Good Morning

02/16/005, 7:00am, I listened to the dogs going wild and collected myself before getting out of bed. I had been living at Eddy Lepp's Medicinal Gardens for two months and knew that this was not our usual wake up. When Linda Senti called for me to get dressed, my suspicions were confirmed. I walked down stairs and sat on the floor as directed by the armed DEA and NTF Officers. Next door, documentary film maker and director of Hello Jazz Productions, Jason Dunlap, was being forced
to dress in the background while giddy DEA officers snapped personal photos of Dunlap's hand lettered sign reading "Go Away DEA."

Freedom of the Press

Once they had us all seated in the same room, Dunlap and I requested to be able to record the happenings. A tough-guy officer refused us and then asked our names. When we inquired if we were under arrest, we were informed that if we told them our names they would tell us our status. Confused by this double talk we did not answer and were arrested and removed by 7:30am. No other media was on site for the remainder of the raid.

Third Time’s the…

This is Lepp’s third raid by the DEA. He and Daniel Barnes were arrested and are now being detained on charges of cultivation and selling. According to the U.S. Department of Justice, on January 19 a DEA Task Force Officer working undercover purchased one pound of high THC marijuana for $2,500.00 from Lepp with Barnes acting as the go-between. The TFO was wearing a wire and his report states that there was no discussion of the marijuana being for medical purposes.

4.8 Million Dollars of Unrooted Clones, Seized!

During Wednesday’s raid, agents allegedly seized approximately 4,700 marijuana plants, 1,600 unrooted clones, ten pounds of processed marijuana, and 16 pounds of partially processed marijuana. Because of the assumption that each clone would eventually bear at least one pound of marijuana, the estimated value of an unrooted clone was $3,000.00. The average price of a clone at a marijuana dispensary is between five and ten dollars.

What’s Next

If Lepp and Barnes are convicted, they face a mandatory minimum of ten years in prison. Lepp has yet to be convicted for last year’s raid, when over 32,500 outdoor plants were massacred alongside the California Highway 20. Because of Lepp’s openness and pride in his legal right to grow medical marijuana, DEA officers informed him last time that he had embarrassed them, so what did he expect? This time there was very little discussion; Dunlap and I were compliant while “resisting arrest,” there were no fire arms that did not belong to the officers, and no person from Eddy’s gardens made any trouble.

That’s a Wrap

Dunlap and I were bailed out of jail by Lepp’s close friend and neighbor, Jack Herer. Dunlap returned to find that much of his camera equipment had been thrown into the middle of the floor and around 300 hours worth of footage for his documentary on Eddy Lepp had been taken as evidence. The house was torn apart; one section of the ceiling is now collapsed as an officer fell through trying to search a crawl space. The officer in question was not identified to us.

so eddy's very big house was remodled after his "bust". he put thousands of dollars into his exsisting 500+ thousand dollar house after the "bust". did the med patients ever get any of their money back...no. he basicly robbed the couple of hundred patients that he scammed into giving him money not to include the people that put all the work into his"gsrden". it wasnt a garden it was a monetary pot field where he and he alone was going to make a million at least to further his ego as a guru mean while leaving his "patients out in the cold and a little poorer so he could travle to the cannibus cup. so he could hang with the "stars" and in turn be a "rock star"(in his own words). his use of normal people to extend his political agenda has reached its end (i and everyone he has cheated should be praying to Jah that karma is dealt out properly not that shiva should protect him). we should all be hoping for justice. just because someone grows doesnt mean they are a guru or a medicine man and by the way he tries to build up his "house on the hill" at others expense and tries to be the "rock star" off the back work of anyone he can dupe into believing his shit he deserves justice not compassion. im a firm believer in pot rights but this isnt what everyone who believes eddy's crap is thinking it is. he is a hypocrite that has stolen the patient's money and is still livin the "drug dealers life". big house, yearly birthday parties, big pot harvests, still off the backs of those who would truly believe in the divinity of the herb, and trips all over the world to show himself as a martyr. he was paid in full for his martyr dumb it was his exploited patients that dont feel like rock stars. they are the ones in a seedy neighborhood tryin to score while he lives large. justice i say is what we should want as a community not mercy. i still say let God sort it out! i think we will find eddy burnin rather than lootin if that came to pass. eddy lepp is a thief that stole a chance for the sPOT light. he took a bribe to increase he profit on his "field of dreams" and ended up pushing the limits past what the county was willing to allow there by ending in a bust which not only lost his "patients" medicine but got a lot of people in trouble. he has run a marijuana garden for years and has stolen labor, and any other thing he could get from people that truly believe in his "religious" speel. he isnt the REVEREND that he claims to be, talkin about how women should be lining up to suck his duck, he is a thief with delusions of grandure. his wife linda would be ashamed that he is concidered to be this guru when he was in bed with her best friend inside of a month after she died the whole time telling everyone he was so sad she wasnt there anymore. lets see eddy behind bars as karma would dictate for the stress his ego and the subsequent bust put on his wife there by leading to her collapse and finally her death. good goin eddy the world should be praying that you get what you deserve

