THC TEXT PROGRAM TERMS OF USE

These Text Program Terms of Use (“Text TOU”) govern your use of the text messaging marketing program (the “Program”) provided by Trans-High Corporation (“THC” or “Company”). Please read this Text TOU carefully. Only persons aged 21 and older may enroll in THC’s Text Program. By opting into the Program, you agree to this Text TOU, the Company’s Privacy Policy and the Company’s overall Terms of Use, as amended from time to time (collectively, the “Terms”). Your access to, and use of, the Program represents your agreement to these Text TOU. IF YOU DO NOT AGREE WITH THESE TERMS, INCLUDING THE CHANGE OF TERMS, DO NOT ACCESS, SUBSCRIBE TO, OR USE THE PROGRAM.

As a Text Program member, you may receive special deals, coupons, event information, and other offers and promotions communications. The THC Text Program sends recurring texts via automated technologies, which may include automatic telephone dialing systems (“ATDS”). 

Express Prior Consent 

When you provide the Company with your mobile phone number and opt into the THC Text Program, you are expressly agreeing that the Company may send recurring SMS and/or MMS text messages with automated technologies, including ATDS, to the enrolled phone number unless and until you cancel your enrollment. Message and data rates may apply; you agree to pay the charges to your wireless bill or to have them deducted from your prepaid balance for this service. Reply STOP to cancel anytime or reply HELP for help to find a link to this Text TOU.

If you signed up by texting a signup keyword, you will receive a confirmation text message, and you may need to reply “YES” as instructed to complete registration. Consent to receive promotional text messages is not required as a condition of purchasing any goods or services.

You understand and agree that the Company’s marketing communications are separate from any transactional text messages (i.e. delivery notifications, invoices, etc.) that you may receive in connection with any purchases for which you provided the same mobile number. Opting out of the Text Program will stop marketing texts, but does not impact the separate transactional text messages sent in regards to orders. 

Opting Out 

You may opt-out at any time by texting the word STOP in response to any text. If you opt-out via a STOP request, you agree to receive a Text Program text message confirming your opt-out from the THC Text Program. You then will not receive marketing texts from Company unless and until you re-enroll in the Program.  As noted above, opting out of the Text Program will stop marketing texts, but does not impact the separate transactional text messages sent in regards to orders.

Alternatively, you can opt-out of receiving texts from the Company by either sending an email with your mobile phone number, and requesting to unenroll from the Text Program, to privacy@hightimes.com. If you chose to opt out via this method, please allow up to 7 business days from when the email request was received to process your removal.

Help 

You can respond “HELP” to any text to receive information and a link to this Text TOU and information on how to contact THC.

Agreement to Update Your Contact Information 

You agree to notify Company of any changes to your mobile number and update your subscription with Company to reflect this change. You may do this by texting “STOP” in response to any Text Program text before you change your mobile number, and going online to enroll your new number. You may also contact Customer Service at customerservice@hightimes.com<mailto:customerservice@hightimes.com> and providing your old number, your email address, and the new telephone number you’d like to enroll, so that you can receive an invitation to join the Text Program from your new number.

Requirements 

To take advantage of the Company’s text messaging marketing program, you must have a text messaging-enabled mobile device with a text messaging plan. Your carrier may prohibit or restrict certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.

The Company’s text messaging marketing program works with all major U.S. carriers including currently: AT&T, Sprint, T-Mobile, Verizon Wireless, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and a host of other smaller regional carriers. 

Change of Terms 

The Company reserves the right to modify these Text TOU by posting new versions on this website as well as the right to provide additional notices of significant changes. Your continued use of the Program following such changes constitutes your acceptance of those changes.
