MASS: 1st Fine Given for Marijuana

SPRINGFIELD - A 29-year-old Holyoke man became the first person in Springfield, and possibly the state, fined for marijuana possession under the state's decriminalization law that went into effect Friday, police said.

 

Jose Burgos, of 116 Waldo St., Holyoke, was issued a $100 fine for possession of less than a half gram of marijuana when he was stopped by police in Springfield Plaza on Liberty Street at about 12:30 p.m., said Sgt. John M. Delaney, aide to Police Commissioner William J. Fitchet.

 

The citation was issued by detective Jaime Bruno.

 

Delaney said he heard that it was the first marijuana citation issued in Massachusetts, but that was not confirmed.

 

Under the law that was approved by voters in November, people carrying a half gram (?typo? the new law is under 1 oz. face civil citation instead of arrest) or less face a civil citation instead of arrest. Violators aged 18 and above must pay the $100 civil penalty to a municipal clerk. Or, offenders can appeal the citation to a clerk magistrate for a civil hearing.

 

The amount of marijuana Burgos had in his pockets was equal to about two marijuana cigarettes, Delaney said.

 

Burgos did not avoid arrest though,

 

Officers found 119 rocks of crack cocaine, packaged for sale, plus 45 bags of heroin in his car.

 

He was taken into custody and charged with trafficking between 28 and 100 grams of cocaine, and possession of heroin with intent to distribute.

 

If convicted, the trafficking charge is punishable by a mandatory seven years in prison, Delaney said.

 

Of significance of the first the marijuana citation, Delaney said, "He gets a slap on the wrist while he's doing a seven-year mandatory."

 

The new law passed despite lobbying by area district attorneys. Law enforcement officials continue to criticize the law, saying it has unintended consequences.

 

Supporters said the law is not difficult to enforce or understand.

to be quite honest with yous-if they made it legal in my state of maryland,id light one up too along with alot of others just to celebrate.our little town would be so rich in just the $100.00 fines.but also-if it was our little town-theyd plant that stuff in our vehicle just to get us more time.whod be so stupid to even come to town, light one up with all that stuff in their vehicle in the first place?even though im all for the legalization of marijuana doesnt mean-im for that other stuff.heck-when my place was raided one cop even stole $100.00 out of my purse that was going towards my bills.and no-i dont sell.but then its his word against mine-who do you think their gonna believe?and duh-yes-there are more bad cops out there than you think.

All I can Say is that Marijuana/Refer prohibition laws in North America do a lot more damage to people then smoking refer does, alone, and when anti-marijuana organizations like the D.E.A. or whoever announce to the American public that refer is a stepping stone/gateway drug that leads to hard drugs, they are admitting that it's not a hard drug by stating this.

those very idiots smoking in public will be caught, have their pot stash's taken, and given a $100 fine, and sent home, that's what the law says. It's not a free pass to blow smoke in a cops face or anything, it just means that having less than an Oz. will not result in prison time, and the instead you'd get a $100 fine and have your pot taken away. People should act accordingly, and not like fools, I agree.

What will happen if the majoroty of voters , who got this thing passed , realize they will have to put up with a bunch of dumbasses parading around and openly smoking weed 'cause they feel they can ?( and you know some will ) And then realize they didn't know enough on the subject before they voted ?

The same MAJOROTY will re-criminalize it the next time around

This particular case seems to put pot smokers in a somewhat negative light, if you ask me, this probably wasn't the very first ticket, just the first one brought to the publics attention like this, and wouldn't ya know it, he happened to also have shitloads of "rocks" and whatever else, I forget, 45 somethings of something, anyway a rediculous amount, basically taking someone who deals with the bad drugs that make ppl say "drugs are bad" and making him famous for being the first person to recieve a pot fine, as if to show the world that a randomly chosen pot head probably has alot of bad drugs on him and sells them, instead of some regular stoner caught with a joint or a dime getting a fine and walking away as the law was intended

If you think he will get charged with the $100.00 fine, then something is very wrong here!

The cops used the pot in his pocket as "cause to search" something is very wrong here folks wake the fuck UP!

But he was stupid to have the other drugs on him, GROW YOUR OWN and only use for your self, if you have to sell to stay alive then only sell the weed and to only close friends.

Some of us need a check up between the EARS as with the cops as well

They will drop the pot charge and stick him with other drug charges.

I think it is a typo in this news article - or maybe the reported confused the weight of the pot the suspect had with the weight on the other drugs he was carrying.

The new law in Mass is decrim under 1oz of marijuana.