Seriously, though. Pot was KEPT illegal, after being made illegal for silly, uninformed reasons way back when, because of our culture and consevative values. People still aren't convinced that making pot legal is safe. They fear your local Spicoli kind of character, but millions more. It's funny how legalisation is somehow equivalent to increased drug use. I didn't smoke pot till I was 18, and I'm 22. But I never believed/realized that SOO many young people, like 14-16 smoked. I don't think it's a terrible thing, but it does concern me, and people who want it legal should discuss this kind of thing. We need to look at it form every angle. So far, all I hear is "it's medicine", "it's never killed anyone", "it will stimulate the economy if we tax it", yada yada. This is so unrealistic. I don't want only people with doctors notes getting high, while I am forced to inhale through some dirt ass pipe or some sketchy electronic device. I want to grow a small field of it so I can make my own food products for my friends and I. I'm such a criminal for wanting that, though... it's like being criminal for trying to get someone to stop smoking cigarettes.

This was not a case of entrapment. Entrapment is when the cops CON you into doing something you would not normally do. Example.....the UC cop tries to buy 1/8 oz from you for $20 and you say no. Then the cop then offers you $100 or $200 for the same 1/8. In this case a guy who has an 1/8 for personal use who would not normally be a seller may very well be inclined to sell this once becuase $200 is a lot of $$. THAT WOULD BE ENTRAPMENT.

If the UC says give me an 1/8 for $20 and you say OK and hand it over.....your a drug dealer all on your own DUMBASS!~

I think that the way he handled this raid was great. What many of the people in the communities think about us smokers is all bad news but here is a case of the government having nothing better to do than go entrap someone who isn't bothering anyone. I certainly agree that the proper way to change laws is through education and persuasion. Some here seem to forget that. Those screaming fuck the police only detract from the main message. The vast majority of people support law enforcement, but when they see parts of any movement, be it medical marijuana or any other, acting in such a way, they are turned off. IN other words, the big mouth immature morons set the cause back every day. I can't count the number of times I've heard politicians and lawmakers refer to posts like that of Jakey and G money in this thread and not have to say another word to make their argument.

I agree that some are judging Eddy too harshly. I am very skeptical about that wire the narc was wearing. Tapes can be edited and the government lies. They could have sent the narc in with all the proper certs for an AIDS patient then conveniently left that out of the evidence and recording. They were after Eddy and I don't think honesty applies when they are trying to keep "harmful drugs away from kids" or sick people.

I'm not sure one way or another about the legal details being discussed by Kurt and WT, but it does not really matter.

Whether he was entrapted, or even set up conspiracy style, does not really matter because the fact is he sold 1lb. of the Herb to a DEA. That's a pretty serious felony no matter what state your in and no matter whether it's interstate commerce or not. Of course you and I agree that the smoking of mildly intoxicating flowers by responsible adults should be legal, but many do not agree with us.
Our job then is education and activism. We must spread awarness to the populace and to the lawmakers. We must try to BECOME the lawmakers and that is a pretty serious commitment to the Herb, but the laws are pretty seriously fucked up right?

I'm by no means a lawyer (I'm predominantly honest). When the Raich case got docketed to the supreme court, there were was some discussion on MSNBC's Abram's report (their legal show) all I remember out of it was the pundits saying how the feds were shoehorning the interstate transit act as their means of dealing with it. The simple fact is Pot should be legal. Nobody should go to jail for it. For the last 13 years the President of the United States of America has been a pot smoker, but no-one other than Kucinich in politics has the balls to say or try to do anything about it. I severved this country honorably in the Armed Forces fo over 9 years. My first and most solemn oath was to defend the Constitution against all enemies foreign and domestic. I failed, our constitution is trounced on every day by the poor options of candidates we have to choose from and the Judges they appoint. It sickens me to no end. The bottom line is nobody should be punished, demonized or looked down upon in any way shape or form for possesion, use or distribution of Pot. Don't get mad at Eddy, he's a good bean, get mad at the worthless piece of shit politicians that our needlessly ruining our lives.

