The first-ever recreational pot commercial was supposed to air on an ABC affiliate in Denver this week but got pulled Monday night due to legal concerns.
Although recreational and medical marijuana use is legal in the state of Colorado, the federal government—which still considers cannabis illegal—regulates airwaves.
“Scripps has decided not to accept marijuana advertising at this time,” a spokeswoman for E.W. Scripps, the company that owns the station, told CNN Money. “We are proud to be a company of free speech and open expression, but we have concerns about the lack of clarity around federal regulations that govern broadcast involving such ads.”
The advertisement was for Neos, a company that sells cannabis oil and vape pens; however, the ad does not mention marijuana nor does it show any images of pot.
According to Cannabrand, the ad agency behind the commercial, Colorado law allows for marijuana TV ads to air when 70 percent of the audience is 21 or older—and the spot was slated to run late Monday night during the appropriate time slot.
