 14 2008, 4:10 pm

Im gonna have to say..making a charge an intent is bogus. Sinse when does the idea of committing a crime become one. I mean it like that movie(minority report). I just think it ridiculous. If anything he should receive a charge on his drug possession but no distribution. BUT at the same time...he does make himself look really sketchy, having all those zip lock bags and an ak-47. I mean how just casually has ak-47 and a bunch of drugs layin around.

zackb

Jul 14 2008, 4:06 pm

He probably was a dealer with all those baggies