I'm not sure if your'e referencing the interstate transit law correctly, I believe they really just have a problem if the pot crosses state lines and is sold without CA getting revenue. However everyone agrees that the law was never intended to be used as it is now, eventually some one will bust up on the feds using that over played trump card in the drug war. At any rate the Constitution A4S2 trumps it anyways which I interpret to be us in florida cannot be excluded from the same priveleges as someone in CA.

The Raich case is very important, or at least has the potetial to do a lot for decriminalization. I also feel the judges are likeley to throw out right and wrong and sumarily rule against her. Our govt has a simple hierarchy of laws with the constitution trumping them all. If the judges rule that feds cannot raid medgrows in states that legalized then Article 4 section 2 of the US constitution shall apply to all states "The citizens of each state shall be entitled to all privileges and immunities of citizens in the several states". That's also why I beleive they will rule against her regardless of comon sense - right and wrong. It could cause a free for all...

No it won't. It will stop the seizure of gardens that use only California grown lumber, California soil, california bred seeds, fertilizer etc. As long as nothing used in the grow or none of the products of the grow come from, or end up in, another state, thereby avoiding the interstate commerce clause. Otherwise the supremecy clause will be valid. If you're a DR, I shouldn't have to explain all this. I'd venture to say that something is Eddy's huge garden was not manufactured in California, but hey, I could be wrong...

The bust with 32,000 plants was a case of the feds exercising their authority ofver marijuana as a controlled substance. The Raich case, should it be ruled in her favor, will forbid the feds from raiding medicinal gardens in states that allow medicinal growing. Those 32,000 plants were the California-legal property of multiple patients. They just happened to be growing on land owned by Lepp and rented to patients/care providers.

Actually he's facing a life sentence which would stop him from growing as well as selling marijuana. If you support medical marijuana, you should be upset with his, "In your face" antics. He's potentially setting the movement back years. People see through this cover and will side with the Gov't when they say the medical marijuana movement is a front for legalization. THIS case is separate from the Raich case because the prior raids were on medical growing--selling to an entrapping agent of the feds is, of course, a different matter. I agree with Kurt, it's not common practice to just dole out pounds to anyone. Set up is most likely, but that's the way the justice system works under prohibition and exactly why YOU must stand against it--join your local NORML chapter & help change the laws!

I don't think we have enough details to rush to judgement against Eddy, I was at the cannabis cup - saw - and met him - he seemed like a pretty sincere person. The report said the undercover person buying the lb was wearing a wire and that no discussion of medicinial purposes were made. Well, you just don't go walk off the street and buy a lb from anybody. If I were a betting man I would bet that all the up front discussion and screening for medicinal purposes were handled way (daysweeks) before the physical transaction was made. When i go to a pharmacy and get a prescription refill, I just show proof of who I am and pay my co-pay, no-one asks me what it is going to be used for. It is far more likely Eddy was set up and any recorded evidence will taken out of context and presented in the worst possible way. Just like we have books that show how to grow pot, Law Enforcement agencies have publications that show how to "get around" probable cause. At any rate we live in a police state. 750,000 americans were arrested last year for Pot. There is no reason whatsoever pot should be ilegal. This sucks and it is another sad commentary on how far our government has gotten out of control. Our founding fathers must think we are spineless pussies for allowing this to go on!

Seems like the feds might be a-scared they're going to lose the Angel Raich case before the Supreme Court. If/when they do, the prior busts of Eddy's gardens are going to be thrown out. As it is, they set him up on a distribution charge, one that isn't protected by medical laws.

It's legal to find out who the feds were who busted him and to set up protest vigils outside their homes, on public property. "Daddy, why are there 500 people outside chanting 'Free Eddy Lepp?'"

I'd like to thank Eddy and Daniel for setting the cause of medicinal Marijuana back even further with their uncanny ability to draw nothing but negative attention to the problem. The
people of this state who voted in Props 215 and 420 can just as easily yank them out from under us if they think the law is being abused. And quite frankly I'm a little sick and fucking tired of this movement being led by a bunch of drug dealears.
Selling to a DEA agent was really the last straw, these guys have no defense. You can't beat them at chess, if your playing checkers guys.
We don't need them or their bad press.

This is just another example of whats wrong with the world today, a government robbing sick people of much needed medicine in order to justify the billions they squander on a war they will never win or even make an effective dent in. I wonder if it was any of these "agents" friends or family members that were suffering needlessly would they have the same attitude towards a simple plant that can and does alleviate symptoms for which many of their sanctioned,side effect infested,government approved crappy pills do not. God Bless America? I sure hope so.

If the government finally legalized marijuana, they'd stop their bitching and moaning because they would then get their greedy hands on a big chunk of the action. In the end, we would all get to smoke some hooch in front of the courthouse, just like back in the day!
