Colorado Medical Marijuana Lawsuit

The Colorado city of Centennial is being sued for forcing a medical marijuana dispensary to shut down. According to DenverPost.com the city initially issued a business license to the dispensary, CannaMart, only to close the shop a month later, claiming they had no idea the business was distributing marijuana.

 

That’s right. Centennial city officials didn’t know that a dispensary called “CannaMart” was selling pot…

 

This is an interesting case that involves constitutional rights, property issues, state and federal drug laws and local business codes. Ultimately, it could set a precedent regarding a city’s right to ban dispensaries.

 

Three former patients have joined CannaMart in the suit.

I agree , some of these shops are a bunch of young punks who act like they are doing you a favor. They never answer any questions like why is the bud wet. And they never weigh it over at all. No fronts! no credit! a personal dealer was better in that sence. And they are driving around in 120 thousand dollar bmw's. And they get away with it! i THOUGHT THE LAW SAYS THEM MUST TAKE EXTRA MONEY AND GIVE IT BACK OR OFFER LOWER PRICES.

im all for the cause... but cannamart sucked anyways, i wont be surprised if more of these dispensaries get shut down, the way a lot of them are doing it is completely unprofessional

This case will overturn the city's ruling. The state and the city needs to wake up and realize that Medical Marijuana will help the state (and the cities that have MMD's) recover from the recession more quickly for the sales tax revenue.

They will re-open. The city is at fault for denying a constitutional right (in colorado) but the dispensary owners are also in trouble for calling themselves a "Medical Supply" business which doesn't entail the transaction of medication but "medical supplys."
Colorado is doing a great job of helping the movement to progress. In city's like Durango, dispensaries are having no problems at all. Shit, Boulder has 64 dispensaries already. Progress is happening guys.. And the people will prevail.

Big companies all around this country (USA) OWN OUR GOVERMENT and If something gets in there way of profits they tell our politicians and then they act and get rid of whatever is the threat to there pockets - but when it comes down to what the PEOPLE want our voices mean nothing to them (Money talks and bullshit walks!!!!) We can thank the CEO's of America and that idiot BUSH for making our country what it is today and it is a shame that OBAMA is following in W's footsteps but then again what president in the last 60 years ever cared about what the PEOPLE think there slave's to $$$$ and we need to understand this and wake up !!!!!

smaller municipals have to abide " ... that is correct , however , most "smaller municipals " , as well as MOST states do . You are talking about the exceptions and there are exceptions on anyside of any topic. They will also fall by the wayside when/if Obama's healthcare/scamever gets passed .

It just goes to show ya, that government doesn't know what it's doing. It also goes to show ya that all government is interested in is making a BUCK. Where's the consideration for the people who are needing the marijuana for pain and suffering. Government is forcing people to have to take other drugs distributed by big-time drug industry companies, cause they are most likely getting a "kick-back" for doing so. IF GOVERNMENT WAS REALLY SERIOUS ABOUT HELPING PEOPLE THEY WOULD JUST LEGALIZE IT AND SOLVE THE PROBLEM ONCE AND FOR ALL.
I for one think the government could care less, it's time to send them a message that they can't refuse. NO pot, No work, no pot, no vote, no pot, etc. you get the point.

I thought the government was suppose to help the people, not force them to take drugs that doesn't really help, but only makes them more dependent on drugs that have as many as 4 or 5 harmful side effects. GOVERNMENT JUST DOESN'T CARE, so such it up and protest till the cows come home, cause I don't think GOVERNMENT cares a rats-ass about people who are suffering from chrontic pain or any other type of pain, or they would just legalize marijuana and set the people FREE.

Real World Wisdom - I am afraid you are not right. There have been several court cases where the cannabis user won the right to use the cannabis. There are even police stations that have to dispense it to people now after it was seized. Others have had to return all the cannabis. Just because the Feds say no, doesn't mean that smaller municipals have to abide to the letter. Many don't. Look at medical cannabis, is that legal on the Federal level? Is it legal in several states?

There is more to it than just "Fed's have ultimate control". They don't.

The city can do just about anything it wants on the subject as it IS against Federal laws conserning weed .

Centennial is a well known hard right enclave in the Denver area. I can totally see the pinheads in charge there having no clue what Canna-mart means and thinking they have the right to deny people their right to medical marijuana because they don't smoke or understand "the reefer".
