Wal-Mart Won’t Rehire Employee Fired for Medical Marijuana Use

After spraining his knee at work, former Wal-Mart employee Joseph Casias was given a drug test – standard operating procedure following a workplace injury. However, when the results came back positive for marijuana use, Casias was fired despite the fact that he is a legal medical marijuana patient in Michigan and uses cannabis to manage pain resulting from sinus cancer and an inoperable brain tumor.

 

Despite this, Wal-Mart decided to fire Casias – a former Associate of the Year – setting off a protests and plans for a nationwide boycott of the store.

 

Unbelievably, Casias, who has been collecting unemployment since his termination, recently was notified that Wal-Mart planned to challenge his eligibility. Thankfully a Wal-Mart spokesperson indicated that the company “will no longer object to Casias receiving those benefits.”

 

Additionally, the spokesperson called the situation “unfortunate” and offered the following explanation: “We’re sympathetic to Mr. Casias’ condition, but like other companies, we have to consider the overall safety of our customers and associates, including Mr. Casias, when making a difficult decision like this.” The spokesperson confirmed that Casias would not be offered his job back.

 

The Marijuana Policy Project has called for a national boycott of Wal-Mart. The group’s director of state policies, Karen O’Keefe, added, “It’s despicable that Wal-Mart would fire such a hardworking and seriously ill employee simply for treating his symptoms with a medicine that he is authorized to use under state law.”

 

There may be room for legal action should Casias pursue it as Michigan offers some protections for employees who legally use medical marijuana. According to a spokesperson for Michigan’s Department of Community Health (the office that oversees the medical cannabis program), “You can’t discriminate against a person if you have a medical marijuana card, and if they use it for medicinal purposes.”

i too was fired from walmart for teating positive after 11 years of employment.but heres the thing i went threw all of there policies and no where did it say they had to fire me.imediate termination only results from coming into work under the influence. i had a accident but was not under the influence of any substance at the the time.

I once opened a door at work , inthere was the item i was looking for and a co-worker looking at me like a frightened deer frozen with fear and white stuff sticking between his upper lip and his nose , his finger still on one side of his nose...oops! I just carried on like business as usual and there weren't any problems. This story is atrociously sad and has been repeated over and over with the corporatization of the world. I boycotted them for years and have gone there a few times lately but am definitely going to re-commit to a total boycott as well as tell everyone I know whenever I can what a fucking evil empire they are.

I've boycotted Wal-Mart since I quit in August of 2006 after working there for more than 4 years. I quit because the direction the company was moving just didn't agree with my ethics. To this day I have never stepped inside of one. I am proof that there are other alternatives for shopping for groceries and goods. Like previous posts have said "vote with your dollar". Companies will listen to that....

Think about it. Companies like this, move into cities and towns. Soon after they move in, local mom and pop shops begin to close because they can't compete with the competitions lower prices. Soon these companies become the major employer in the communities that they're located. People are forced to work for the low wages with little benefits that they provide. Having such a broad and diverse workforce, these companies eventually end up hiring the sick and disabled. The company in question has a history of bad employee relations. I can remember a few years back, employees at a particular store voted for union representation. The company attempted to fight the employees in court. The company failed and the employees right to organize upheld. Soon after, the company closed the store.The largest mega store chain has failed in many ways. From their purchase of near slave labor items, to their base pay rate for floor employees. I've grown to despise the big chain stores. I get an odd feeling when ever I am in one. I feel like I am in a warehouse for chinese made goods. In a nut shell, the american poor work for low pay in a warehouse selling products made with slave labor from abroad. The big chain stores are exploiting labor on both sides of the pacific.
This issue is much bigger than one man getting fired. This case shows the mindset of the big box stores. This man was hurt on the job. I am sure that before they asked if he was ok, they were checking for drugs. That's the way it is for many companies. When ever there's an injury, look for a way to skirt responsibility. My hope is that more people will see things the way I do. Maybe we'll give another thought to the family owned grocery stores. Maybe we'll search for the mom and pop gas stations. We could even shut the tv off for the day and visit family. It's our dollar that feeds the corporate machine. We have the choice of who to give our dollars to. If you're someone that believes in righteousness, then perhaps now is the time to make a difference. Don't shop in the stores that violate your personal moral code. Only go to gas stations that give their employ good pay. Vacation no more than 300 miles from home. There are many ways, many things we can do. And those are my thoughts, till next time. It is unfortunate that the gentleman was deposed of his position with the WalMart company..Perhaps he should just sue them for unfair labor practices. Anyway, if you read this, as an act of solidarity with a person who is getting the stick from a bullying entity it might be good if we all just stop buying from WalMart, if you haven't already.They are first on the list of chain stores that are negligent to the laws concerning overtime, injury and medical claims, harassment, and product origin..Yeah, they obviously have their act together; they do offer jobs, they donate money and products to the local community, etc. But they also look at labor as an expendable and easily replaced resource should there be any minor insurrections. It would help the man who was fired if we just stop going to WalMart.It can show what happens to bullies who get confronted. .Well, I'm new to this website so I'll stop yammering and finish with this...TOTAL BOYCOTT!

