Any day that starts with fire arms and ends with Jack Herer picking you up from jail, joint in hand, has to be an interesting one…
Good Morning
02/16/005, 7:00am, I listened to the dogs going wild and collected myself before getting out of bed. I had been living at Eddy Lepp's Medicinal Gardens for two months and knew that this was not our usual wake up. When Linda Senti called for me to get dressed, my suspicions were confirmed. I walked down stairs and sat on the floor as directed by the armed DEA and NTF Officers. Next door, documentary film maker and director of Hello Jazz Productions, Jason Dunlap, was being forced
to dress in the background while giddy DEA officers snapped personal photos of Dunlap's hand lettered sign reading "Go Away DEA."

Once they had us all seated in the same room, Dunlap and I requested to be able to record the happenings. A tough-guy officer refused us and then asked our names. When we inquired if we were under arrest, we were informed that if we told them our names they would tell us our status. Confused by this double talk we did not answer and were arrested and removed by 7:30am. No other media was on site for the remainder of the raid.
Third Time’s the…
This is Lepp’s third raid by the DEA. He and Daniel Barnes were arrested and are now being detained on charges of cultivation and selling. According to the U.S. Department of Justice, on January 19 a DEA Task Force Officer working undercover purchased one pound of high THC marijuana for $2,500.00 from Lepp with Barnes acting as the go-between. The TFO was wearing a wire and his report states that there was no discussion of the marijuana being for medical purposes.
4.8 Million Dollars of Unrooted Clones, Seized!
During Wednesday’s raid, agents allegedly seized approximately 4,700 marijuana plants, 1,600 unrooted clones, ten pounds of processed marijuana, and 16 pounds of partially processed marijuana. Because of the assumption that each clone would eventually bear at least one pound of marijuana, the estimated value of an unrooted clone was $3,000.00. The average price of a clone at a marijuana dispensary is between five and ten dollars.
What’s Next
If Lepp and Barnes are convicted, they face a mandatory minimum of ten years in prison. Lepp has yet to be convicted for last year’s raid, when over 32,500 outdoor plants were massacred alongside the California Highway 20. Because of Lepp’s openness and pride in his legal right to grow medical marijuana, DEA officers informed him last time that he had embarrassed them, so what did he expect? This time there was very little discussion; Dunlap and I were compliant while “resisting arrest,” there were no fire arms that did not belong to the officers, and no person from Eddy’s gardens made any trouble.

Dunlap and I were bailed out of jail by Lepp’s close friend and neighbor, Jack Herer. Dunlap returned to find that much of his camera equipment had been thrown into the middle of the floor and around 300 hours worth of footage for his documentary on Eddy Lepp had been taken as evidence. The house was torn apart; one section of the ceiling is now collapsed as an officer fell through trying to search a crawl space. The officer in question was not identified to us.

Seriously, though. Pot was KEPT illegal, after being made illegal for silly, uninformed reasons way back when, because of our culture and consevative values. People still aren't convinced that making pot legal is safe. They fear your local Spicoli kind of character, but millions more. It's funny how legalisation is somehow equivalent to increased drug use. I didn't smoke pot till I was 18, and I'm 22. But I never believed/realized that SOO many young people, like 14-16 smoked. I don't think it's a terrible thing, but it does concern me, and people who want it legal should discuss this kind of thing. We need to look at it form every angle. So far, all I hear is "it's medicine", "it's never killed anyone", "it will stimulate the economy if we tax it", yada yada. This is so unrealistic. I don't want only people with doctors notes getting high, while I am forced to inhale through some dirt ass pipe or some sketchy electronic device. I want to grow a small field of it so I can make my own food products for my friends and I. I'm such a criminal for wanting that, though... it's like being criminal for trying to get someone to stop smoking cigarettes.

I certainly agree that the proper way to change laws is through education and persuasion. Some here seem to forget that. Those screaming fuck the police only detract from the main message. The vast majority of people support law enforcement, but when they see parts of any movement, be it medical marijuana or any other, acting in such a way, they are turned off. IN other words, the big mouth immature morons set the cause back every day. I can't count the number of times I've heard politicians and lawmakers refer to posts like that of Jakey and G money in this thread and not have to say another word to make their argument.

Whether he was entrapted, or even set up conspiracy style, does not really matter because the fact is he sold 1lb. of the Herb to a DEA. That's a pretty serious felony no matter what state your in and no matter whether it's interstate commerce or not. Of course you and I agree that the smoking of mildly intoxicating flowers by responsible adults should be legal, but many do not agree with us.
Our job then is education and activism. We must spread awarness to the populace and to the lawmakers. We must try to BECOME the lawmakers and that is a pretty serious commitment to the Herb, but the laws are pretty seriously fucked up right?

I'm by no means a lawyer (I'm predominantly honest). When the Raich case got docketed to the supreme court, there were was some discussion on MSNBC's Abram's report (their legal show) all I remember out of it was the pundits saying how the feds were shoehorning the interstate transit act as their means of dealing with it. The simple fact is Pot should be legal. Nobody should go to jail for it. For the last 13 years the President of the United States of America has been a pot smoker, but no-one other than Kucinich in politics has the balls to say or try to do anything about it. I severved this country honorably in the Armed Forces fo over 9 years. My first and most solemn oath was to defend the Constitution against all enemies foreign and domestic. I failed, our constitution is trounced on every day by the poor options of candidates we have to choose from and the Judges they appoint. It sickens me to no end. The bottom line is nobody should be punished, demonized or looked down upon in any way shape or form for possesion, use or distribution of Pot. Don't get mad at Eddy, he's a good bean, get mad at the worthless piece of shit politicians that our needlessly ruining our lives.

I'm not sure if your'e referencing the interstate transit law correctly, I believe they really just have a problem if the pot crosses state lines and is sold without CA getting revenue. However everyone agrees that the law was never intended to be used as it is now, eventually some one will bust up on the feds using that over played trump card in the drug war. At any rate the Constitution A4S2 trumps it anyways which I interpret to be us in florida cannot be excluded from the same priveleges as someone in CA.

No it won't. It will stop the seizure of gardens that use only California grown lumber, California soil, california bred seeds, fertilizer etc. As long as nothing used in the grow or none of the products of the grow come from, or end up in, another state, thereby avoiding the interstate commerce clause. Otherwise the supremecy clause will be valid. If you're a DR, I shouldn't have to explain all this. I'd venture to say that something is Eddy's huge garden was not manufactured in California, but hey, I could be wrong...
