Judge Ends L.A.’s Never-Ending Temporary Medical Marijuana Ban

Following close on the heels of the Obama Administration’s memo that put the policy change regarding medical marijuana into writing, a Superior Court judge ruled that Los Angeles’ ban on new medical marijuana dispensaries is invalid.
The L.A. moratorium on dispensaries was originally adopted in August 2007 with the intention of curbing the influx of dispensaries opening in the city. However, Monday’s ruling concluded “that the city had failed to follow state requirements when it extended its initial moratorium.” Judge Chalfant added, "The city cannot rely on an expired ordinance."
Still the L.A. City Council members and District Attorney Cooley remain dedicated to closing dispensaries. A new draft of the ordinance will be submitted for consideration soon and Councilman Dennis Zine got all Eliot Ness in a statement:
"Anyone who doesn't comply is going to be taken down … Once we take a few down and some publicity comes about, those who are in it for the cash business will say it's too hot, let's get out of it."