It is unfortunate that this man who legally had the right to use cannabis for health reasons, lost his job. I have noticed when hired, employers usually ask what medications you take, the doctor you see, and send you in for a pre-employment physical, drug test etc. I am just wondering if Walmart follows this policy. I am sure they do pre-employment drug screening. And if the state has decriminalized marijuana, then that should be the policy each employer must be aware of and consider when employing legal users.

I do think they should rehire him, sounds like he was a asset to their store,not a liability, as they have suggested by firing him. But personally, I wouldn't want to have to set foot in that store again,maybe he will have the opportunity, and do it just to prove a point;that he is a good worker, fighting major illnesses, and is trying to continue to have as normal of a life as possible with the help of marijuana. Would they be so concerned if he was prescribed, morphine, oxycontin and all the other powerful legal opiates, usually prescribed to chronic pain sufferers?

But Unfortunatley we live in whats called the corporate world and Wal-mart like many others has a very strict no tolerance policy. Are you gonna stop going to the grocery store because an employee there who smoked marijuana be it recreationlly or medicinally gets fired? No because if ya did you woudnt be eating!!! Hell being in California, a very marijuana-friendly state the same rules apply. Should marijuana be decriminalized?, Yes of course but until it is, each of us has a responsibility in the work place and if your employer doesnt allow a medical marijuana exception why dont you go and ask them First off Why and than put you in the company owners shoes! I know i sure dont wanna pay out money cause of someone fucking themselves up while high. And not saying all of us who smoke are stupid, but it is the select few that are not very bright who are smoking "to be cool" that ruin it for the rest of us. As far as the JEW BASTARD comments, who cares about a persons religion, im sure ya aint complaining when ya stop and see Apu and Habib on your way to work at the 7-11 when ya get your coffee. In Michigan, sending someone for a drug test when they get hurt on the job is standard procedure. If the company finds drugs, you're quickly fired, with no recourse for your injuries. The man who was fired has protections under the law, when the dust settles, walmart will be paying him all his back pay and then some.

I agree with wants to help but can't. How many employers hire functional alcoholics, many who come to work hung over, but fire or do not employ pot smokers because of the subsidized discrimination of the federal government?

It's just not fucking fair.

Other than their business practices(low-balling manufacturers prices, importing 99.99% of their products from China, giving workers 34 hours a week to avoid paying benefits) this story is just another reason I will not shop at Wal-Mart.

I have watched as known alcoholics come to work hung over, yet still have their jobs. No laws against drinking a 5th then going to work the next morning. I guess those fucking retards dont think thats dangerous. I once smoked until I passed out. Went to work the next day, alert, awake, and on top of my game. Oh, but thats against the law. Where are we? I thought we were smarter then this. I have no health ins.(unemployed and full time student) and I m not suppose to smoke a little on the weekends. WTF?

i think society should give stoners a honest chance to prove they are not a danger! and customers don't need to be protected from the children of the bong, we are no children of the corn!or some other harmfull abusive sect.Some of us are a bit like the cable guy but we've got them in check, no problemo,But seriously they should have this WAL-MART megastore exclusivly run by stoners for like a year or so, than evaluate and compare salesnumbers , i think they are in for a big suprise!All stoner WAL-MART customers should ask for the manager and confront him with some persuasive arguments to actually realise this proposal!And growerssupplies should be added to the list of items available at WAL-MART!And most definately a BONG-section with everthing from grinders to bongcleaner and vaporisers which can be sitetested ofcourse.And in the Coffee-Corner they sell the most delicious POT-brownies, yes customer satisfaction is our prime directive!

If WAL-MART was smart, they'd sell growstuff, seeds and marijuana,..but they don't so i take my fat wallet someplace , to smart people who sell quality items, no WALL-MART-CRAP

Well, make that an international boycott and if i were Casias i don't know if i would that job back after being treated that way. This company had nothing on him before ,even better, his efforts on the workfloor didn't go by unnoticed, maybe a reason for a rival company to aquire this excellent worker(performing above average despite serious injury).WALL (S)MART?, i don't think so.
