The California Supreme Court threw out the controversial decision (Pack v. City of Long Beach), which previously held that federal law preempted some forms of dispensary regulations.
Several municipalities, including Los Angeles and Long Beach, used the Pack decision to ban dispensaries. Now those bans may be considered unlawful.
As it turns out, the dismissal was based on the Long Beach City Council changing the ordinance to an outright ban on dispensaries after the State Supreme Court agreed to review the appellate decision. This rendered the issues before the court moot.
There are other dispensary-related appellate cases pending review by the California Supreme Court later this year. For the moment, however, the dismissal of the Pack decision creates an uncertain standing for such dispensary bans.
